The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises.

Correction Required: The facility's current certificate of compliance and a copy of the applicable regulations under which the facility is certified shall be posted in a conspicuous location used by parents, with instructions for contacting the appropriate regional day care office posted at the same location.

Noncompliance Area: OBSERVED CHILD RESTRAINT SEATS IN THE FACILITY'S BUS. OPERATOR REPORTED THAT SHE DOES NOTHAVE MFG INSTRUCTIONS FOR ALL OF THE SEATS.

Correction Required: Manufacturers' instructions for use of safety restraints shall be kept in the vehicle at all times.

Noncompliance Area: OPERATOR HAS SWINGS HANGING FROM THE CEILING IN THE COVERED INFANT/TODDLER OUTDOOR PLAY AREA. THEY ARE NOT MOUNTED OF SURFACING MATERIAL THAT MEETS THE CPSC GUIDELINES.

Correction Required: Outdoor equipment that requires embedded mounting must be mounted over a loose-fill or unitary playground protective surface covering that meets the recommendations of the United States Consumer Product Safety Commission. The equipment must be anchored firmly and be in good repair.

Noncompliance Area: CHILD #1 , DOB 4/25/16, HAS A HEALTH ASSESSMENT ON FILE DATED 7/20/16. CHILD #1 HAS BEEN ATTENDING SINCE 7/12/16. CHILD #2, DOB 6/5/16, HAS A HEALTH ASSESSMENT DATED 8/16/16. Noncompliance Area: THE FIRST AID KIT WAS MISSING TAPE. ALL OTHER REQUIRED ITEMS WERE PRESENT IN KIT.

THE CEILING AND FLOOR COVERINGS HAVE BEEN REMOVED, THERE IS DAMAGED DRYWALL, MISSING FLOOR COVERING & CEILING TILES. EQUIPMENT IS PILED UP IN CORNERS TO MAKE ROOM FOR WORK TO BE DONE. THE ROOM HAS BEEN MADE INACCESSIBLE TO CHILDREN.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility`s outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Noncompliance Area: OBSERVED PEELING PAINT OF THE CONCRETE FOUNDATION WALL ALONG THE SIDEWALK IN THE PRESCHOOL/SCHOOL AGE PLAY YARD. ALSO OBSERVED SOME FLAKING PAINT ON THE FOUNDATION WALL OF THE BUILDING THAT IS ACCESSIBLE FROM THE GRASSY PART OF THE PRESCHOOL/SCHOOL AGE PLAY YARD.

Correction Required: Peeled or damaged paint or damaged plaster is not permitted on indoor or outdoor surfaces in the child care facility.

Noncompliance Area: ON 7/12/17 WHEN REP ARRIVED TO VERIFY CORRECTIONS, OBSERVED A HOT PLATE IN USE THAT WAS SET AT 275 DEGREES F. IT WAS ON THE COUNTER IN THE KITCHENETTE WHICH IS ACCESSIBLE TO CHILDREN.

Correction Required: Hot water pipes and other sources of heat exceeding 110 F that are accessible to children shall be equipped with protective guards or shall be insulated to prevent direct contact.

Noncompliance Area: WHEN THE CERTIFICATION REP ARRIVED TWO STAFF PERSONS WERE OUTSIDE IN THE PLAY AREA WITH 10 CHILDREN. ONE STAFF PERSON IDENTIFIED HER GROUP AS BEING 1 INFANT, 1 YOUNG TODDLER AND 2 PRESCHOOLERS. WHEN ASKED TO IDENTIFY HER PRIMARY SUPERVISION GROUP, THE OTHER STAFF PERSON IDENTIFIED 1 INFANT, 1 YOUNG TODDLER AND 4 OTHER CHILDREN BUT NAMED AT LEAST 1 OF THE CHILDREN THAT WAS ASSIGNED TO THE OTHER STAFF PERSON, LEAVING 1 CHILD UNACCOUNTED FOR.

Correction Required: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements at 3280.52(b) : The required staff:child ratios must be maintained at all times. . THE LEGAL ENTITY WILL ARRANGE FOR STAFF AT FACILITY TO PARTICIPATE IN UP TO 10 HOURS OF PQAS APPROVED TECHNICAL ASSISTANCE. IT DOES NOT MATTER IF THE PQAS APPROVED TECHNICAL ASSISTANCE IS THROUGH THE REGIONAL KEY. THE LEGAL ENTITY MUST RECEIVE DHS APPROVAL OF THE TECHNICAL ASSISTANCE BEFORE IT BEGINS.

Noncompliance Area: A NEW FENCE WAS JUST INSTALLED IN THE OUTDOOR PLAY AREA AND THERE IS A LARGE GAP (OVER 1 FOOT) GAP UNDER THE FENCE IN SEVERAL AREAS WHERE A CHILD COULD GET UNDER THE FENCE AND GET ACCESS TO A WOODED AREA OR THE ROAD.

Correction Required: If unsafe areas or conditions are in or near an outdoor play space, fencing or natural barriers are required to restrict children from those unsafe areas or conditions.
