Description: Unsafe Areas in Outdoor Space

Noncompliance Area: On 7/29/25, child #1 eloped through an area of the fence that was not secure. Staff person #1 prevented child #1 from reaching the road.

Correction Required: If unsafe areas or conditions are in or near an outdoor play space, fencing or natural barriers are required to restrict children from those unsafe areas or conditions.

Correction Required: A facility shall be operated in conformity with applicable Federal and State laws and regulations.State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children.

Noncompliance Area: The facility admitted to not conducting annual emergency drills.

Correction Required: Emergency drills shall be conducted annually. Annual emergency drills shall be documented and on file at the facility.

Noncompliance Area: Staff person #1 & 2 did not complete the required health and safety training within 90 days of hire.

Correction Required: Staff persons shall complete professional development within 90 days of hire as listed in subsections (f)1-10.

Description: Infant: updated health report every 6 months/Exemption documentation from parent/guardian

Noncompliance Area: During the paperwork review portion of the annual renewal inspection on 5/9/2023, child 1, who was a young toddler, had a health report dated 5/23/2022. An updated health report was not obtained by 11/23/2023. Child 2 did not have an updated flu shot on file for the year of 2022.

Correction Required: The operator shall require the parent to provide an updated health report at least every 6 months for an infant or young toddler. The facility shall require the parent to provide updated written verification from a physician, physician's assistant, CRNP, the Department of Health or a local health department of ongoing vaccines administered to an infant, toddler or preschool child in accordance with the schedule recommended by the ACIP.

Exemption from immunization for reasons of medical need must be documented by a written, signed and dated statement from the child's physician, physician's assistant or CRNP. Noncompliance Area: During the renewal inspection on 5/15/2023, staff 1 did not obtain the child abuse clearance until after 45 days from date of hire. She also did not have the FBI and NSOR clearance on file within 45 days of hire, which is out of compliance with the provisional hire requirements.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). Description: Child's hands washed/Adult Hygiene

Noncompliance Area: During the renewal inspection on 6/8/2022, certification representative observed staff 5 changing a diaper. Staff 5 did not wash her hands or the hands of the child after diapering.

Correction Required: A staff person shall ensure that a child's hands are washed before meals and snacks, after toileting and after being diapered.A facility person shall wash his hands before meals and snacks, and after toileting and after diapering a child.

Noncompliance Area: The facility did not have a section on how to accommodate infant, toddler, children with disabilities and children with chronic medical conditions during an emergency.

Noncompliance Area: Upon entering the outside play area, there is an orange climbing mechanism to the left. It has peeling paint all throughout it.

Correction Required: Peeled or damaged paint or damaged plaster is not permitted on indoor or outdoor surfaces in the child care facility.

Noncompliance Area: Facility person #1 is missing an initial health assessment and TB test. Date of hire 12/11/17.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.An adult health assessment must include tuberculosis screening by the Mantoux method at initial employment. Subsequent tuberculosis screening is not required unless directed by a physician, physician's assistant, CRNP, the Department of Health or a local health department.

Noncompliance Area: The facility's emergency plan has not been updated since 4/1/17.

Correction Required: The operator shall review the emergency plan at least annually and update the plan as needed. The operator shall document in writing each review and update of the emergency plan and kept on file at the facility.

Noncompliance Area: Child 1 did not have a tuition amount on his fee agreement. Child 3 did not have a date of admission on her fee agreement.

Correction Required: An agreement shall specify the amount of the fee to be charged per day or per week. An agreement shall specify the date of the child`s admission.

Noncompliance Area: Child 3 did not have services provided listed on fee agreement. Child 2 and 4 did not have updated child service reports in their files.

Correction Required: The services to be provided to the family and the child, including the Department`s approved form to provide information to the family about the child`s growth and development in the context of the services being provided. The operator shall complete and update the form and provide a copy to the family in accordance with the updates regarding emergency contact information in 3270.124(f) (relating to emergency contact information).

Noncompliance Area: Child 1 did not have a health assessment on file and he was at the facility for longer than 60 days.

Correction Required: The operator shall require the parent of an enrolled child, including a child, a foster child and a relative of an operator or a facility person, to provide an initial health report no later than 60 days following the first day of attendance at the facility.

Noncompliance Area: Medication for child 5 was not in an original container. It was an unknown medication in a plastic bag.

Correction Required: A prescription or nonprescription medication may be accepted only in an original container. The medication shall remain in the container in which it was received.

Noncompliance Area: Child 1 did not have permission for emergency medical care or minor first aid documented on emergency contact form.

Correction Required: A child`s record shall contain signed parental consent for emergency medical care for the child. Written consent is required prior to admission.A child`s record shall contain signed parental consent for administration of minor first-aid procedures by facility staff. Noncompliance Area: Staff 1 began employment on 6/22/2017. Staff 1 did not have proof of applying for a child abuse clearance on file, nor a signed disclosure form. A child abuse clearance was not obtained until 8/4/2017.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services. A provisional employee may not be permitted to work alone with children and must work within the vicinity of a permanent employee. A facility person`s record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL.

Noncompliance Area: A first aid kit was not in the outside playspace when children were out there.

Correction Required: A first-aid kit shall be in a child care space.

Noncompliance Area: During an unannounced swimming visit on 8/11/2017, facility did not have a first aid kit at the pool

Noncompliance Area: Employees did not have emergency plan trainining when the change of ownership occurred.

Correction Required: The operator shall assure that each facility person receives training regarding the emergency plan at the time of initial employment, on an annual basis and at the time of each plan update. The operator shall document the date of each training and the names of all facility persons who received the training and kept on file at the facility.
