Noncompliance Area: During the initial review on 5/28/26, staff person #2 had a health assessment with multiple unclear edits deeming the need for an updated health assessment form.

Correction Required: A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem. A facility person's record shall include a written report of initial and subsequent health assessments, including the results of initial and subsequent tuberculin skin tests, x-rays or other medical documentation necessary to confirm freedom from communicable tuberculosis.

Description: Mantoux TB/Health assessment, TB test

Noncompliance Area: During the initial review on 5/28/26, staff person #1 did not have TB testing on file.

Correction Required: An adult health assessment shall include Tuberculosis screening by the Mantoux method at initial employment. Subsequent tuberculosis screening is not required unless directed by a physician, CRNP, the Department of Health or a local health department. A facility person's record shall include a written report of initial and subsequent health assessments, including the results of initial and subsequent tuberculin skin tests, x-rays or other medical documentation necessary to confirm freedom from communicable tuberculosis.

Description: Emergency plan

Noncompliance Area: During the initial review on 5/28/26, the operator did not have proof showing that the emergency plan was sent to the local municipality and county emergency management agency.

Correction Required: The operator shall send a copy of the emergency plan and subsequent plan updates to the local municipality and to the county emergency management agency.

Description: Comply with CPSL

Noncompliance Area: During the initial review on 5/25/26, staff person #1 did not have Mandated Reporter Training completed.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). PROVISIONAL HIRE UNSUPERVISED: A provisional employee may not be permitted to work alone with children and must work within the vicinity of a permanent employee.

Description: Comply with CPSL/CPSL information

Noncompliance Area: During the initial review on 5/28/26, staff person #1 did not have an NSOR (National Sex Offender Registry) completed within the last 5 years. The NSOR on file was dated 2/1/21.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). PROVISIONAL HIRE UNSUPERVISED: A provisional employee may not be permitted to work alone with children and must work within the vicinity of a permanent employee. A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person #1 may not work in a childcare position at the facility.

Regulation: 3290.61

Description: Unsafe Areas in Outdoor Space

Noncompliance Area: During the initial review on 5/28/26, the outdoor space the operator identified for childcare had: 1. A partially drained pool that was in poor repair in the center of the space. 2. A trampoline that was in poor repair. 3. Two unwound water hoses that were accessible to the children and posed as a hazard. 4. Multiple garbage cans that were accessible to the children. 5. Fencing and construction materials near the trampoline. 6. An electrical line running from the house to the pool was exposed and accessible to the children. 7. Pool ladder was in the childcare space.

Correction Required: If unsafe areas or conditions are in or near an outdoor play space, fencing or natural barriers are required to restrict children from those unsafe areas or conditions.

Regulation: 3290.63

Description: Protective Outlet Covers 5 yrs. or less

Noncompliance Area: During the initial review on 5/28/26, there was an unused outlet in the kitchen on the wall near the glass door area that did not have a protective receptacle cover.

Correction Required: Protective receptacle covers shall be placed in electrical outlets accessible to children 5 years of age or younger.

Regulation: 3290.64(a)

Description: Locked or inaccessible - in original container

Noncompliance Area: During the initial review on 5/28/26, there was alcoholic beverages accessible to the children in the kitchen area.

Correction Required: Cleaning materials and other toxic materials shall be stored in an original labeled container or in a container that specifies the content. Toxics shall be kept in a locked area or in an area inaccessible to children, and shall be stored away from food, food preparation areas and child care spaces.

Regulation: 3290.65(d)

Description: Contaminated trash in closed plastic-lined receptacle

Noncompliance Area: During the initial review on 5/28/26, the trash can in the bathroom was not lidded.

Correction Required: Trash that has been contaminated by human secretions or excrement shall be contained in closed, plastic-lined receptacles.

Regulation: 3290.95(a)

Description: System in compliance

Noncompliance Area: During the initial review on 5/28/26, the operator did not have an interconnected fire detection system with proof of purchase.

Correction Required: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. § 1016(c)).
