Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem. A facility person's record shall include a written report of initial and subsequent health assessments, including the results of initial and subsequent tuberculin skin tests, x-rays or other medical documentation necessary to confirm freedom from communicable tuberculosis.

The file of Staff #6 contained consecutive child abuse clearances (10/23/2020 and 1/2/2026), FBI clearances (10/24/2020 and 1/27/2026) and NSOR verification certificates (10/23/2020 and 1/27/2026) all updated more than 60 months apart. The PA criminal history clearances provided for Staff #6 were dated 10/22/2020 and 1/2/2026 (request date), also more than 60 months apart and the clearance dated 1/2/2026 does not have a dissemination date making it not valid.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person #6 may not work in a child care position at the facility.

Noncompliance Area: In the infant area of the main classroom, a cabinet knob below the sink was broken leaving a jagged metal piece protruding from the cabinet at a child's level posing a scratch and puncture hazard.

Noncompliance Area: In the main child care space, foam blocks, which staff stated are used by toddlers, contained teeth marks.

Correction Required: Toys and objects with a diameter of less than 1 inch, objects with removable parts that have a diameter of less than 1 inch, plastic bags and styrofoam objects may not be accessible to children who are still placing objects in their mouths.

Description: 2 feet apart

Noncompliance Area: In the infant area in the main child care space, 2 infants were sleeping in pack and plays which did not contain 2 feet of open space on 3 sides. One pack and play was in a corner against a wall and a portable shelf. Another pack and play in the same area was against a wall and an infant exerciser which approximately 6 - 12 inches from side. A 3rd pack and play where a child was sleeping was located in the toddler/preschool area and was directly between Rubbermaid drawers and a play kitchen.

Correction Required: At least 2 feet of space is required on three sides of a bed, cot, crib or other rest equipment while the equipment is in use.

The facility shall implement dismissal policies in accordance with the Department of Health regulation in 28 Pa. Code § 27.77 (relating to immunization requirements for children in child care group settings).

Correction Required: The operator shall assure that each facility person receives training regarding the emergency plan at the time of initial employment, on an annual basis and at the time of each plan update. The operator shall document the date of each training and the names of all facility persons who received the training and kept on file at the facility.

Correction Required: Competence is the completion of training by a professional in the field of first-aid and cardiopulmonary resuscitation (CPR). All staff persons shall renew their certification in pediatric first aid and pediatric cardiopulmonary resuscitation (CPR) on or before the expiration of the most current certification.

Correction Required: Staff persons shall participate, at least annually, in firesafety training conducted by a fire protection professional. Staff persons and volunteers shall receive training in maintenance of smoke detectors, the duties of facility persons during a fire drill and during a fire and the use of the facility's fire extinguishers, not including discharge of the fire suppressant agent. A facility person's record shall include verification of child care experience, education and training following the outset of service at the facility.

The file of staff #3 contained PA state police clearances (8/7/2019 and 2/15/2025), child abuse clearances (8/8/2019 and 2/25/2025) and FBI clearances (8/6/2019 and 2/21/2025) which were updated more than 60 months from the prior.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). LACKING REQUIRED HIRING DOCUMENTS: Facility Person #2 may not work in a child care position at the facility. A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL.

Noncompliance Area: Upon entering the facility at approximately 10:10 am, 14 children between the ages of 1 year and 4 years were in the main classroom. Staff #1, staff #2 and staff #9 identified all 14 children in the group. Maximum group size with a young toddler is 10 children to 2 staff.

Correction Required: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements in § 3270.51 (relating to similar age level).

Noncompliance Area: In the infant room, an infant was observed asleep in a bouncy seat, not in the position recommended by the AAP.

Correction Required: Infants shall be placed in the sleeping position recommended by the American Academy of Pediatrics unless there is a medical reason an infant should not sleep in this position. The medical reason shall be documented in a statement signed by a physician, physician's assistant or CRNP and placed in the child's record at the facility.

Noncompliance Area: There was no thermometer in the refrigerator in the infant room.

Correction Required: A facility shall have an operable, clean refrigerator used to store potentially hazardous foods. The refrigerator shall be capable of maintaining food at 45° F or below. An operating thermometer shall be placed in the refrigerator.

Description: Supervised at all times

Noncompliance Area: At approximately 11:45 AM, Facility Person #4 was observed changing a child's diaper as she was caring for a total of to children - a young toddler and 3 infants- in the infant room. For the extent of the diaper change, she was positioned with her back to the other three children in her care. One of the children was resting in a packnplay positioned, due to the L-shape of the room, out of the line of sight from the changing table.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises.

Conditions at the facility may not pose a threat to the health or safety of the children. Until such time as the required pre-service trainings are completed, facility person #3 must be supervised, when interacting with children, by an AGS who has completed the required training related to this citation. Noncompliance Area: The were two metal pipes in the outdoor playspace - one coming up from the ground, and another extending from a wall on the side of the building, that would present a hazard to children engaging in gross motor play in the space.

Correction Required: If unsafe areas or conditions are in or near an outdoor play space, fencing or natural barriers are required to restrict children from those unsafe areas or conditions. Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.
