Noncompliance Area: During the complaint investigation, the certification representative observed that the breakfast period lasted approximately 10 minutes. Children were required to finish eating within this limited timeframe. Breakfast schedule did not provide and include adequate appropriate time for children to eat breakfast.

Correction Required: If a child receives care for 4 or more consecutive hours, nutritional, appropriately-timed meals and snacks shall be served.

Staff #1 was working alone in the facility with a total of 14 children, including a youngest child aged 1.3 years. Shortly afterward, the number of children in care increased to 18, with Staff #1 still alone until Staff #2 arrived.

Correction Required: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff: child ratio and maximum group size in accordance with the requirements in § 3270.51 (relating to similar age level).
