Findings: The staffing pattern posted in the school age classroom is inaccurate. It has the Center's Director and Owner as working with that class from 4pm to 6pm daily. However, she denies that she does and reports that she is instead at another location of the Center in another city. Please revise the staffing patterns to accurately reflect which staff are covering which rooms. Please post the corrected staffing patterns in the corresponding rooms and send a copy of all staffing patterns to OCC for the correction of this non-compliance.

Findings: The Complainant reported that parents have been asked to provide the Friday afternoon snack for their child's classroom. The Center reports that they have designated Fridays as Healthy Snack Days as a family engagement activity for the Center's upcoming accreditation. The Center reports that it is by voluntary participation of the parents. The Center added that if a child does not like what is brought in by the parent who signed up for that Friday, the Center will provide an alternative snack for that child. Nonetheless, the regulation states that if a Center operates 4 or more hours per day, the operator shall furnish snacks. When discussed with the Center Director and Assistant Director, they report that they will cease the parents' participation in providing Friday afternoon snacks and the Center will resume providing snacks everyday. Therefore, this non-compliance is now corrected.

Findings: The Center reports that they have designated Fridays as Healthy Snack Days as a family engagement activity for the Center's upcoming accreditation. The Complainant is concerned that some of the snacks have been homemade; brought from home to share with all children in the classroom. The Complainant is worried in regards to allergens and how the snack was prepared and kept by the various parents. Therefore, if a snack is prepared by the parent at their home, there is no way to determine the processing or handling of the food and possible contaminants. LS discussed the concerns and regulation with the Center Director and Assistant Director. They report that they will cease the parents' participation in providing Friday afternoon snacks and the Center will resume providing snacks everyday. Therefore, this non-compliance is now corrected.

Findings: The Center did not notify OCC via 1203 regarding two staff members moving from the Dunkirk location to the Huntingtown location. Even if a 1203 is submitted deleting them from one location, another 1203 must be submitted to add them to the other location to include their accurate start date at the other location. While on-site, the Center wrote a 1203 to add AB and GL to the Huntingtown location. Therefore, this non-compliance is now corrected.

Findings: During the on-site inspection, it was discovered that OCC was unaware of three staff members having left employment at the Center ranging in dates from 12/15/22 to 02/24/23. It was also discovered that a teacher had moved to substitute status on 08/19/22 and an Aide to substitute status also on 08/19/22, but OCC had not been notified. The Center must notify OCC of staff changes within five business days via 1203. During the inspection, the Center completed a 1203 reflecting these changes so this non-compliance is now corrected.

Findings: The overall temperature in the building seemed cold. The thermostat was set on 69 degrees F. When the floor temperature in the infant room was taken, it only measured 62 degrees F. The floor temperature throughout the Center must be at least 65 degrees F or greater. Please inform OCC of how the Center will maintain the floor temperature in all rooms at 65 degrees F or higher for the correction of this non-compliance.

Findings: Although Aide RS has been employed since 09/08/2022, she has not had a medical evaluation completed. When asked, she said that she has an appointment scheduled for 06/22/2023. Center Director instructed her to have a medical completed ASAP. Please submit a completed medical on OCC's form for RS for the correction of this non-compliance.

Findings: Hazardous cleaning chemicals were found in an unsecured cabinet in the bathroom that was also unsecured. The bathroom has a child resistant handle locking mechanism on the door, but it was not engaged; therefore, leaving the bathroom and the chemicals potentially accessible to children. While on site, the Center placed a lock on the cabinet door that contains the chemicals. Therefore, this non-compliance is now corrected.

Findings: During the inspection, two electrical sockets were found to be uncapped and unused. While on-site, the Center capped both outlets. Therefore, this non-compliance is now corrected.

Findings: During the inspection, juice was observed to have been transferred out of its original container into unmarked/unlabeled dispensers. While on-site, the Center disposed of the juice, stating that it was leftover from last week. Therefore, this non-compliance is now corrected.

Findings: Complainant reported difficulty reaching the Director of the Center by phone and by coming to the Center on multiple occasions. The Complainant reported that she was only able to reach the Owner/Director by going to the other Center location in Dunkirk. When asked, the Director reports that she is in the Huntingtown location more than 50% of the time, as required. When other staff were asked, they also report that the Director is on-site at the Huntingtown location every morning until at least mid-day. When the Licensing Specialist arrived for this inspection, the Director was on-site. However, when the Licensing Specialist asked the Director for her schedule, it only shows her on the schedule working 19 hours per week. The Center is open from 6am to 6pm as reflected on the license and the work hours for other employees. Therefore, the Center operates 60 hours per week which then requires the Director to be present at the Center at least 30 hours per week. The Director must be there 50% of the operating hours to plan and supervise all aspects for children, supervise staff and be available to staff, parents and children.
