Noncompliance Area: One cracked bin with a potential pinch point was observed in the Older 3's classroom. A child size couch in the PreK Classroom was observed to have a tear causing the inner foam to be exposed. In the outdoor play space, a small knobby ball was observed to be coated in dirt in the toddler area. Also in the outdoor play space, two dodgeballs were observed to have the polyurethane skin peeling from the ball.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Correction Required: If disposable diapers are provided by a parent or by a facility, a soiled diaper shall be discarded by immediately placing the diaper into a plastic-lined, hands-free covered can.

State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children. Until such time as the required pre-service trainings are completed, staff person #1 must be supervised, when interacting with children, by an AGS, GS, or Director who has completed the required training related to this citation. If there are no staff person(s) available to supervise staff person #1, staff person #1 may not work in a child-care position at the facility.

Noncompliance Area: A plant with sharp thorns was observed on the retaining wall in the outside play space. The plant was accessible to children receiving care in the outdoor play space creating a safety hazard. Two pairs of adult scissors were observed in a container on top of the cubby next to the door in the lower-level PreK Classroom. The scissors were accessible to children receiving care in the space. One pair of adult scissors were observed in an unlocked drawer in the upstairs kitchenette area. The gate leading from the upper-level Middle / School Age Classroom to the kitchenette was not latching allowing access to the kitchenette. Standing water was observed on one of the slides in the outdoor play structure.

Correction Required: Conditions at the facility may not pose a threat to the health or safety of the children.

Noncompliance Area: The file for Staff Person #1 lacked a completed NSOR Certificate prior to starting in a child care taking position. Staff Person #1 was observed at naptime to be alone and providing care to 6 young toddlers, 1 older toddler and 1 older school ager. The updates to the Child Abuse Clearance on file for Staff Person #3 exceeded 60 months between clearances dated 4.19.21 and 4.29.26. The files for Staff Persons #4, #5, #6 and #7 were observed to contain disclosure statements for Volunteer purposes. Volunteer disclosure statements are not acceptable for employment in a child care.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). Facility Person #1 may not work in a child care position at the facility until they have provided a complete NSOR Certificate. Staff Person's #4, #5, #6 and #7 may not work in a child care position until they have signed a Disclosure Statement for employment purposes. A provisional employee may not be permitted to work alone with children and must work within the vicinity of a permanent employee.

Correction Required: The staff:child ratio while toddlers and preschoolers are napping is one staff person to 10 young toddlers, one staff person to 12 older toddlers, one staff person to 20 preschool children.

The operator shall document the date of each training and the names of all facility persons who received the training and kept on file at the facility.

This resulted in them not having an approved training completed between 11.24 and 5.25.

Correction Required: Competence is the completion of training by a professional in the field of first-aid and cardiopulmonary resuscitation (CPR). All staff persons shall renew their certification in pediatric first aid and pediatric cardiopulmonary resuscitation (CPR) on or before the expiration of the most current certification.

Description: Restraints prohibited

Noncompliance Area: Staff Persons #1 and #2 have restrained Child #1 by holding the child on their lap and wrapping their arms and a leg around the child or by "hugging" the child. This restricted the child's ability to move freely. Staff reported this only occurred when the child was exhibiting behaviors that placed the other children in care at risk of harm.

Correction Required: A facility person may not restrain a child by using bonds, ties or straps to restrict a child's movement or by enclosing the child in a confined space, closet or locked room. The prohibition against restraining a child does not apply to the use of adaptive equipment prescribed for a child with special needs.

Young School Agers were observed to be receiving care in the lower-level Toddler Classroom and would have passed through the Kitchenette allowing access to the unlocked drawer where the knife was observed.

Correction Required: Conditions at the facility may not pose a threat to the health or safety of the children.

Noncompliance Area: The file for Staff Person #1 lacked verification that they had been fingerprinted for a DHS FBI clearance prior to starting. An FBI clearance for DOE purposes was observed on file upon starting. A DOE FBI clearance is not acceptable for employment in a child care facility. The FBI clearance for DHS purposes was dated 15 days after Staff Person #1 started at the facility. The updates to the State Police Clearances on file for Staff Person #4 exceeded 60 months. This was evidenced by State Police Clearances dated 5.4.19 and 5.29.24. The updates to the State Police, Child Abuse and FBI Clearances for Staff Person #5 exceeded 60 months. The State Police and Child Abuse Clearances on file were dated 3.5.19 and 5.28.24. The FBI Clearances were dated 3.7.19 and 5.30.24.

Noncompliance Area: Based on interviews with staff, on 2/16/24, staff person #1, staff person #2 and 12 older toddlers were present in the OT room. All of the children were on their cots getting ready to nap. Child #1 was next staff person #2. Child #1 picked up the staff person's permanent marker off of the floor and scribbled on both of their hands, ankles and right cheek. Staff person #1 and staff person #2 did not see the child draw on themselves. Staff person #2 stated approximately one minute went by until they looked over and saw child #1 with scribbled marker on themselves.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises.

Description: Liquid or powdered soap

Noncompliance Area: Based on interviews with staff, on 2/16/24, child #1 scribbled permanent marker on both of their hands, ankles and right cheek. Staff person #1 attempted to remove the permanent marker on child #1 by using baby oil and then rubbing it with a Magic Eraser. Liquid or powdered soap was not used.
