Noncompliance Area: The outdoor play space adjacent to the school age classroom contained a wall-mounted chalkboard with a tray that had sharp corners creating a hazard for children in care.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Description: No peeling paint or plaster

Noncompliance Area: The outdoor play space adjacent to the school age classroom contained 2 wooden picnic tables each with multiple areas of peeling paint.

Correction Required: Peeled or damaged paint or damaged plaster is not permitted on indoor or outdoor surfaces in the child care facility.

Description: Comply with CPSL/CPSL information

Noncompliance Area: The file of staff #1 contained a PA criminal history clearance which did not have a dissemination date rendering the clearance incomplete.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person #1 may not work in a child care position at the facility.

Description: Clean and good repair

Noncompliance Area: In the outdoor play space, the adhesive repair to the platform of a toddler slide was pulling off exposing a cracked area approximately 2 inches in length.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Description: Inaccessible to children

Noncompliance Area: The drawstring bags were hanging on the door handles in each of the outdoor play spaces at a height which made the first aid kits stored inside the bags accessible to children.

Correction Required: A first-aid kit must be inaccessible to children.

Regulation: 3270.82(h)

Description: Handwashing signs

Noncompliance Area: The training chair in the restroom did not have a posted handwashing sign.

Correction Required: A facility person and an able child shall wash his hands after toileting and before eating. A sign on which this requirement is written shall be posted at each toilet, training chair, diapering area and sink in the facility.

Description: Staff assigned to specific children

Noncompliance Area: Durning rest time, staff #1 was asked to identify the children in the primary supervisory group of the 7 children in the infant classroom. Staff #1 identified 3 children (2 infants and 1 young toddler). Staff #2 was then asked, and they identified 4 children (all under the age of one year) in their supervisory group. One of the children identified in the supervisory group of staff #1 was also identified by staff #2 leaving one child, who was asleep in a crib, not identified by staff #1 or staff #2

Correction Required: Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises.

Description: Age and Training/Exp, educ., training at facility

Noncompliance Area: The file of staff #2 contained documentation of 9 training hours in their annual training year of December 2022 to December 2023 lacking 3 hours to meet the annual 12-hour requirement. Staff #2 had taken 2 hours of training on 2/19/2024 and 1 hour on 6/5/2024 and is now in compliance.

Correction Required: A staff person shall obtain an annual minimum of 12 clock hours of child care training. A facility person's record shall include verification of child care experience, education and training following the outset of service at the facility.

Description: Comply with CPSL/CPSL information

Noncompliance Area: The file of staff #3 contained a volunteer PA state police and volunteer child abuse clearance, lacking the acceptable clearances for staff under the CPSL.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). LACKING REQUIRED HIRING DOCUMENTS: A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person #3 may not work in a child care position at the facility.

Correction Required: The services to be provided to the family and the child, including the Department's approved form to provide information to the family about the child's growth and development in the context of the services being provided. The operator shall complete and update the form and provide a copy to the family in accordance with the updates regarding emergency contact information in § 3270.124(f) (relating to emergency contact information).

Noncompliance Area: Staff person #1, with health and safety training completed prior to 10-4-22, lacked the Pennsylvania Health and Safety Update 2022 Training required by 12-30-22 and requires current training.

Correction Required: A facility shall be operated in conformity with applicable Federal and State laws and regulations. State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children.

Description: General Health and Safety

Noncompliance Area: In the young toddler room with young toddlers present in the room, there was a Santa Claus decoration and stereo on the shelf between the older toddler and young toddler rooms with cords that were accessible to children that could be pulled down and were a visible hazard.

Correction Required: Conditions at the facility may not pose a threat to the health or safety of the children.

Description: Letter to parents

Noncompliance Area: The operator's letter provided to the parent of each enrolled child explaining the emergency procedures lacked the accommodations for infants, toddlers, and children with chronic medical conditions.

Correction Required: The operator shall provide to the parent of each enrolled child a letter explaining the emergency procedures. The operator shall also provide to the parent of each enrolled child a letter explaining any subsequent update to the plan.

Regulation: 3270.69(b)

Description: 110º F or less

Noncompliance Area: The water temperature at the sink in the preschool rom was 116° F.

Correction Required: Hot water temperature, in areas accessible to children, may not exceed 110° F.

Regulation: 3270.94(a)(1)

Description: Every 60 days

Noncompliance Area: According to the fire drill log, a fire drill was not conducted at least once every 60 days between 9-11-23 to 11-16-23.

Correction Required: The Director or designated staff person who is responsible for compliance with this chapter shall conduct fire drills and ensure that fire drills are conducted at least once every 60 days.

Noncompliance Area: According to the log, the operator did not manually test the interconnected fire detection system in the facility at least once every 30 days between 5-26-23 to 6-30-23 and 9-11-23 to 11-16-23.

Correction Required: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. §  1016(c)). The Director or designated staff person who is responsible for compliance with this chapter shall ensure the requirements under subsection (a) are met.

Description: Age and Training/Exp, educ., training at facility

Noncompliance Area: The files for staff #2 through #6 contained pediatric CPR and first aid certification which was not renewed on or before the expiration of their previous certification. The training dates for each are as follows - staff #2; previous training 5/24/19, renewed 9/20/21. Staff #3; previous training 7/30/19, renewed 9/20/21. Staff #4; previous training 5/20/19, renewed 9/20/21. Staff #5; previous training 3/01/19, renewed 9/20/21. Staff #6; previous training 8/05/19, renewed 9/20/21. All staff now have current pediatric CPR and pediatric first aid training.

Correction Required: Competence is the completion of training by a professional in the field of first-aid and cardiopulmonary resuscitation (CPR). All staff persons shall renew their certification in pediatric first aid and pediatric cardiopulmonary resuscitation (CPR) on or before the expiration of the most current certification.A facility person's record shall include verification of child care experience, education and training following the outset of service at the facility.

Description: Health and Safety Training - Pediatric First Aid and CPR/Exp, educ., training at facility

Noncompliance Area: The file for staff #1 contained pediatric CPR and first aid certification completed more than 90 days after hire. Staff #1 was hired on 2/17/21. The training was completed on 9/20/21.

Correction Required: Staff persons shall complete professional development in pediatric first aid and pediatric cardiopulmonary resuscitation within 90 days of hire.A facility person's record shall include verification of child care experience, education and training following the outset of service at the facility.

Description: Hypothetical locations

Noncompliance Area: Based on documentation at the facility, the hypothetical location of the fire during drills has not been rotated for each consecutive drill. Drills held on 5/26/21 and 6/29/21 and drills held on 9/30/21, 10/20/21, and 11/24/21 each had the same hypothetical location, pull station 60.

Correction Required: The Director or designated staff person who is responsible for compliance with this chapter shall conduct fire drills and ensure that the hypothetical locations of the fire are rotated around the facility for each drill such that the hypothetical location is never the same for consecutive drills.

Noncompliance Area: The files for child #1, #2, and #3 lacked an immunization record in accordance with the ACIP.

Correction Required: A health report shall include a review of the child's immunized status according to recommendations of the ACIP.

Noncompliance Area: The file for staff person #1, with a hire date of 9/30/19, contained a Department of Education finger print clearance, and no proof of applying for the DHS FBI finger print clearance. Staff person #2, with a start date of 6/10/19, file lacked a signed disclosure statement.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). LACKING REQUIRED HIRING DOCUMENTS: Facility Person # 1-- may not work in a child care position at the facility. A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person #1--- may not work in a child care position at the facility.

Noncompliance Area: There was no list daily activities posted in the infant room.

Correction Required: A written plan of daily activities and routines, including a time for free play shall be established for each group. The plan shall be flexible to accommodate the needs of individual children and the dynamics of the group.

Noncompliance Area: Facility persons #3 #4 #5 and #6had been at the facility over a year. Their records did not reflect that they had taken fire safety training within the years time.

Correction Required: Staff persons shall participate, at least annually, in firesafety training conducted by a fire protection professional. Staff persons and volunteers shall receive training in maintenance of smoke detectors, the duties of facility persons during a fire drill and during a fire and the use of the facility's fire extinguishers, not including discharge of the fire suppressant agent.

Noncompliance Area: Staff person #1 did not have proof of having been finger printed in the file. Staff person #1's start date was 12-2-2018. Staff person #2 completed a CPSL training, however it was not with one of the state approved providers.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). LACKING REQUIRED HIRING DOCUMENTS: Facility Person # 1 may not work in a child care position at the facility.

Noncompliance Area: The emergency contact form for child #1 was missing the addresses of the release persons.

Correction Required: Emergency contact information must include the name, address and telephone number of the individual designated by the parent to whom the child may be released.

Noncompliance Area: In the crib of child #2, the crib sheets are loose and may cause the child to suffocate.

Correction Required: Conditions at the facility may not pose a threat to the health or safety of the children.
