Noncompliance Area: Cert rep observed rest equipment failed to be labeled with the children's name who uses them.

Correction Required: Individual, clean, age-appropriate rest equipment shall be provided for preschool, toddler and infant children as agreed between the parent and the operator. The rest equipment must be labeled with the child's name and used only by the named child while enrolled in the program.

Description: Written consent/Consent for emergency medical care required prior to admission

Noncompliance Area: In review of children's files, child 1's emergency contact and record failed to have signed parental consent for emergency medical care.

Correction Required: Emergency contact information must include the written consent signed by a parent for emergency medical care. A child's record must contain signed parental consent for emergency medical care for the child. Written consent is required prior to admission.

Noncompliance Area: In review of children files, child 1's emergency contact failed to include the designated release person's address.

Correction Required: Emergency contact information must include the name, address and telephone number of the individual designated by the parent to whom the child may be released.

Description: Written emergency plan posted

Noncompliance Area: Cert rep observed a written plan identifying the means of transporting a child to emergency care and staffing provisions failed to be posted.

Correction Required: A written plan shall be conspicuously posted which identifies the means of transporting a child to emergency care and the facility staffing provisions in the event of an emergency. The plan must accompany a staff person who leaves the facility on an excursion with children.

Description: Within 60 days/Initial and subsequent health assessments

Noncompliance Area: In review of children's files, child 1's file failed to include a health report. File only contained immunization records.

Correction Required: The operator shall require the parent of an enrolled child to provide an initial health report no later than 60 days following the first day of attendance at the facility. A child's record must contain initial and subsequent health reports.

Description: Within 3 months, then 12 months

Noncompliance Area: In review of staff files, staff member 2 failed to have a health assessment. File only included the TB results.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment on file at the facility.

Noncompliance Area: In review of health and safety documentation, facility's policy addressing shaken baby syndrome and abusive head trauma and child maltreatment failed to address the prevention and identification of child maltreatment.

Correction Required: Conditions at the facility may not pose a threat to the health or safety of the children.

Description: Consent for administration of minor first-aid required prior to admission

Noncompliance Area: In review of children files, child 1's record failed to have signed parental consent for administration of minor first-aid procedures by a staff.

Correction Required: A child's record must contain signed parental consent for administration of minor first-aid procedures by facility staff. Written consent is required prior to admission.

Description: Training regarding plan/Required training

Noncompliance Area: In review of emergency plan documents, staff person 1 failed to be trained on the facility's emergency plan procedure at the time of the inspection.

Correction Required: The operator shall assure that each facility person receives training regarding the emergency plan at the time of initial employment, on an annual basis and at the time of each plan update. The operator shall document the date of each training and the names of all facility persons who received the training. A facility person's record shall include records of training required by the Department.

Regulation: 3290.64(a)

Description: Locked or inaccessible - in original container

Noncompliance Area: Cert rep observed cleaning materials accessible to children in the bathrooms on the main floor and basement.

Correction Required: Cleaning materials and other toxic materials shall be stored in an original labeled container or in a container that specifies the content. Toxics shall be kept in a locked area or in an area inaccessible to children, and shall be stored away from food, food preparation areas and child care spaces.

Regulation: 3290.95(a)/3290.95(b)

Description: System in compliance/Operator or designated staff responsibility

Noncompliance Area: In review of fire safety documents, facility failed to have tested their smoke detection system once every 30 days.

Correction Required: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. § 1016(c)). The operator or designated staff person who is responsible for compliance with this chapter shall ensure the requirements in subsection (a) are met.
