There was a bin with Lego's in the school age room with several cracks on the corner, which exposed sharp edges, There was a plastic bin in Toddler 2 holding toys which had several cracks on one corner, exposing sharp edges.

Noncompliance Area: In the toddler 1 room, there were a few rest mats that had tears in the fabric that exposed the foam.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Noncompliance Area: At approximately 3:00 p.m., staff person #4 stood at the doorway to the toddler 2 classroom at the end of the hallway and let a 3 year old child from the staff person's group walk to the bathroom alone down the hallway. Staff person #4 was supervising their group in the classroom from the doorway while the child was in the bathroom.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises.

Noncompliance Area: The file for child #2 had an emergency contact form that lacked the work address and telephone number of the enrolling parent.

Correction Required: Emergency contact information must include the home and work addresses and telephone numbers of the enrolling parent.

Noncompliance Area: The file for child #1 had a health assessment that lacked a statement that age-appropriate screenings recommended by the American Academy of Pediatrics were conducted since the time of the previous health assessment.

Correction Required: A health report shall include a statement that age-appropriate screenings recommended by the American Academy of Pediatrics were conducted since the time of the previous health report required by this section.

Noncompliance Area: The file for child #3, a 2 year old, had an immunization record that lacked documentation of the 2nd dose of the Hepatitis A vaccination by age 23 months in accordance with the schedule recommended by the ACIP.

Correction Required: The facility shall require the parent to provide updated written verification from a physician, physician's assistant, CRNP, the Department of Health or a local health department of ongoing vaccines administered to an infant, toddler or preschool child in accordance with the schedule recommended by the ACIP.

Noncompliance Area: The file for staff person #3 had a health assessment that exceeded 24 months between assessments.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.

Noncompliance Area: The file for staff person #1 lacked out of state Criminal History and Sex Offender registry checks at their start date and requires current out of state Criminal History and Sex Offender registry checks. Staff Person #1 and Staff Person #2 may not work in a child care position at the facility.

Noncompliance Area: At approximately 3:00 p.m., staff person #4 stood at the doorway to the toddler 2 classroom at the end of the hallway and let a 3 year old child from the staff person's group walk to the bathroom alone down the hallway. Staff person #4 was supervising their group in the classroom from the doorway while the child was in the bathroom.

Correction Required: When children are grouped in similar age levels, the following maximum child group sizes and ratios of staff persons apply: Infants 1:4 with a maximum group size of 8; Young toddlers 1:5 with a maximum group size of 10; Older toddlers 1:6 with a maximum group size of 12; Preschool children 1:10 with a maximum group size of 20; Young school-age children 1:12 with a maximum group size of 24; Older school-age children 1:15 with a maximum group size of 30.

Noncompliance Area: The back wooden steps of the right modular had splintering along the railing in multiple areas with sharp edges. On the toddler play space, there was a gallon container of milk that was tied to the fence being using as a bird feeder that had a sharp edge. In the left modular on the right wall, there were a few holes and tears in the wall.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Noncompliance Area: In the toddler 2 room, there was peeling paint in one area on the back wall.

Correction Required: Peeled or damaged paint or damaged plaster is not permitted on indoor or outdoor surfaces in the child care facility.

Noncompliance Area: In the pre-k room, there were several wooden blocks in a bin that were splintering with sharp edges.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Noncompliance Area: In the toddler 1 room, child #4, who was in care in the room, lacked an emergency contact form in the room.

Correction Required: When children are in the facility, emergency contact information shall be present in a child care space for children receiving care in the space.

Noncompliance Area: The file for staff person #1 had a health assessment that exceeded 24 months between assessments.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL.

Noncompliance Area: In the pre-k room, there were 9 children in the room with a capacity for 8, resulting in the pre-k room being over capacity.

Correction Required: The capacity established for an indoor space may not be exceeded.

Noncompliance Area: In the right side toddler modular play space, on the far wall there were 3 small sharp metal pieces sticking out that were accessible to children. In the left side preschool modular play space, there was 1 small sharp metal piece sticking out on the right wall and several small sharp metal pieces sticking out on the back wall that were accessible to children. On the back steps of the right side modular in the outdoor preschool/school-age play space, there was splintering wood with sharp edges in multiple places on the railings.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Noncompliance Area: In the toddler 1 room, there were 2 large fabric climbing blocks that had fabric tearing in multiple places with small pieces coming apart that could be placed in a child's mouth. In the young toddler room, there was 1 rest mat that had a couple of areas with fabric tearing and small pieces coming apart that could be placed in a child's mouth.

Correction Required: Toys and objects with a diameter of less than 1 inch, objects with removable parts that have a diameter of less than 1 inch, plastic bags and styrofoam objects may not be accessible to children who are still placing objects in their mouths.

Noncompliance Area: In the school-age room, the thermometer in the refrigerator was not functioning correctly.

Correction Required: A facility shall have an operable, clean refrigerator used to store potentially hazardous foods. The refrigerator shall be capable of maintaining food at 45 F or below. An operating thermometer shall be placed in the refrigerator.

Noncompliance Area: A daily activity schedule was not posted in the infant room, the pre-k 1 room, and the pre-k 2 room.

Correction Required: The written plan of daily activities shall be posted in the group space.

Noncompliance Area: In the young toddler room, there was a sharp piece of metal on the child lock on the small refrigerator that was accessible to children.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Noncompliance Area: On the preschool/school-age outdoor play space, there was a basketball hoop with a torn net hanging down from the rim, and there was a second basketball hoop with 2 pieces of a broken cynder block with sharp edges on the back of the hoop stand.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Noncompliance Area: In the hallway on the way to the outside play space, staff person #9 named 5 school-age children in his group, staff person #4 named 4 school-age children in her group, and staff person #8 named 6 school-age children in her group, resulting in 15 out of 16 children being named, and 1 school-age child not being named in a group.

Correction Required: Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises.

Correction Required: The facility shall require the parent to provide updated written verification from a physician, physician's assistant, CRNP, the Department of Health or a local health department of ongoing vaccines administered to an infant, toddler or preschool child in accordance with the schedule recommended by the ACIP.

Noncompliance Area: The file for staff person #3, staff person #5, and staff person #7 had a health assessment that exceeded 24 months between assessments.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.

Staff persons and volunteers shall receive training in maintenance of smoke detectors, the duties of facility persons during a fire drill and during a fire and the use of the facility`s fire extinguishers, not including discharge of the fire suppressant agent.

In the toddler room #2, there was a bulletin board with the bottom left border board coming apart from the wall exposing the back sharp edge of a nail that was accessible to children.
