Findings: Based on the Surveyors' observations at the time of the inspection, the certificate holder failed to comply with the Enforcement Agreement that was signed by the certificate holder and implemented by the Department on 08-19-2020. The Surveyors did an inspection to verify closure of the home, and upon the Surveyors' arrival at 9:35 a.m., there were 5 enrolled children present in the home, and a 6th enrolled child arrived during the inspection. The provider and 1 staff member were present with the enrolled children and the home was in full operation. The provider is not qualified for this position and the certificate holder was put on notice regarding this issue on 02-20-2020 during the yearly Compliance inspection. It was observed that children were participating in daily activities as usual and the home was not closed as agreed upon. Due to the fact that the home is not able to currently operate as per the Enforcement Agreement and the certificate holder has not complied with the stipulations for re-opening, as well as the fact that the provider is not qualified, the certificate holder placed the enrolled children's health, safety, and welfare at risk of harm. | |||
