A safe indoor and outdoor environment was not provided for the children. There are multiple areas where the turf, used as surfacing for the stationary play structure, was peeling and lifting causing tripping hazards on the playground.

Surfacing did not extend six (6) feet beyond the external limits of the equipment or 3 feet for equipment used only by children less than 2 years of age. Before caregivers could get to two children on the playground, at different times, two children were observed quickly climbing the stationary water feature which did not have surfacing within the required fall zone. The stationary water feature was installed two feet from a large window and brick wall.
