Description: Building Surfaces

Noncompliance Area: Several ceiling surfaces were observed to be dirty or in poor repair throughout the facility as follows: * Older 1's: Stained and broken ceiling tiles and dust accumulation on the ceiling vent; 3 ceiling tiles need to be replaced (2 with cracked pieces coming out and 1 bulging) * Infant Rm: 1 stained and cracked ceiling tile and dust accumulation around the ceiling vent and tiles * 2's Rm: 1 stained ceiling tile * PreKdg Rm: a few bubbling ceiling tiles * Preschool Rm: 3 stained ceiling tiles

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Description: Prohibit items in crib

Noncompliance Area: Child #1 was observed sleeping in a crib with a pacifier strap attached to the pacifier. Child #2 was observed sleeping in a crib with a stuffy toy.

Correction Required: Toys, bumper pads, or pillows may not be present in a crib while an infant is sleeping in the crib.

Description: Supervised at all times /Staff assigned to specific children

Noncompliance Area: During the inspection, the PreK class was observed transitioning in and out of the classroom to use the bathroom outside of the classroom. Staff Person #1 remained in the classroom with 11-15 preschool children, while Staff Person #2 was in the bathroom with a few of the children, sending them back to the classroom as they finished. Staff Person #1 and #2 were not physically present with the children in their group. In the School Age classroom, there were 13 total children (younger and older school age) with 2 staff. Staff Persons #3 and #4 were unable to identify their Primary Care Groups.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises. TIERED LIS: 1. Children must be supervised at all times. This portion of the plan shall have an immediate correction date. 2. The legal entity must arrange for all facility staff to receive a minimum of two hours of training regarding supervision of children and primary care groups. The legal entity must receive DHS approval of the training content prior to scheduling the training. The Operator shall provide a date for when this training will be completed.

Noncompliance Area: Staff person #5 was observed to be caring for children unsupervised. Staff person #5 has not completed the following pre-service training required prior to caring for children unsupervised: Pediatric First Aid/CPR

Correction Required: A facility shall be operated in conformity with applicable Federal and State laws and regulations.State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children. Until such time as the required pre- service training has been completed, Staff person #5 must be supervised, when interacting with children at a minimum by, an AGS who has completed all preservice trainings and has all qualifications to care for children unsupervised. If there are no staff person(s) available to supervise staff person #5, staff person #5 may not work in a child-care position at the facility.

Noncompliance Area: The initial health assessment on file for Staff Person #5, did not include the date that the TB Test was given or read by the health care practitioner.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem. An adult health assessment must include tuberculosis screening by the Mantoux method at initial employment. Subsequent tuberculosis screening is not required unless directed by a physician, physician's assistant, CRNP, the Department of Health or a local health department.

Description: Disposable nursers or parents/Bottles labeled

Noncompliance Area: Child #1 was using a center bottle that was not labeled with the child's name. The bottle stays at the center and is washed without the use of a dishwasher.

Correction Required: Disposable nursers shall be used for infants unless bottles are provided by the parent or unless a commercial dishwasher is used by the facility. Disposable nursers and bottles shall be labeled with the child's name.

Description: Similar Age Level

Noncompliance Area: During the inspection, the PreK class was observed transitioning in and out of the classroom to use the bathroom outside of the classroom. Staff Person #1 remained in the classroom with 11-15 preschool children, while Staff Person #2 was in the bathroom with a few of the children, sending them back to the classroom as they finished. Staff Person #1 was out of ratio (1:10) in the classroom with up to 15 children, until Staff Person #2 returned to the classroom.

Correction Required: When children are grouped in similar age levels, the following maximum child group sizes and ratios of staff persons apply: Infants 1:4 with a maximum group size of 8; Young toddlers 1:5 with a maximum group size of 10; Older toddlers 1:6 with a maximum group size of 12; Preschool children 1:10 with a maximum group size of 20; Young school-age children 1:12 with a maximum group size of 24; Older school-age children 1:15 with a maximum group size of 30. TIERED LIS: 1. The staff: child ratios must be maintained at all times. This portion of the plan shall have an immediate correction date. 2. Correction Required: A prescription or nonprescription medication may be accepted only in an original container. The medication shall remain in the container in which it was received.

Description: Written consent/Medication log

Noncompliance Area: There was no medication log for Child #1's inhaler that was filled out by the parent, giving permission and instructions on when to administer the inhaler. The one that was filled out by the staff when the inhaler was administered, was on a medication log for Child #1's other Epi-Pen medication at the facility. (corrected on-site)

Correction Required: A parent shall provide written consent for administration of medication or a special diet. An operator is responsible to establish and maintain a medication log if prescription or nonprescription medication is administered.

Noncompliance Area: There was no documentation of annual 12 hours of childcare training on file for Staff Person #1.

Correction Required: A staff person shall obtain an annual minimum of 12 clock hours of child care training.

Noncompliance Area: There was no current FBI clearance that was completed through DHS for Staff Person #2. The current one on file was done through PDE, which is not acceptable for childcare positions.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). LACKING REQUIRED HIRING DOCUMENTS: Staff Person # 2 may not work in a childcare position at the facility until the DHS FBI clearance results are received.

Noncompliance Area: Staff Person #3 was observed working alone, unsupervised with children. Staff Person #3 did not have documentation of 2 years (2,500 hours) of childcare experience to be qualified to work as an AGS.

Correction Required: An assistant group supervisor shall have a high school diploma or a general educational development certificate and 2 years experience with children. An aide or a combination of aides shall be supervised at all times by a staff person qualified at minimum as an assistant group supervisor.

Noncompliance Area: Staff Person #1 did not have the clearances required for a provisional hire prior to working at the facility (see Code Page). Prior to starting, her file contained only one of the two clearance results (the state police clearance) required to begin working provisionally.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL.

Noncompliance Area: Hand Sanitizer was observed in the front pocket of a backpack in the 2's Room, which was accessible to children.

Correction Required: Cleaning materials and other toxic materials shall be kept in an area or container that is locked or made inaccessible to children.
