Noncompliance Area: The file for child #2 lacked an initial child health report that was completed no later than 60 days following the first day of attendance at the facility 7/17/25. The child health report in the file was dated 9/18/25, which was 63 days from the first day of attendance at the facility.

Correction Required: The operator shall require the parent of an enrolled child, including a child, a foster child and a relative of an operator or a facility person, to provide an initial health report no later than 60 days following the first day of attendance at the facility.

Description: Pertinent Laws & Regulations/General Health and Safety

Noncompliance Area: Staff persons #1 and #2 were observed to be caring for children unsupervised. Staff persons #1 and #2 do not have current pediatric first-aid/CPR training. This is evidenced by the previously documented pediatric first-aid/CPR training expiration date of 5/20/26 for staff person #1 and 7/8/26 for staff person #2.

Correction Required: A facility shall be operated in conformity with applicable Federal and State laws and regulations. State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children. Until such time as the required trainings are completed, staff persons #1 and #2 must be supervised, when interacting with children, by an AGS who has completed the required training related to this citation. If there are no staff person(s) available to supervise staff persons #1 and #2, staff persons #1 and #2 may not work in a child care position at the facility.

Description: 12 months prior to service and every 24 months thereafter

Noncompliance Area: The file for staff person #1 lacked a health assessment that was completed 24 months from the previous health assessment. The health assessments in the file are dated 5/13/24 and 7/10/26.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.

Noncompliance Area: The outdoor playspace was observed to have tall grass and a metal pole lying in the grass creating a tripping hazard.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Description: Disposable diapers

Noncompliance Area: In the restroom with the changing table it was observed that a hands-free can was not present in the restroom.

Correction Required: If disposable diapers are provided by a parent or by a facility, a soiled diaper shall be discarded by immediately placing the diaper into a plastic-lined, hands-free covered can.

Description: Two facility persons present in facility

Noncompliance Area: At approximately 8:46am 2 young toddlers and 3 preschool children were with staff person #1 in the Treasure Island classroom and no other staff were in the building with staff person #1 Staff person #2 arrived at the facility at 9:16am.

Correction Required: At least two facility persons shall be present in the facility when two or more children are in care. At a minimum, one of the facility persons shall be a staff person. TIERED LIS: 1. Two facility persons will be present in the facility when 2 or more children are in care. This portion of the plan shall have an immediate correction date. 2. The Legal Entity will arrange for all staff to attend a minimum of 2 hours of in person training on supervision conducted by the ELRC. Proof of training will be submitted upon completion. The operator shall a provide date for when this training will be completed.

Description: Handwashing signs

Noncompliance Area: In the Infant Island restroom, the two child size toilets were observed to not have handwashing signs posted above them.

Correction Required: A facility person and an able child shall wash his hands after toileting and before eating. A sign on which this requirement is written shall be posted at each toilet, training chair, diapering area and sink in the facility.

Noncompliance Area: The Fire Drill and Fire Detection log was observed that fire drills were missing from 8/31/25 to 12/4/25.

Correction Required: The Director or designated staff person who is responsible for compliance with this chapter ensure fire drills are conducted at least once every 60 days.

Noncompliance Area: The Fire Drill and Fire Detection Log was observed for the 30-day smoke detector checks. The 30-day smoke detector checks were missing from 8/31/25 to 12/4/25.

Correction Required: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. § 1016(c)). The Director or designated staff person who is responsible for compliance with this chapter shall ensure the requirements under subsection (a) are met.

Description: Two facility persons present in facility

Noncompliance Area: At approximately 1:02pm 1 infant, 2 young toddlers, 1 older toddler, 2 preschool children, and 1 young school-age children were with staff person #2 in the Treasure Island classroom and no other staff were in the building with staff person #2 until staff person #4 entered the building.

Correction Required: At least two facility persons shall be present in the facility when two or more children are in care. At a minimum, one of the facility persons shall be a staff person.

Description: Similar Age Level/Mixed Age Level

Noncompliance Area: At approximately 1:02pm 1 infant, 2 young toddlers, 1 older toddler, 2 preschool children, and 1 young school-age children were with staff person #2 in the Treasure Island classroom for two minutes until staff person #4 came back into the Treasure Island classroom from being outside. This left staff person #2 over ratio by three children due to the youngest child being an infant.

Correction Required: When children are grouped in similar age levels, the following maximum child group sizes and ratios of staff persons apply: Infants 1:4 with a maximum group size of 8; Young toddlers 1:5 with a maximum group size of 10; Older toddlers 1:6 with a maximum group size of 12; Preschool children 1:10 with a maximum group size of 20; Young school-age children 1:12 with a maximum group size of 24; Older school-age children 1:15 with a maximum group size of 30. When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements in § 3270.51 (relating to similar age level).

Description: Supervised at all times

Noncompliance Area: At approximately 10:06am a school-age child left the Treasure Island classroom and went to the Back Room where the rest rooms are located alone. None of the staff were aware that the school-age child left the Treasure Island classroom. At approximately 10:08am 2 infants, 1 young toddler, 1 older toddler, and four young school-age children were left alone in the Treasure Island classroom for two minutes until staff persons #2, #3, and #4 came back into the Treasure Island classroom.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises.
