Small Wonders Day Care School - Shavertown PA Child Care Center

Noncompliance Area: A renewal inspection occurred at the facility and a physical site review occurred on the outdoor play area. A maroon and white playset was found that under a ladder, rock climb and slide did not contain protective surface covering under these areas. The manufacturer instructions indicate mounting the equipment over loose-fill or unitary playground protective surfacing.

Correction Required: Outdoor equipment that requires embedded mounting must be mounted over a loose-fill or unitary playground protective surface covering that meets the recommendations of the United States Consumer Product Safety Commission. The equipment must be anchored firmly and be in good repair.

Noncompliance Area: A renewal inspection occurred at the facility and a review of staff files was conducted. The Child Protective Services Law(CPSL) was revised to include the requirement for the National Sex Offender Registry(NSOR) clearance effective 9/30/2019. The CPSL also states that anyone hired before 9/30/19 had until 7/1/20 to obtain this clearance. The following staff have been employed at the center before 9/30/19 and at the time of inspection the files did not contain the completed NSOR clearance; Staff # 1, Staff # 2, Staff # 3 , Staff # 4, Staff # 5, Staff # 6, Staff # 7, Staff # 8, Staff # 10, Staff # 11 and Staff # 12. Staff # 2, Staff # 3 , Staff # 4, Staff # 5, Staff # 6, Staff # 7, Staff # 8, Staff # 10, Staff # 11 and Staff # 12 were working with children during this inspection. Staff # 13 was hired provisionally on 11/18/19 and the file is missing documentation that this staff's NSOR clearance was applied for before working with children. Staff # 13 does not have a completed NSOR clearance on file. Staff # 13 was working with the children at the time of this inspection. The amendments to the CPSL also eliminated the ability to hire staff on a provisional hire basis beginning 12/31/19. In order to continue hiring staff provisionally the legal entity was required to apply to the Department for a waiver. Although ,the legal entity did not receive the provisional hire waiver approval until 1/7/20, Staff #9 was hired provisionally on 1/2/2020. The file for staff person # 9 does not have a completed NSOR clearance or the documentation confirming that clearance was applied for. Facility person # 9 was working with the children at the time of this inspection. Staff # 14 had an FBI clearance dated for 2/16/15 and this clearance was not updated until 2/22/20. This clearance was not updated every 60 months as required by the CPSL. This clearance needed to be updated by 2/16/2020.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services).A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Staff # 1, Staff # 2, Staff # 3 , Staff # 4, Staff # 5, Staff # 6, Staff # 7, Staff # 8, Staff # 9, Staff # 10, Staff # 11, Staff # 12, and Staff # 13 may not work in a child care position at the facility.

Noncompliance Area: On the date of this renewal inspection, a review of the facility's diaper changing procedure was monitored. After diaper changing two children, Staff # 1 did not wash their hands.

Correction Required: Liquid or powdered soap shall be used for handwashing.

Noncompliance Area: On the date of this renewal inspection, a physical site review was conducted. The infant and toddler room has a capacity of 19 and at the time of this inspection contained 23 children.

Correction Required: The capacity established for an indoor space may not be exceeded.

Noncompliance Area: On the date of this renewal inspection, a review of the facility's diaper changing procedure was monitored. After diaper changing two children, Staff # 1 did not wash their hands.

Correction Required: A facility person and an able child shall wash his hands after toileting and before eating. A sign on which this requirement is written shall be posted at each toilet, training chair, diapering area and sink in the facility. A facility person shall wash his hands before meals and snacks, and after toileting and after diapering a child. The Legal Entity/Director will locate and schedule for all staff to attending training regarding diaper changing and hygiene. This training must be at least a 2-hr in-person training and PQAS certified. The training program selected must be sent to the Northeast Daycare Office for approval. Once the training is approved by the Northeast Daycare Office, the Legal Entity/Director will arrange for all staff to attend the training.

Staff # 3 had a date of hire of 8/27/18 and the file was missing documentation of a health assessment and tuberculosis screening. Staff # 3 was working in ratio with a group of children during this inspection.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem. A facility person's record shall include a written report of initial and subsequent health assessments, including the results of initial and subsequent tuberculin skin tests, x-rays or other medical documentation necessary to confirm freedom from communicable tuberculosis.

Staff # 3 was working in ratio with a group of children during this inspection.

Correction Required: An adult health assessment must include a physical examination. An adult health assessment must include tuberculosis screening by the Mantoux method at initial employment. Subsequent tuberculosis screening is not required unless directed by a physician, physician's assistant, CRNP, the Department of Health or a local health department.

Staff # 3 was working in ratio with a group of children during this inspection.

Correction Required: A facility person's record shall include two written, nonfamily references from individuals attesting to the person's suitability to serve as a facility person

Noncompliance Area: On the date of this inspection, a review of staff files was conducted. Staff # 1's date of hire was 8/16/18, Staff # 2's date of hire was 8/16/18, Staff # 3's date of hire was 8/27/18, Staff # 4's date of hire was 8/30/18 and Staff # 5's date of hire was 7/11/18. All of these staff files were missing documentation that the facility's emergency plan had been reviewed with them at the initial time of employment.

Correction Required: The operator shall assure that each facility person receives training regarding the emergency plan at the time of initial employment, on an annual basis and at the time of each plan update. The operator shall document the date of each training and the names of all facility persons who received the training and kept on file at the facility.

Noncompliance Area: On the date of this inspection, a review of staff files was conducted. Staff file # 1 had a date of hire of 8/16/18 but did not submit their FBI fingerprints until 10/2/18. Staff file # 2 had a date of hire of 8/16/18 but did not submit their FBI fingerprints until 9/26/18. Staff # 1 and Staff # 2 have worked in ratio with children since their hire date.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A provisional employee may not be permitted to work alone with children and must work within the vicinity of a permanent employee.A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person # 1 may not work in a child care position at the facility.

Noncompliance Area: On the date of this inspection, a physical site review was conducted. At this time, Staff # 1 was in the 3-yr old preschool room and was viewed diapering a child. After diapering, Staff # 1 did not ensure the child's hands were washed.

Correction Required: A facility person and an able child shall wash his hands after toileting and before eating. A sign on which this requirement is written shall be posted at each toilet, training chair, diapering area and sink in the facility. A staff person shall ensure that a child's hands are washed before meals and snacks, after toileting and after being diapered.

Noncompliance Area: In the outdoor play area, there was a cracked play table with sharp edges exposed.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Noncompliance Area: In the storage room, there was a box of expired crackers.

Correction Required: Food stored, prepared or served shall be clean, wholesome, free from spoilage, free from adulteration and safe for human consumption.

Noncompliance Area: In the outdoor play area, a small part of the fence had sharp edges exposed.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility`s outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.
