2024-07-10 Complaints- Legal Location 3270.111(c) - Promote development Compliant - Finalized

Regulation: 3270.111(c)

Description: Promote development

Noncompliance Area: During a complaint investigation staff admitted that a child was put in time out for roughly two hours due to an incident with another peer. This caused the child to not be able to partake in developmental activities, and did not aid the social competence and self-esteem of the child.

Correction Required: Daily activities shall promote the development of skills, social competence and self-esteem. Daily experiences shall recognize the child as an individual and give some choice of activities that respect personal privacy, lifestyle and cultural background.

Provider Response: (Contact the State Licensing Office for more information.)
The staff member who assigned the time out was new to our team and was going against the training she received as well as the policies and procedures she agreed to upon hire. Still, her actions have real consequences for our children and affect the agency. She has been retrained and warned about the consequences of any further infractions. Site leadership met individually with each staff member to reiterate that we do not give time outs and to explain what an acceptable break from a preferred activity looks like. Staff were instructed on how to assign a safe teacher-directed activity (such as read, color, draw) to address potential behavioral concerns. In addition to these one-on-one meetings, all staff completed a Better Kid Care training called ¿Moving Beyond Time Out ¿ Responsive Caregiving¿ to reinforce these messages.
2024-07-10 Complaints- Legal Location 3270.162(c) - Not withheld as discipline Compliant - Finalized

Regulation: 3270.162(c)

Description: Not withheld as discipline

Noncompliance Area: It was admitted by the director that while a child was in time out, a snack was given to other children. The child in timeout was not offered the snack.

Correction Required: Food may not be withheld from a child for purposes of discipline.

Provider Response: (Contact the State Licensing Office for more information.)
This citation was a result of our misunderstanding of the regulation. All children onsite are given breakfast, lunch, and a snack each day they are present without exception. Breakfast, lunch, and snack components are never withheld from any child for any reason. In this instance, ice pops were being given out as an incentive for good behavior, which we now understand is against the regulation since some children would, by definition, not receive the incentive. All staff will be briefed on this misunderstanding by 8/26 and will have a clear understanding that if any food item is being distributed to children, it must be distributed to all children onsite.
