Description: Staff:child ratios while swimming

Noncompliance Area: On 7/29/25, an off-site swimming inspection was conducted at Brookside Swim Club. Cert Rep observed 5 older school age children and 13 young school age children (totaling 18 children) with Staff 1 and Staff 2 present for swimming. Staff 3 did not count in ratio since they were the lifeguard.

Correction Required: The staff-child ratios while children are swimming are Infant 1:1; Young or older toddler 1:2; Preschool 1:5; Young school-age 1:6; Older school-age1:8.

Regulation: 3270.31(e)(4)(ii)

Description: Fire safety - 1 yr.

Noncompliance Area: At the time of the inspection, Staff 1 did not have proof of a current fire safety training on file.

Correction Required: Staff persons shall participate, at least annually, in firesafety training conducted by a fire protection professional. Staff persons and volunteers shall receive training in maintenance of smoke detectors, the duties of facility persons during a fire drill and during a fire and the use of the facility's fire extinguishers, not including discharge of the fire suppressant agent.

Noncompliance Area: At the time of the inspection (5/22/25 at 7:30 am), Staff 1 was the only staff person with 2 school age children, no other staff or facility persons were present..

Correction Required: At least two facility persons shall be present in the facility when two or more children are in care. At a minimum, one of the facility persons shall be a staff person.

Description: Excursions

Noncompliance Area: At the time of the inspection, the school bus that the children were riding in did not have a copy of the children's emergency contact information forms.

Correction Required: When children leave the facility on walking and riding excursions, emergency contact information specific to each child on the excursion shall accompany a staff person on the excursion.

Noncompliance Area: At the time of the inspection, child 1, 2, 3 and 4 did not have an emergency contact form nor an agreement form that has been updated by parent within the last 6 months. Child 5's agreement form was not updated within the last 6 months. See LIS code sheet for last update.

Correction Required: The parent shall update in writing emergency contact information once in a 6-month period or as soon as there is a change in the information. A parent is required to review and update the emergency contact information and the financial agreement at least once in a 6-month period or as soon as there is a change in the information.

Noncompliance Area: At the time of the inspection, Staff 1 arrived at the center by bus with 8 children. No other staff was at the center at this time, leaving staff 1 alone with 8 school age children.

Correction Required: At least two facility persons shall be present in the facility when two or more children are in care. At a minimum, one of the facility persons shall be a staff person.

Noncompliance Area: Certification rep reviewed staff #1 file and observed Pediatric First Aid/CPR certificate on record is not from an approved PQUAS instructor. Staff #1 date of hire: 11/16/2019.

Correction Required: Staff persons shall complete professional development in pediatric first aid and pediatric cardiopulmonary resuscitation within 90 days of hire.

Noncompliance Area: Certification rep reviewed staff #1 record and observed FBI clearance and out of state Child Abuse clearance is not on record date of hire 11/16/2019.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). SAFETY PLAN: The operator is required to submit to the Children and Youth Agency a plan of supervision or alternate arrangement as required by the Child Protective Services Law. LACKING REQUIRED HIRING DOCUMENTS: Facility Person # -- may not work in a child care position at the facility. PROVISIONAL HIRE UNSUPERVISED: A provisional employee may not be permitted to work alone with children and must work within the vicinity of a permanent employee. A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person #--- may not work in a child care position at the facility.

Description: Information re: special needs/Consent for administration of medications or special dietary needs

Noncompliance Area: During renewal inspection, certification rep reviewed child #1 file, information on the child's special needs and parental consent for special dietary needs was missing on the emergency contact form.

Correction Required: Emergency contact information must include information on the child's special needs, as specified by the child's parent, physician, physician's assistant or CRNP, which is needed in an emergency situation.A child's record shall contain signed parental consent for administration of medications or special dietary needs.
