Description: Contaminated trash in closed plastic-lined receptacle

Noncompliance Area: The changing table was observed to have a bath towel on top of the plastic area and used with all children, not being sanitized between diaper changes, causing human secretions contaminating the service.

Correction Required: Trash that has been contaminated by human secretions or excrement shall be contained in closed, plastic-lined receptacles.

Description: Name on bottle

Noncompliance Area: It was observed a tube of diaper cream that did not identify the name of the child for whom the medication is intended.

Correction Required: The label of a medication container shall identify the name of the medication and the name of the child for whom the medication is intended. Medication shall be administered to only the child whose name appears on the container.

Description: General Health and Safety

Noncompliance Area: It was observed in the bathroom that the toilet bolts were exposed. In the playroom, it was observed a nail sticking out of the frame of the door next to the climbing toy.

Correction Required: Conditions at the facility may not pose a threat to the health or safety of the children.

Description: Locked or inaccessible - in original container

Noncompliance Area: In the facility bathroom, several toxics were observed to be accessible to the children in the medicine cabinet and the sink cupboard that were not locked.

Correction Required: Cleaning materials and other toxic materials shall be stored in an original labeled container or in a container that specifies the content. Toxics shall be kept in a locked area or in an area inaccessible to children, and shall be stored away from food, food preparation areas and child care spaces.

Noncompliance Area: The facility fire drill log showed that the facility did not conduct fire drills every 60 days. This is evidenced by the last fire drill documentation of 9/18/2024.

Correction Required: The operator or designated staff person who is responsible for compliance with this chapter shall conduct fire drills and ensure that the hypothetical locations of the fire are rotated around the facility for each drill such that the hypothetical location is never the same for consecutive drills.

Noncompliance Area: The facility fire drill log showed that the facility has not been regularly testing the facility's fire detection system every 30 days since 11/1/2024.

Correction Required: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. § 1016(c)). The operator or designated staff person who is responsible for compliance with this chapter shall ensure the requirements in § 3290.95(a) are met.

Noncompliance Area: Observed a damaged spot on a shelf in the child care area which had splintering edges.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Description: Small Toys and Objects

Noncompliance Area: Observed in the outdoor play area, a sand table accessible to the toddlers in care, which was filled with corn which is smaller than 1 inch in diameter and a choking hazard.

Correction Required: Toys and objects with a diameter of less than 1 inch, objects with removable parts that have a diameter of less than 1 inch, plastic bags and styrofoam objects may not be accessible to children who are still placing objects in their mouths.

Noncompliance Area: Observed the facility did not have a current certificate of rabies immunization record for a cat at the facility.

Correction Required: A veterinarian's certificate of current rabies immunization is required for a cat or dog at the facility. The certificate shall be on file when the cat or dog is present.

Noncompliance Area: Staff file #1 contained documentation of 10 of the 12 hours of childcare training required between 12/19/20 and 12/19/21, two hours of trainings were borrowed from 12/19/21-22 trainings completed.

A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL.

Noncompliance Area: The file for staff person #1 lacked mandated reporter training that was completed 60 months from the previous mandated reporter training. The mandated reporter trainings in the file were dated 4/7/15 and 12/4/20.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include records of training required by the Department.

Noncompliance Area: The files for children #1 and #2 lacked health reports that included the influenza immunization as recommended by the ACIP.
