Noncompliance Area: At the time of inspection, the loose fill (rubber chips) used as a protective surface measured a depth below the recommendations of the USCPSC (6 in of loose fill). The loose fill depth was measured at .75 inches to 2.75 inches.

Correction Required: Outdoor equipment that requires embedded mounting must be mounted over a loose-fill or unitary playground protective surface covering that meets the recommendations of the United States Consumer Product Safety Commission. The equipment must be anchored firmly and be in good repair.

The evacuation routes and evacuation plans to exit the building may be the same as those required by §3270.94 (relating to fire drills).

Staff persons and volunteers shall receive training in maintenance of smoke detectors, the duties of facility persons during a fire drill and during a fire and the use of the facility's fire extinguishers, not including discharge of the fire suppressant agent.

Correction Required: A volunteer shall be 16 years of age or older and shall be directly supervised at all times by a staff person. The identified person must be removed as a volunteer until they are 16 years of age. Ensure that all volunteers will be at least 16 years of age or older.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). LACKING REQUIRED HIRING DOCUMENTS: A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Revise and submit written policies and procedures regarding the CPSL hiring requirements to ensure that all staff/facility persons (new and existing) have the required CPSL clearance documents within the required timeframes in accordance with the CPSL.

Description: Similar Age Level/Supervised at all times

Noncompliance Area: On 7/24/25, at approximately 12:30pm, a child was observed being supervised by a volunteer (facility person #1) and not a staff person in the infant room. The child was also observed alone and unattended with no staff supervision when the volunteer left the classroom.

Correction Required: When children are grouped in similar age levels, the following maximum child group sizes and ratios of staff persons apply: Infants 1:4 with a maximum group size of 8; Young toddlers 1:5 with a maximum group size of 10; Older toddlers 1:6 with a maximum group size of 12; Preschool children 1:10 with a maximum group size of 20; Young school-age children 1:12 with a maximum group size of 24; Older school-age children 1:15 with a maximum group size of 30. The required staff:child ratios must be maintained at all times. Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. Children must be supervised at all times. TIERED LIS: 1. Ensure that children are supervised by a staff person at all times and that staff/child ratios are maintained at all times by 7/24/25. 2. Develop and submit a written staffing and supervision plan including provisions for staff shortages including but not limited to call outs, scheduling, terminations, staff lunch, resignations and operational tasks that impact staffing and times of transition to ensure ongoing compliance with staff/child ratios and supervision of children. Submit a copy of the written staffing and supervision plan by 8/24/25.

Correction Required: A facility person's record shall include a written report of initial and subsequent health assessments, including the results of initial and subsequent tuberculin skin tests, x-rays or other medical documentation necessary to confirm freedom from communicable tuberculosis.

Correction Required: Trash shall be removed from the facility grounds at least once per week.
