Regulation: 3270.102(a)

Description: Clean and good repair

Noncompliance Area: In the Bumblebees room, a bin of Magna Blocks was observed to have four blocks in poor repair; specifically, the plastic was cracking, creating a potential hazard. Also in the Bumblebees room, a blue bin was observed under the window by the Quiet Area. The bin was cracked, creating a sharp edge.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Regulation: 3270.151(a)

Description: 12 months prior to service and every 24 months thereafter

Noncompliance Area: The record for Staff Person #1 included health assessments dated 1/6/2023 and 1/3/2025, which were timely. However, the 1/3/2025 health assessment did not include an examination for communicable diseases. An updated health assessment was obtained on1/8/2026, making the timeframe between complete health assessments greater than 24 months. (SEE LIS CODE SHEET) Similarly, the record for Staff Person #2 included health assessments dated 2/8/2023 and 2/24/2025, which were timely. However, the 2/24/2025 health assessment did not include an examination for communicable diseases. An updated health assessment was obtained on1/9/2026, making the timeframe between complete health assessments greater than 24 months. (SEE LIS CODE SHEET)

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.

Description: Age and Training

Noncompliance Area: The file for Staff Person #3 lacked the minimum 12 hours of annual childcare training. Specifically, between November 2024 and November 2025, Staff Person #3 obtained 10 hours of childcare training.

Correction Required: A staff person shall obtain an annual minimum of 12 clock hours of child care training.

Regulation: 3270.66(e)

Description: Arts and crafts non-toxic

Noncompliance Area: In the Monster Bugs room in a bin of art supplies, several bottles of Dab-O-Ink bingo daubers labeled "keep out of reach of children" were mixed in with non-toxic, child-safe ink daubers.

Correction Required: Arts and crafts materials shall be nontoxic.

Regulation: 3270.72(d)

Description: Above ground window opening restricted to 6"

Noncompliance Area: In the Caterpillars room, which is above the ground floor, a small window near the bathroom area was observed not to have the locks employed which would limit the opening to 6 or fewer inches. Additionally, a chair was pulled below the window, making it easily accessible to children.

Correction Required: Windows or doors above the ground floor that open directly to the outdoors and are accessible to children shall be constructed, modified or adapted to limit the opening to 6 or fewer inches.

Regulation: 3270.76

Description: Building Surfaces

Noncompliance Area: Several stained ceiling tiles were observed throughout the facility, specifically: in the Fireflies room, in the corner of the ceiling above the toy kitchen; in the Crickets room, in the back right corner; in the Bumblebees room, above the exit to the outdoor play space, to the right of the exit and in the storage closet at the rear of the room.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Regulation: 3270.77(a)

Description: No peeling paint or plaster

Noncompliance Area: At the back left of the Crickets room near the "Hot Chocolate Stand" toy, plaster at the corner where the walls meet was observed to be cracked and flaking.

Correction Required: Peeled or damaged paint or damaged plaster is not permitted on indoor or outdoor surfaces in the child care facility.

Regulation: 3270.95(a)/3270.95(b)

Description: Devices must be compliant/Director or designated staff person ensure compliance

Noncompliance Area: The facility's fire detection testing log included two tests which were more than 30 days apart (4/10/2025 - 5/13/2025, 33 days). The fire extinguisher at the end of the upstairs hall by exit #4 was reading in the "overcharged" range. The fire extinguisher in the Monster Bugs room was also reading in the "overcharged" range.

Correction Required: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. § 1016(c)). The Director or designated staff person who is responsible for compliance with this chapter shall ensure the requirements under subsection (a) are met.

Regulation: 3270.131(a)/3270.182(1)

Description: Health information/Initial and subsequent health reports

Noncompliance Area: The initial health report in the file for Child #1 was conducted more than 60 days after the child's first day of attendance at the facility.

Correction Required: The operator shall require the parent of an enrolled child, including a child, a foster child and a relative of an operator or a facility person, to provide an initial health report no later than 60 days following the first day of attendance at the facility. A child's record shall contain initial and subsequent health reports.

Regulation: 3270.32(a)

Description: Comply with CPSL

Noncompliance Area: The most recent Mandated Reporter Trainings in the file for Staff Person #2 exceeded 60 months between trainings.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services).

Regulation: 3270.34(a)(6)

Description: Staff evaluations

Noncompliance Area: The most recent written evaluations in the file for Staff Person #1 exceeded 12 months between evaluations.

Correction Required: A director is responsible for written evaluation of staff persons on a regular basis, a minimum of one evaluation every 12 months.

Regulation: 3270.113(b)

Description: No physical punishment

Noncompliance Area: During staff interviews on 5/24/24 staff verified that staff person #1 physically punished child #1 by lifting him up by his arm and sitting him down very roughly onto the floor.

Correction Required: A facility person may not use any form of physical punishment, including spanking a child.

Regulation: 3270.20(a)(1)

Description: Inpatient hospitalization or ER treatment of child

Noncompliance Area: An incident occurred on 5/16/24 and the operator did not notify the regional office within 24 hours after the child was taken to the emergency room.

Correction Required: The operator shall immediately notify a child's parent and shall telephone notice to the appropriate regional office within 24 hours if a child in care at the facility is hospitalized or receives emergency room treatment.

Regulation: 3270.32(a)

Description: Comply with CPSL

Noncompliance Area: Staff #1 had a mandated reporter training that was completed longer then 60 months between trainings. Dates of trainings 11/4/18 and 11/9/23.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services).
