Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.

Noncompliance Area: The child file for Child #1 contained a current financial agreement and emergency contact form that were not reviewed and signed by the parent every 6 months; the two most recent reviews of the emergency contact form and the financial agreement form were dated 3/11/24 and 8/21/23.

Correction Required: A parent is required to review and update the emergency contact information and the financial agreement at least once in a 6-month period or as soon as there is a change in the information.

Staff person #2 contained current Pediatric First Aid/CPR training dated 2/14/24 which was not renewed prior to their current Pediatric First Aid/CPR training expiring as of 10/2023.

Correction Required: Staff persons shall complete professional development within 90 days of hire as listed in subsections (f)1-10.

Noncompliance Area: Three cigarette butts were observed on different parts of the rubberized mat of the outdoor play space used by children in care.

Noncompliance Area: The child file for Child #1 contained a current financial agreement form that lacked the services to be provided.

The operator shall complete and update the form and provide a copy to the family in accordance with the updates regarding emergency contact information in § 3270.124(f) (relating to emergency contact information). A facility person's record shall include verification of child care experience, education and training prior to service at the facility.

Correction Required: An assistant group supervisor shall have a high school diploma or a general educational development certificate and 2 years experience with children.

Correction Required: The facility shall require the parent to provide updated written verification from a physician, physician's assistant, CRNP, the Department of Health or a local health department of ongoing vaccines administered to an infant, toddler or preschool child in accordance with the schedule recommended by the ACIP.

Noncompliance Area: In the Bottom Room a Benadryl located inside the medicine box was observed to not labeled for the use of a specific child.

Correction Required: The label of a medication container shall identify the name of the medication and the name of the child for whom the medication is intended. Medication shall be administered to only the child whose name appears on the container.

Noncompliance Area: The facility emergency plan lacked information regarding volunteer emergency preparedness as well as a plan for continuity of operations in their emergency plan.

Correction Required: A facility shall be operated in conformity with applicable Federal and State laws and regulations.State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children.

Description: Health and Safety Training

Noncompliance Area: Staff person #1, Staff person #2, and Staff person #3 have not completed the following required pre-service training within 90 days of their date of hire (see LIS code sheet): Health and Safety Training; the health and safety training on file was completed prior to 9/30/16 and is not considered an acceptable training.

Correction Required: Staff person(s) shall complete professional development in the topics of 3270.31(f)(1 -- 10) within 90 days of hire. Staff person #1, Staff person #2, and Staff person #3-- will have until 12/27/22 to complete the required training. Until such time as the required training has been completed, Staff person #1, Staff person #2, and Staff person #3--- must be supervised, when interacting with children, by an (AGS) who has completed the required training related to this citation. If there are no staff available to supervise Staff person #1, Staff person #2, and Staff person #3 may not work in a child-care position at the facility.

Noncompliance Area: In the New Rear Room, chipped/damaged plaster was observed on the wall to the right of the first aid kit just above the baseboard.

Correction Required: Peeled or damaged paint or damaged plaster is not permitted on indoor or outdoor surfaces in the child care facility.

Noncompliance Area: Upon review of the facility's 30-day fire alarm testing log the following tests were observed to be conducted more than 30 days apart: 1/11/22 - 2/23/22 (43 days), 2/23/22 - 3/30/22 (35 days), 5/9/22 - 6/21/22 (43 days), 7/8/22 - 8/25/22 (48 days), 9/12/22 - 10/25/22 (43 days).

Noncompliance Area: The receptacles over the cabinet in the preschool room and under the window in the toddler room lacked protective receptacle covers and were accessible to children 5 years of age and younger.

Correction Required: Protective receptacle covers shall be placed in electrical outlets accessible to children 5 years of age or younger.

Noncompliance Area: Child file #1 lacked child's admission date that the child started at the facility on agreement form.

Correction Required: An agreement shall specify the date of the child's admission. A child's record shall contain the dates of application, admission and withdrawal of the child.

Noncompliance Area: Child file #1 contained the child's original agreement form in the file not copies of the agreement as required.

Correction Required: A parent shall receive the original agreement. The facility shall retain a copy of the agreement. A child's record shall contain a copy of the initial agreement and subsequent written agreements between the parent and the operator. The parent receives the original agreement.

Noncompliance Area: Preschool front room and back room lacked copies of emergency contact forms for randomly selected children in care at the time of the inspection.

Correction Required: When children are in the facility, emergency contact information shall be present in a child care space for children receiving care in the space.

Noncompliance Area: Child files #2 and #3 lacked documentation of up to date Influenza vaccines for the child according recommended schedule by the ACIP.

Correction Required: The facility shall require the parent to provide updated written verification from a physician, physician's assistant, CRNP, the Department of Health or a local health department of ongoing vaccines administered to an infant, toddler or preschool child in accordance with the schedule recommended by the ACIP.

Noncompliance Area: Bottles for infants in care at the time of the inspection were not labeled with the child's name.

Correction Required: Disposable nursers and bottles shall be labeled with the child's name.

Noncompliance Area: Staff file #1, DOH 11/26/19, contained volunteer PA State Police Clearance dated 7/13/19 and a volunteer Child Abuse Clearance dated 7/24/19. The staff file lacked copy of request for NSOR clearance as required by CPSL.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). LACKING REQUIRED HIRING DOCUMENTS: Facility Person # 1 may not work in a child care position at the facility. A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person #1 may not work in a child care position at the facility.

Noncompliance Area: There was Tylenol, Ibuprofen and cough syrup in the toddler room without written consent for administration of the medication to the children they were intended for.

Correction Required: A parent shall provide written consent for administration of medication or a special diet.

Noncompliance Area: Staff person #1 identified 3 infants and 2 young toddlers in her group which exceeded one to four ratio when infants are in the group.

Correction Required: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements in 3270.51 (relating to similar age level). The required staff:child ratios must be maintained at all times.

Noncompliance Area: The hot water in the toddler bathroom accessible to the children in care measured at 112 F.

Correction Required: Hot water temperature, in areas accessible to children, may not exceed 110 F.

Noncompliance Area: All of the pack n plays in the infant room were not labeled for use by a specific child in care, on the day of inspection one pack n play was to be used by two children that were in care that day.

Correction Required: Individual, clean, age-appropriate rest equipment shall be provided for preschool, toddler and infant children as agreed between the child's parent and the operator. The rest equipment shall be labeled for the use of a specific child and used only by the specified child.

Noncompliance Area: Child file #1 contained copies of child service reports dated 9/11/17 and 9/26/18, which exceeded the required 6 months for providing information to the family.

Correction Required: The services to be provided to the family and the child, including the Department's approved form to provide information to the family about the child's growth and development in the context of the services being provided. The operator shall complete and update the form and provide a copy to the family in accordance with the updates regarding emergency contact information in 3270.124(f) (relating to emergency contact information).

Noncompliance Area: Staff #1 was observed diapering toddlers without sanitizing the changing surface between diapering of each child.

Correction Required: Diaper changing surfaces shall be cleaned after each use by wiping the surface with a sanitizing solution or by changing a pad or other surface covering.

Noncompliance Area: The hand washing sink in the infant room was used for both hand washing and bottle preparation.

Correction Required: The diapering area may not be used for food preparation or food service.

Noncompliance Area: Bottles in the infant room were not labeled with the child's name on them.

Correction Required: Disposable nursers and bottles shall be labeled with the child's name.

Noncompliance Area: The winter sand contained a label with "keep out of reach of children" on it for in the toddler room for use with the children in care.

Correction Required: Arts and crafts materials shall be nontoxic.

Noncompliance Area: The high chairs in the infant room lacked the T-shaped safety straps.

Correction Required: High chairs shall have a wide base and a T-shaped safety strap.

Noncompliance Area: The infant room contained rocking sleep cradles for the infants to sleep.

Correction Required: Individual, clean, age-appropriate rest equipment shall be provided for preschool, toddler and infant children as agreed between the child's parent and the operator. The rest equipment shall be labeled for the use of a specific child and used only by the specified child.

Noncompliance Area: Child files #1, #2 and #3 contained child service reports that were not specifically written for the specific child in care.

Correction Required: The services to be provided to the family and the child, including the Department's approved form to provide information to the family about the child's growth and development in the context of the services being provided. Correction Required: An adult health assessment must include tuberculosis screening by the Mantoux method at initial employment. Subsequent tuberculosis screening is not required unless directed by a physician, physician's assistant, CRNP, the Department of Health or a local health department.A facility person's record shall include a written report of initial and subsequent health assessments, including the results of initial and subsequent tuberculin skin tests, x-rays or other medical documentation necessary to confirm freedom from communicable tuberculosis.

PROVISIONAL HIRE UNSUPERVISED: A provisional employee may not be permitted to work alone with children and must work within the vicinity of a permanent employee.
