Noncompliance Area: File for Staff # 1 was not in compliance with CPSL regulations. File for Staff # 1 contained State police and Child Abuse clearances over 60 months. State Police clearances dated 4/15/21 and 6/3/26. Child Abuse clearances were dated 4/15/21 and 6/5/26.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. The CPSL was revised on 9/18/2018 to include a requirement that all clearances be updated and on file at least every 60 months.

Description: Age appropriate restraints

Noncompliance Area: On 5/11/26 Staff # 1 was transporting 6 children; 2 children were 6 years old, and 1 child was 7 years old. Only one booster seat was observed in the vehicle.

Correction Required: A child 7 years of age or younger shall be transported in accordance with the requirements for parents and guardians as stated in 75 Pa.C.S. §4581 (relating to restraint systems).

Description: Two facility persons present in facility

Noncompliance Area: On 5/11/26 Staff # 1 was left alone in the facility with 4 Preschool children while Staff # 2 went to pick up school aged children.

Correction Required: At least two facility persons shall be present in the facility when two or more children are in care. At a minimum, one of the facility persons shall be a staff person. Tiered LIS: 1. At least two facility persons shall be present in the facility when two or more children are in care. At a minimum, one of the facility persons shall be a staff person. This portion of the plan shall have an immediate correction date. 2. For a period of 2 months, the legal entity must send staff scheduling to Regional Office. The schedule for the upcoming week shall be sent to the Regional Office by close of business on the Friday prior. This portion of the plan shall have a correction date of 2 months after plan of correction is accepted. 3. The operator shall demonstrate the ability to maintain compliance with the regulation during all unannounced inspections conducted by the Department over the next two months. This portion of the plan shall have a correction date of 2 months after plan of correction is accepted.

Description: Clean, age appropriate

Noncompliance Area: A few of the rest mats were observed to be ripped and the foam was exposed.

Correction Required: Individual, clean, age-appropriate rest equipment shall be provided for preschool, toddler and infant children as agreed between the child's parent and the operator. The rest equipment shall be labeled for the use of a specific child and used only by the specified child.

Noncompliance Area: Toddler room did not have a first-aid kit.

Correction Required: A first-aid kit shall be in a child care space.

Description: Insurance coverage information

Noncompliance Area: Emergency contact form for child # 3 did not contain health insurance name and policy number.

Correction Required: Emergency contact information must include health insurance coverage and policy number for a child under a family policy or Medical Assistance benefits, if applicable.

Noncompliance Area: Emergency contact form for children # 1, # 2 and # 4 did not contain address and phone number of release persons.

Correction Required: Emergency contact information must include the name, address and telephone number of the individual designated by the parent to whom the child may be released.

Noncompliance Area: Diaper area in the infant room did not contain a plastic-lined, hands-free covered can.

Correction Required: If disposable diapers are provided by a parent or by a facility, a soiled diaper shall be discarded by immediately placing the diaper into a plastic-lined, hands-free covered can.

Noncompliance Area: Emergency Contact Forms for children # 3 and # 5 did not contain signed consent for emergency medical care and the administration of minor first-aid by facility staff.

Correction Required: A child's record shall contain signed parental consent for emergency medical care for the child. Written consent is required prior to admission. A child's record shall contain signed parental consent for administration of minor first-aid procedures by facility staff. Written consent is required prior to admission.

Regulation: 3270.54(a)

Description: Two facility persons present in facility

Noncompliance Area: Staff # 1 was observed supervising 6 children, Staff # 1 was the only staff in the building for approximately 15 minutes.

Correction Required: At least two facility persons shall be present in the facility when two or more children are in care. At a minimum, one of the facility persons shall be a staff person.

Description: Inaccessible to children

Noncompliance Area: First-aid kit in the school-age room was on a shelf accessible to children.

Correction Required: A first-aid kit must be inaccessible to children.

Description: Handwashing signs/Lidded waste receptacles

Noncompliance Area: The preschool classroom contains two bathrooms. The first bathroom did not contain a lidded trash can. The second bathroom did not have a handwashing sign posted.

Correction Required: A facility person and an able child shall wash his hands after toileting and before eating. A sign on which this requirement is written shall be posted at each toilet, training chair, diapering area and sink in the facility. A toilet area, training chair area, diapering area and sink area shall be equipped with a clean, lidded waste receptacle.

Regulation: 3270.77(a)

Description: No peeling paint or plaster

Noncompliance Area: Infant room, preschool room and toddler room have several areas of peeling paint.

Correction Required: Peeled or damaged paint or damaged plaster is not permitted on indoor or outdoor surfaces in the child care facility.

Regulation: 3270.95(a)/3270.95(b)

Description: Devices must be compliant/Director or designated staff person ensure compliance

Noncompliance Area: During an initial inspection on 5/2/25, facility did not have a working fire system.

Correction Required: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. §  1016(c)). The Director or designated staff person who is responsible for compliance with this chapter shall ensure the requirements under subsection (a) are met.

Noncompliance Area: There was a large plastic bag hanging from the diaper changing table in the infant room that was accessible to the children.

Correction Required: Toys and objects with a diameter of less than 1 inch, objects with removable parts that have a diameter of less than 1 inch, plastic bags and styrofoam objects may not be accessible to children who are still placing objects in their mouths.

Noncompliance Area: Infant room staff stated they have been warming bottles directly in the microwave because their bottle warmer was broken.

Correction Required: Bottled formula may not be heated in a microwave oven.

Noncompliance Area: Staff person #1, date of hire 2/4/2020, Staff person #2, date of hire 1/28/2020, staff person #3, date of hire 11/12/2019 and staff person #4, date of hire 12/23/2019, are all working in child care positions at the facility without their National Sex Offender Registry verification. The legal entity does not have an approved waiver to hire provisionally.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). Facility Persons # 1-4 may not work in a child care position at the facility until they provide to the facility their completed National Sex Offender Registry certification.

Noncompliance Area: There was a can of Febreeze in an unlocked cabinet under the sink which was accessible to the children, in one of the preschool room bathrooms.

Correction Required: Cleaning materials and other toxic materials shall be kept in an area or container that is locked or made inaccessible to children.

Noncompliance Area: Staff person #1 began in a child care position on 1/29/2019 and does not have a health assessment on file.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.A facility person's record shall include a written report of initial and subsequent health assessments, including the results of initial and subsequent tuberculin skin tests, x-rays or other medical documentation necessary to confirm freedom from communicable tuberculosis.

Noncompliance Area: All of the staff have completed American Life and Health Foundation first-aid. This is an online first-aid and not approved by OCDEL. None of the staff have current approved first-aid certification.

Correction Required: Competence in first-aid is demonstrated by the completion of training by a professional in the field of first-aid. First-aid training shall be renewed on or before expiration of certification or every 3 years, as applicable. One or more facility persons competent in first-aid techniques shall be at the facility when one or more children are in care.

Noncompliance Area: There was a tube of diaper ointment in the young toddler room that was in an unlocked cabinet within the reach of children.

Correction Required: Medication shall be stored in a locked area of the facility or in an area that is out of the reach of children.

Noncompliance Area: There were 2 expired Ventolin inhalers. I expired 4/18 and the other 5/18.

Correction Required: Medication shall be stored in accordance with the manufacturer's or health professional's instructions on the original label.

Noncompliance Area: There was one tile on the outdoor playground that had a small hole in it.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Noncompliance Area: There was some rubber mulch on the infant/toddler play area that had come over from the preschool/school age side.

Correction Required: Toys and objects with a diameter of less than 1 inch, objects with removable parts that have a diameter of less than 1 inch, plastic bags and styrofoam objects may not be accessible to children who are still placing objects in their mouths.

Noncompliance Area: Staff person#1's health assessment did not indicate whether or not she was free from communicable disease and able to provide adequate care for children.

Correction Required: An adult health assessment must include an examination for communicable diseases and the results of that examination. An adult health assessment must include information on medical problems that might threaten the health of the children or prohibit a staff person from providing adequate care to children.

Noncompliance Area: Child #1 did not have signed consent for administration of minor first aid procedures or emergency medical care.

Correction Required: A child's record shall contain signed parental consent for emergency medical care for the child. Noncompliance Area: Staff #1 and 2 did not have proof of education on file.

Correction Required: A facility person's record shall include verification of child care experience, education and training prior to service at the facility.

Noncompliance Area: Staff person #1 began in a child care position on 1/17/2018, but did not go for fingerprinting for her FBI clearance until 2/5/18. Fingerprints must be submitted prior to beginning in a child care position.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services).

Noncompliance Area: There was a small hole in one of the window screens in the infant room.

Correction Required: Screens shall be in good repair.

Noncompliance Area: The inspector overheard staff #1 yelling at the toddlers in her room through the wall seperating the toddler room and the director's office. Staff #1 was overheard yelling "stop it right now," and "if you don't stop crying your not going to eat lunch."

Correction Required: A facility person may not use harsh, demeaning or abusive language in the presence of children. The legal entity must arrange for all facility persons and staff to receive a minimum of two hours of in person training dealing with challenging behaviors in children. The legal entity must receive DHS approval of the training content prior to scheduling the training. This training must be conducted by a PQAS approved trainer. Further, this training will not be allowed to count towards the annual six hours of training required by regulation.

Noncompliance Area: The inspector overheard staff #1 yelling at the toddlers in her room through the wall seperating the toddler room and the director's office. Staff #1 was overheard yelling "stop it right now," and "if you don't stop crying your not going to eat lunch."

Correction Required: Food may not be withheld from a child for purposes of discipline. The facility will develop and implement a supervision policy that will focus on how the facility will use appropriate discipline techniques when working with challenging behaviors in children and positive outcomes. This supervision policy must be submitted to the Department prior to implementation for approval.

Noncompliance Area: The facility failed to report an incident of suspected child abuse to Childline that was both observed and discussed at the facility on 05/09/17.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). All staff persons shall attend at least two hours of in person training on Mandated Reporting for all facility persons. This training must be conducted by a PQAS trainer and will not be allowed to count towards the annual six hours of required trainings.

Noncompliance Area: Staff # 6 was hired on 12/07/16 and did not have a health assessment until 12/28/16 which is ouit of date.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.

Noncompliance Area: The inspector found bottles in the infant room that were not labeled as is required.

Correction Required: Disposable nursers and bottles shall be labeled with the child`s name.

Noncompliance Area: Staff #1, #2, #6 and #7 did not have the correct Pa State Police clearance on file. Staff # 2 who was hired on 03/21/16 and also does not have an FBI clearance on file at the facility. Staff #8 was hired 10/01/16 and does not have a complete FBI on file at the facility.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services).Facility Person #1,#2, #6, #7 and #8, may not work in a child care position at the facility.

Noncompliance Area: The inspector observed outlets in the Pre K room that were not ocvered as is required.

Correction Required: Protective receptacle covers shall be placed in electrical outlets accessible to children 5 years of age or younger.

Noncompliance Area: The insepctor observed toxics within reach of children in the Pre K room.

Correction Required: Cleaning materials and other toxic materials shall be kept in an area or container that is locked or made inaccessible to children.
