Description: Devices must be compliant/Director or designated staff person ensure compliance

Noncompliance Area: More than 30 days has passed since the last test which was conducted on 01/12/26.

Correction Required: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. § 1016(c)). The Director or designated staff person who is responsible for compliance with this chapter shall ensure the requirements under subsection (a) are met.

Regulation: 3270.113(a)(1)

Description: Staff assigned to specific children

Noncompliance Area: At approximately 1:15pm in Room 2 (Sun Room) one staff and three children (2 infants, and 1 young toddler) were observed. During the onset of supervision and ratio, when staff was asked to identify and name the children whom they were responsible for, Staff person #4 identified and named 2 infants thus leaving the 1 young toddler unaccounted for. When asked who was responsible for the one unnamed child Staff person #4 said Staff person #1, who was out of the room on their break, was responsible for that child. Staff person #3, who was in an adjacent room (Room 1, Living Room), also confirmed that Staff person #1 was responsible for the young toddler. Therefore, it was determined that Staff person #1 was observed to not be physically present with their assigned group of children.

Correction Required: Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises.

Description: Comply with CPSL/CPSL information

Noncompliance Area: The staff file for Staff person #1 lacked a valid Child Abuse clearance; the Child Abuse clearance on file is dated 8/14/20 which is more than 60 months old. The staff file for Staff person #2 contained a current National Sex Offender Registry (NSOR) check dated 11/14/25 which was not renewed within 60 months of the previously dated 11/4/20 NSOR check on file.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services) LACKING REQUIRED HIRING DOCUMENTS: Staff Person #1 -- may not work in a childcare position at the facility. A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Staff Person #1 --- may not work in a childcare position at the facility.

Description: Staff evaluations

Noncompliance Area: The staff file for Staff person #1 contained current staff evaluation dated 6/4/25 which was not completed at least once every 12 months from the previous staff evaluation on file dated 5/20/24.

Correction Required: A director is responsible for written evaluation of staff persons on a regular basis, a minimum of one evaluation every 12 months.

Description: No business simultaneous use/Requirements specific to school-age programs

Noncompliance Area: At approximately 10:15am, in Room 3 (Dining Room) which is measured childcare space, one young school age child and one staff person were observed and when asked stated the young school age child was attending cyber school through Commonwealth Charter School therefore the space is being used for a purpose other than childcare.

Correction Required: Indoor space in which children are receiving care may not be used simultaneously for other business, commercial, social or another purpose unrelated to the child care being offered. If a child is required to be enrolled in public or private school under the Public School Code of 1949 (24 P.S. §§ 1-101-27-2702) and if the child is not enrolled and if the child is not exempted from enrollment under the Public School Code, a child care facility may not admit the child for care during the hours when the child is required by law to attend public or private school.

Regulation: 3270.65

Description: Protective Outlet Covers 5 yrs. or less

Noncompliance Area: In Room 4 (PreK 3) a 6-outlet grounded wall tap adapter located to the left of the TV was observed to lack 4 protective receptacle covers and accessible to the preschool age children under 5 years of age in care.

Correction Required: Protective receptacle covers shall be placed in electrical outlets accessible to children 5 years of age or younger.

Regulation: 3270.66(b)

Description: Original container

Noncompliance Area: In Room 1 (Living Room) a spray bottle containing a clear liquid, which staff identified as bleach water, was observed to lack a label specifying the contents.

Correction Required: Cleaning materials and other toxic materials shall be stored in an original labeled container or in a container that specifies the content. Toxics shall be stored away from food, food preparation areas and child care spaces.

Description: Services proceeded

Noncompliance Area: The child file for Child #1 contained a current child service report dated 10/22/24 that was not completed every 6 months from the previous report dated 2/6/24. The child file for Child #2 contained a current child service report dated 10/22/24 that was not completed every 6 months from the previous report dated 2/15/24.

Correction Required: The services to be provided to the family and the child, including the Department's approved form to provide information to the family about the child's growth and development in the context of the services being provided. The operator shall complete and update the form and provide a copy to the family in accordance with the updates regarding emergency contact information in § 3270.124(f) (relating to emergency contact information).

Description: Bottles labeled

Noncompliance Area: In the Living Room refrigerator three bottles used by an infant in care were observed to not be labeled with the child's name.

Correction Required: Disposable nursers and bottles shall be labeled with the child's name.

Regulation: 3270.27(a)(6)

Description: Emergency plan

Noncompliance Area: An annual emergency drill was observed to be conducted on 8/19/24 which was more than 12 months after the previously documented emergency drill dated 6/19/23.

Correction Required: Emergency drills shall be conducted annually. Annual emergency drills shall be documented and on file at the facility.

Description: Comply with CPSL/CPSL information

Noncompliance Area: The staff file for Staff person #1 contained a current Child Abuse clearance dated 1/2/25 and a current National Sex Offender Registry (NSOR) clearance dated 1/3/25 both of which were not renewed within 60 months of the previously dated 5/6/19 Child Abuse clearance and 12/23/19 NSOR clearance expiring.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL.

Noncompliance Area: The child file for Child #2, who is a young toddler at the time, was observed to contain health reports that were conducted more than 6 months apart; those health report dates are dated 7/9/22 and 11/11/21.

Correction Required: The operator shall require the parent to provide an updated health report at least every 6 months for an infant or young toddler.
