The center and playground were designed with supervision and safety in mind. During construction a 16-unit camera system, state of the art alarm system, individual parent pass-code entry and 6 feet playground fencing were all installed. The Director / Owner has 35 years’ experience from teaching to directing and is on site daily. Electrical outlets and power strips, not in use, which were located in space used by children did not have safety outlets or were not covered with safety plugs unless located behind furniture or equipment that cannot be moved by a child. In spaces #2, #3, hallway, and lobby areas the safety shutter system that prevents the insertion of foreign objects into a receptacle is stuck into the open position.

Children were not adequately supervised at all times. Upon arrival to the center, I observed a staff member open the door to the classroom several times and remain between the indoor and outdoor space, leaving 7 (seven) children, 2-3 years of age, unattended in outdoor space #3 for several minutes. The children were on the opposite side of the outdoor space playing in the sand area under the large shade structure, approximately 50 feet away. The staff member was unable to see or hear the children while standing in the doorway to the classroom.
