Noncompliance Area: A renewal inspection was conducted at the facility on 5/14/26, at the time of the inspection a review of staff files was conducted and found that Staff Person #1 only completed 9 hours of annual childcare training during the 2025 training period.

Correction Required: A staff person shall obtain an annual 12 clock hours of child care training.

Description: Comply with CPSL

Noncompliance Area: A renewal inspection was conducted on 9/16/25 and a review of staff files found that staff person #1 did not update their clearances every 60 months as evidenced by a previous NSOR dated 2/25/20 and a current dated 9/2/25.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). All required clearances need to be renewed prior to expiration of each certificate, every 60 months.

Description: FIRE DETECTION/Staff responsibility

Noncompliance Area: Per the facility's fire drill and detection log, there were more than 30 calendar days between tests of the facility's fire detection system 10/5/23-11/9/23, 1/2/24-2/5/24, 2/5/24-3/12/24, and 5/2/24-6/3/24.

Correction Required: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. §  1016(c)). The primary staff person or designated staff person who is responsible for compliance with this chapter shall ensure the requirements in subsection (a) are met.

Description: Admission date/Application, admission, withdrawal dates

Noncompliance Area: During the inspection, child #1 through child #5 did not have a date of admission on the agreement for this school year.

Correction Required: An agreement shall specify the date of the child's admission. A child's record must contain the dates of application, admission and withdrawal of the child.

Regulation: 3280.131(d)(5)/3280.131(e)(3)

Description: Immunization record/Dismissal policy

Noncompliance Area: During the inspection, child #4 did not have an annual influenza vaccine on file and therefore is not immunized according to recommendations of the ACIP

Correction Required: A health report shall include a review of the child's immunized status according to recommendations of the ACIP. The facility shall implement dismissal policies in accordance with the Department of Health regulation in 28 Pa. Code § 27.77 (relating to immunization requirements for children in child care group settings). Child #4 must be dismissed from care by close of business on 9/22/23 and may only return to care when the immunization record is updated or when a parent provides a written, signed exemption letter.

Description: Pick up and drop off points

Noncompliance Area: During the inspection, the operator did not have annual documentation that the local traffic safety authorities are notified in writing of the location of the facility and about the program's use of pedestrian and vehicular routes around the group child care facility.

Correction Required: The operator shall notify local traffic safety authorities in writing of the location of the facility and about the program's use of pedestrian and vehicular routes around the group child care facility.

Description: Emergency plan/Emergency plan

Noncompliance Area: During the inspection, the operator who has since enrolled toddlers into the program, did not have a section in the emergency plan to include accommodations for toddlers during an emergency.

Correction Required: The facility shall have an emergency plan that provides for accommodations for infants, toddlers, children with disabilities and children with chronic medical conditions. The operator shall send a copy of the emergency plan and subsequent plan updates to the local municipality and to the county emergency management agency.

Description: Toxic plants not permitted

Noncompliance Area: During the inspection, the operator had a Monstera and numerous Pothos plants in the facility. Both types of these plants are toxic to children.

Correction Required: Toxic plants are not permitted in a child care space.

Regulation: 3280.161(c)

Description: Potentially hazardous food refrigerated

Noncompliance Area: During the renewal inspection, the children's perishable food brought from home was stored in lunchboxes in the classroom and not refrigerated as required.

Correction Required: Potentially hazardous food brought from the child's home or provided by the facility shall be refrigerated.

Noncompliance Area: During an initial inspection, the operator did not have requirements for volunteer emergency preparedness training, practice drills and continuity of operations included in their emergency plan.

Correction Required: A facility shall be operated in conformity with applicable Federal and State laws and regulations. State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children. To maintain full compliance with 45 CFR § 98.41(a)(1)(vii), child care facilities must have requirements for volunteer emergency preparedness training, practice drills and continuity of operations included in their emergency plan.

Noncompliance Area: During the initial inspection on 8/3/33, the operator did not have a policy and procedure on file to identify the prevention of shaken baby syndrome, abusive head trauma, and child maltreatment.

Correction Required: A facility shall be operated in conformity with applicable Federal and State laws and regulations. State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children. To maintain compliance with 45 CFR 98.41(a)(1)(vi), in addition to the training requirements, child care providers must have a policy and procedure to identify the prevention of shaken baby syndrome, abusive head trauma, and child maltreatment.

Regulation: 3280.151(a)/3280.151(c)(2)

Description: 12 months prior to service and every 24 months thereafter/Mantoux TB

Noncompliance Area: During an initial inspection on 8/3/22, staff #1 did not have a health assessment and TB test conducted within the past 12 months on file. Staff #2 did not have a health assessment conducted within the past 12 months on file.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem. An adult health assessment must include tuberculosis screening by the Mantoux method at initial employment. Subsequent tuberculosis screening is not required unless directed by a physician, physician's assistant, CRNP, the Department of Health or a local health department.

Regulation: 3280.76

Description: Building Surfaces

Noncompliance Area: During the initial inspection, the ceiling tile above the door was popped out and not placed in the bracket, posing a hazard. The vents throughout the facility were dusty. The handrail on the steps leading to the playground had exposed rusted areas.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.
