Description: Supervised at all times /Staff assigned to specific children

Noncompliance Area: On 6/24/24 upon entering the building from the outdoor play area staff #1 & 2 miscounted the children and child #1 & 2 were left outside in the play space. Child #1 & 2 were left outside for 5 minutes then they went over the fence. Child #1 & 2 were found approximately an hour later by the Macungie Police and returned to the center.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. Children must be supervised at all times. Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises.

Noncompliance Area: Staff person #1 does not have an initial health assessment and TB results on file prior to working with children.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem. A facility person's record shall include a written report of initial and subsequent health assessments, including the results of initial and subsequent tuberculin skin tests, x-rays or other medical documentation necessary to confirm freedom from communicable tuberculosis.

Noncompliance Area: Staff person #1 does not have two written nonfamily references on file.

Correction Required: A facility person's record shall include two written, nonfamily references from individuals attesting to the person's suitability to serve as a facility person.

Description: General Health and Safety/Supervised at all times

Correction Required: Conditions at the facility may not pose a threat to the health or safety of the children. Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. Supervision will be checked by three unannounced supervision visits to the facility over the next three months.

Description: Comply with CPSL/CPSL information

Noncompliance Area: Staff person #1 does not have proof of FBI fingerprinting prior to working with children. Staff #1 paid for fingerprinting although did not complete process of actually having the fingerprinting done.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). LACKING REQUIRED HIRING DOCUMENTS: Facility Person # 1 may not work in a child care position at the facility. A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL.

Description: Clean and good repair

Noncompliance Area: On the outside playground, there is a rope ladder. It was observed on the rope ladder that the bottom step was broken. The right side of the step was not attached to the rope and the edge had wooden splinters.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Description: Fire safety - 1 yr.

Noncompliance Area: During the renewal inspection on 4/10/2024, staff 2, 3, 4, 5 and 6 did not have updated fire safety training on file. There was a fire safety/emergency plan training form on file that was dated 9/18/2024. With it being a date in the future, it was not acceptable. As per facility, it was dated incorrectly.

Correction Required: Staff persons shall participate, at least annually, in firesafety training conducted by a fire protection professional. Staff persons and volunteers shall receive training in maintenance of smoke detectors, the duties of facility persons during a fire drill and during a fire and the use of the facility's fire extinguishers, not including discharge of the fire suppressant agent.

Correction Required: A facility shall be operated in conformity with applicable Federal and State laws and regulations.State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children.

Noncompliance Area: The facility did not have information available on how to access regulations electronically. There was not instructions available on how to contact the appropriate regional office.

Correction Required: The operator shall provide the parent of each child enrolled with information on how to access the regulations in this chapter electronically and with instructions for contacting the appropriate regional child care office.

Description: Health and Safety Training

Noncompliance Area: Staff person #1-10 did not complete the required one-hour 2022 update to the health and safety training by 12/30/2022.

Correction Required: Staff person #1 shall complete the required one-hour 2022 update to the health and safety training by 5/6/2023.

Description: Comply with CPSL/CPSL information

Noncompliance Area: Staff 9, 11 and 12 had clearances that previously had more than 5 years between updates. Staff 9 had a state police clearance dated 8/17/2017 and was not updated again until 3/8/2023. The child abuse clearance was dated 8/23/2017 and not updated again until 3/8/2023. The FBI clearance was dated 8/16/2017 and not updated again until 3/10/2023. Staff 11 obtained the state police and child abuse clearance on 6/29/2017 and did not update them until 3/8/2023. Staff 12 obtained the child abuse clearance on 10/29/2015 and the FBI clearance on 11/2/2015. The child abuse clearance was not updated until 4/5/2022 and the FBI was updated on 11/24/2021.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). Description: Age and Training/Health and Safety Training - Pediatric First Aid and CPR

Noncompliance Area: During an investigation from 8/1/2022-9/26/2022, it was found that staff 1 and 2 completed online only first aid/cpr training that was not The American Red Cross "Adult and Pediatric First Aid/CPR." Staff 1's first aid training was completed on 6/4/2021. Staff 2's first aid training was completed on 7/6/2021.

Correction Required: Competence is the completion of training by a professional in the field of first-aid and cardiopulmonary resuscitation (CPR). All staff persons shall renew their certification in pediatric first aid and pediatric cardiopulmonary resuscitation (CPR) on or before the expiration of the most current certification.Staff persons shall complete professional development in the topics of 3270.31(f)(10). Staff persons #1 and 2 will have until 10/13/2022 to complete the required training. Until such time as the required training has been completed, staff persons 1 and 2 must be supervised, when interacting with children, by an AGS who has completed the required training related to this citation. If there are no staff available to supervise staff persons 1 and 2, staff persons #1 and 2 may not work in a child-care position at the facility.

Description: No ridicule or threaten harm

Noncompliance Area: During a complaint investigation, it was verified that facility person 1 touched child 1's butt and said "sorry, the devil made me do it " on July 29th, 2022. It occurred during outside play in the morning.

Correction Required: A facility person may not single out the child for ridicule, threaten harm to the child or the child's family and may not specifically aim to degrade the child or the child's family.

Regulation: 3270.66(a)

Description: Locked or inaccessible

Noncompliance Area: There were toxics, which was disinfectant cleaners, under the sink in the pre-k room in an unlocked cabinet. The cabinet was accessible to the children in care.

Correction Required: Cleaning materials and other toxic materials shall be kept in an area or container that is locked or made inaccessible to children.
