Noncompliance Area: The facility did not require the parent of child #1 and #2 to provide updated written verification from a physician, physician's assistant, CRNP, the Department of Health or a local health department or a written statement of exemption from immunization for religious belief or strong personal objection equated to a religious belief for the influenza immunization that is recommended by the ACIP.

Correction Required: The facility shall require the parent to provide updated written verification from a physician, physician's assistant, CRNP, the Department of Health or a local health department of ongoing vaccines administered to an infant, toddler or preschool child in accordance with the schedule recommended by the ACIP. Exemption from immunization for religious belief or strong personal objection equated to a religious belief shall be documented by a written, signed and dated statement from the child's parent or guardian. The statement shall be kept in the child's record.

Noncompliance Area: The operator is not in compliance with the CPSL as the file for facility person #1 hired 2/25/2013 contains a DOE FBI clearance dated 3/11/2013 which is more than 60 months old and is therefore no longer valid. The operator is not in compliance with the CPSL as the file for facility person #2 hired 6/1/2015 contains a Child Abuse clearance dated 4/11/2015 and a certificate for Mandated Reporter training dated 2/11/2015 both of which are more than 60 months old and are therefore no longer valid.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person #1 & #2 may not work in a child care position at the facility. Facility person #1 & #2 must be removed from a child care position by the close of business because she does not have all the required clearances.

Noncompliance Area: It was observed in the second Toddler 1 classroom a ceiling tile had a large water stain on it and was not in good repair.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Noncompliance Area: It was observed in the Toddler 1 (Room #1) classroom plastic bags were hanging on the bathroom door and were accessible to children who are still placing objects in their mouths.

Correction Required: Toys and objects with a diameter of less than 1 inch, objects with removable parts that have a diameter of less than 1 inch, plastic bags and styrofoam objects may not be accessible to children who are still placing objects in their mouths.

Noncompliance Area: Emergency contact information for child #1 and #2 does not include the address of the individual designated by the parent to whom the child may be released.

Correction Required: Emergency contact information must include the name, address and telephone number of the individual designated by the parent to whom the child may be released.

Noncompliance Area: Written notification of safe routes was not posted by the operator at a conspicuous location in the child care facility. (CORRECTED ON SITE)

Noncompliance Area: The operator did not assure that facility person #1 received training regarding the emergency plan at the time of initial employment. Facility person #1 received emergency plan training on 6/11/2019 which was past the initial employment date of 4/17/2019.

Correction Required: The operator shall assure that each facility person receives training regarding the emergency plan at the time of initial employment, on an annual basis and at the time of each plan update. The operator shall document the date of each training and the names of all facility persons who received the training and kept on file at the facility.

Noncompliance Area: The operator is not in compliance with the CPSL as facility person #1 (start date 4/17/2019) has a Department of Education FBI clearance dated 2/13/2019 and facility person #2 (start date 11/14/2018) has a Department of Education FBI clearance dated 10/5/2018; DHS FBI clearances are required effective 9/24/2018.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). LACKING REQUIRED HIRING DOCUMENTS: Facility Person # 1 and 2 may not work in a child care position at the facility.

Noncompliance Area: The transportation first-aid kit in the mini-van does not contain tweezers and Band-Aids. (CORRECTED ON SITE)

Correction Required: A first-aid kit must contain the following: soap, an assortment of adhesive bandages, sterile gauze pads, tweezers, tape, scissors and disposable, nonporous gloves.A first-aid kit, including the contents as specified in 3270.75 (relating to first-aid kit) shall be in the vehicle when children are being transported.

Noncompliance Area: It was observed a sign stating that a facility person and able children shall wash hands after toileting and before eating was not posted at the sink in the Toddler 1 (Room #1) and Preschool (Room #5) classrooms.

Correction Required: A facility person and an able child shall wash his hands after toileting and before eating. A sign on which this requirement is written shall be posted at each toilet, training chair, diapering area and sink in the facility.

Noncompliance Area: The fire drill log documented fire drills on 6/28/2018, 3/21/2019 and 6/17/2019, all of which are not at least every 60 days. Provider indicated that fire drills are held are held more frequently but a written record is not kept of the date, the time of day, the hypothetical location of the fire, the evacuation time, the names of the facility person and the number of children participating in the fire drill.

Correction Required: A fire drill shall be held at least every 60 days. Facility persons and children in attendance shall participate in the fire drill. Facility persons and children shall exit the building, weather permitting. A written record shall be kept of the date, the time of day, the hypothetical location of the fire, the evacuation time, the names of facility persons and the number of children participating in the fire drill.

Noncompliance Area: It was observed a green and blue mat in the bathroom in between the Toddler 1's classroom and the Younger 1's classroom had foam exposed, in the Toddler 2's classroom a Sterilite 3 drawer plastic storage container had two cracks on the top shelf, posing a pinch or crush point and the top part of the Cafe' play set in the Pre-K room was not secured on the one side with screws and was hanging loose in a manner that posed a hazard to children.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Noncompliance Area: A written plan of daily activities and routines was not established for the infant room and therefore was not posted in the group space.

Correction Required: A written plan of daily activities and routines, including a time for free play shall be established for each group. The plan shall be flexible to accommodate the needs of individual children and the dynamics of the group. The written plan of daily activities shall be posted in the group space.

Noncompliance Area: It was observed in the Toddler 1's classroom an Epi-pen and a bottle of Assured All Day Pain Relief were being stored in an area that was not locked and was within the reach of children. (CORRECTED ON SITE)

Correction Required: Medication shall be stored in a locked area of the facility or in an area that is out of the reach of children.

Noncompliance Area: It was observed an Epi-Pen was prescribed for child #1 and was present in the Toddler 1's classroom; however, a medication log was not established by the operator.

Correction Required: An operator is responsible to establish and maintain a medication log if prescription or nonprescription medication is administered.
