The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises.

Noncompliance Area: During the inspection, it was observed that the facility did not have their annual local safety letter.

Correction Required: The operator shall notify local traffic safety authorities in writing of the location of the facility and about the program's use of pedestrian and vehicular routes around the group child care facility.

Description: Mixed age levels

Noncompliance Area: I observed a situation where the facility had 8 children, aged between 1 and 6 years old, being supervised by just one staff member.

Correction Required: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements at §3280.52(b).

Noncompliance Area: During my inspection I observed peeling paint on the red door leading to the classroom in the basement.

Correction Required: Peeled or damaged paint or damaged plaster is not permitted on indoor or outdoor surfaces in the child care facility.

Noncompliance Area: During my inspection I observed that the facility had not conducted a fire drill since 1/4/24, and none had been documented.

Correction Required: The primary staff person or designated staff person who is responsible for compliance with this chapter shall conduct fire drills and ensure that fire drills are conducted at least once every 60 days. The primary staff person or designated staff person who is responsible for compliance with this chapter shall conduct fire drills and ensure that a written record is maintained on file at the facility indicating the specific time of day of the drill, the hypothetical location of the fire, the evacuation time, and the names of the facility persons and the number of children who participate in the fire drill.

Description: Clean, age appropriate

Noncompliance Area: During my inspection I observed that the rest equipment was not labeled. Provider corrected this violation onsite.

Correction Required: Individual, clean, age-appropriate rest equipment shall be provided for preschool, toddler and infant children as agreed between the child's parent and the operator. The rest equipment shall be labeled for the use of a specific child and used only by the specified child.

Description: Restraints prohibited

Noncompliance Area: During my inspection I observed staff 2 restrict the young toddler's movement by enclosing them in a highchair for over an hour.

Correction Required: A facility person may not restrain a child by using bonds, ties or straps to restrict a child's movement or by enclosing the child in a confined space, closet or locked room. The prohibition against restraining a child does not apply to the use of adaptive equipment prescribed for a child with special needs.

Description: Surfaces cleaned

Noncompliance Area: During my inspection I observed that the staff 1 did not wipe down the changing table after diapering.

Correction Required: Diaper changing surfaces shall be cleaned after each use by wiping the surface with a sanitizing solution or by changing a pad or other surface covering.

Description: Locked or inaccessible - in original container

Noncompliance Area: During my inspection I observed that there was cleaning spray hanging on the changing table in the baby room. This violation was corrected onsite.

Correction Required: Cleaning materials and other toxic materials shall be stored in an original labeled container or in a container that specifies the content. Toxics shall be kept in a locked area or in an area inaccessible to children, and shall be stored away from food, food preparation areas and child care spaces.

Noncompliance Area: During unannounced investigation dated 5/15/2023, certification representative observed that staff/child ratio was not in compliance with the regulations. There was 1 staff person to 7 children, ages 1 to 5 years old.

Correction Required: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements at §3280.52(b). IF USING TIERED LIS: The required staff:child ratios must be maintained at all times. The legal entity must submit documentation in a format approved by DHS proving that the facility is maintaining the required staff:child ratios at all times. The legal entity will confirm continuing compliance by sending copies of the documentation to the -------- Region Office on a weekly basis for a period of three months after DHS approves the documentation format.

Description: Protective Outlet Covers 5 yrs. or less

Noncompliance Area: During unannounced monitoring inspection dated 5/15/2023, certification representative observed that there was one electrical outlet that did not have a protective cover on it.

Correction Required: Protective receptacle covers shall be placed in electrical outlets accessible to children 5 years of age or younger.

Noncompliance Area: During unannounced monitoring inspection dated 5/15/2023, certification representative observed that there was hand sanitizer (toxics) that was accessible to children on a table.

Toxics shall be kept in a locked area or in an area inaccessible to children, and shall be stored away from food, food preparation areas and child care spaces.

Noncompliance Area: DURING THE UNANNOUNCED INSPECTION ON 4/17/18, STAFF 1 LEFT THE CHILDREN UNATTENDED TO ANSWER THE FRONT DOOR AND TO USE THE PHONE AT THE FRONT DESK.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises.
