PORTLAND, Ore. (KOIN) -- A 70-year-old Beaverton day care worker who was found guilty of sexually abusing a child was sentenced to 5 years probation because there wasn't enough evidence to prove intent.
John Patrick Gilbreath first came to the attention of investigators in 2016 when a 3-year-old girl told her parents about what happened at the Partridge House Day Care.
Beaverton police said the 2016 allegation was investigated at the time but no criminal charges were filed.
But in March 2018, another child told her parents similar things. Again, Beaverton police looked into it and Gilbreath was arrested June 14, 2018.
In late January Washington County Judge Andrew Erwin found Gilbreath guilty of 1st-degree unlawful sexual penetration.
But at his sentencing, Erwin found a 25-year prison sentence would be unconstitutional for Gilbreath because they could not prove his actions were "done with a sexual intent."
Gilbreath will get credit for time served, must register as a sex offender, undergo treatments and is forbidden to have contact with minors.
