Noncompliance Area: Child #2 lacked a medication log for non prescription Tylenol observed at the facility. Child #3 lacked a medication log for non prescription Tylenol observed at the facility.

Correction Required: An operator is responsible to establish and maintain a medication log if prescription or nonprescription medication is administered.

Noncompliance Area: Staff #3 lacked a health assessment updated every 24 months. Health assessments observed were dated 3/8/18 and 10/12/20, exceeding 24 months. Staff #5 lacked a health assessment updated every 24 months. The most current health assessments observed was dated 8/2/18, exceeding 24 months.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.

Noncompliance Area: The emergency contact information for child #1 lacked signed parental consent for emergency medical care and administration of minor first-aid procedures by facility staff.

Noncompliance Area: Staff #1 was observed having only 1 written reference in their record.

Correction Required: A facility person's record shall include two written, nonfamily references from individuals attesting to the person's suitability to serve as a facility person

Noncompliance Area: Staff #1 was observed having a drivers license from the state of Maine but lacked out of state clearances. Staff #4 was observed having a disclosure statement but lacked a date on the disclosure statement.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Staff #1 may not work in a child care position at the facility until all out of state clearances are obtained.

Noncompliance Area: On 10/16/20 at 12:30 PM 3 staff were observed supervising a mixed ratio of 20 older toddlers and 2 preschoolers.

Correction Required: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements in 3270.51 (relating to similar age level).

Noncompliance Area: The pre-k 4/5 child care space was observed having an unlocked cabinet with an assortment of toxic cleaners located on the bottom shelf of the cabinet accessible to children.

Correction Required: Cleaning materials and other toxic materials shall be kept in an area or container that is locked or made inaccessible to children.

Noncompliance Area: *2nd citation, on 11/26/19 staff #1 and #2 were assigned supervision of children in the infant child care space. Staff #1 was observed leavening the area designated for young toddler/mobile infants and entering the area designated for young infants to speak with staff #2. Staff #1 was unaware that 1 of the 8 young toddlers in the young toddler/mobile infant area was climbing on a piece of furniture when their back was turned to the children. Previously cited on 9/19/19, per directors self-disclosure and video observation at renewal inspection; the facilities camera system recorded an incident on 9/17/19 at 9:00 AM which showed child #2 climb onto a children's table and then fall when climbing off the table. The video showed inadequate supervision from former staff person #8 who had their back turned to the child and did not observe the incident occur.

Correction Required: The legal entity is required to develop a staff supervision policy regarding the supervision of children. All staff are required to review and sign the supervision policy. A copy of the supervision policy and signatures of staff verifying they have reviewed the policy will be sent to the Western Region Office.

Noncompliance Area: *On 11/26/19 at 1445 the infant child care space was observed having staff #1 supervising a group of 8 young toddlers in the area designated for mobile infants/young toddlers and staff #2 was supervising a group of 5 infants in the space designated for young infants.

Correction Required: The required staff:child ratios must be maintained at all times. The legal entity must submit documentation to the Western Region Office showing all staff have reviewed regulations 3270.51 and 3270.52 regarding staff:child ratios.

Noncompliance Area: The children's cubbies located on both sides of the hallway, a wooden easel located in the pre-k child care space, and plastic cabinets approximately 62 inches in height and 30 inches in width located in both the young and older toddler child care spaces lacked anchoring to the wall, creating possible tipping hazards.

Correction Required: Furniture must be durable, safe, easily cleaned and appropriate for the child's size, age and special needs.
