Noncompliance Area: The original agreements were observed in the files for Children #1, #2 and #4.

Correction Required: A parent shall receive the original agreement. The facility shall retain a copy of the agreement.

Noncompliance Area: The file for Child #4, a young toddler, lacked an updated health report that had been completed within the last 6 months. The file only contained an updated immunization record.

Correction Required: The operator shall require the parent to provide an updated health report at least every 6 months for an infant or young toddler

Noncompliance Area: The health reports on file for Children #4 and #5 lacked verification that the children had received annual flu vaccinations as recommended by the ACIP. Written exemptions were not on file for the children.

Correction Required: The facility shall require the parent to provide updated written verification from a physician, physician's assistant, CRNP, the Department of Health or a local health department of ongoing vaccines administered to an infant, toddler or preschool child in accordance with the schedule recommended by the ACIP.

Noncompliance Area: Liquid soap was not present at the water source in the changing are in the Infant area of the classroom to allow for appropriate handwashing following diapering.

Correction Required: Liquid or powdered soap shall be used for handwashing.

Noncompliance Area: The current health assessment on file for Staff Person #1 lacked a statement that the physician had completed a physical examination.

Correction Required: An adult health assessment must include a physical examination.

Noncompliance Area: The updates to the emergency contact form for Child #3 have exceeded 6 months since last review and update at this time.

Correction Required: A parent is required to review and update the emergency contact information and the financial agreement at least once in a 6-month period or as soon as there is a change in the information.

Noncompliance Area: The emergency telephone numbers were missing from the cordless phone in the classroom.

Correction Required: The telephone number of the nearest hospital, police department, fire department, ambulance and poison control center shall be posted by each telephone in the facility.

Noncompliance Area: Child #1 lacked a current child service report.

Correction Required: The services to be provided to the family and the child, including the Department's approved form to provide information to the family about the child's growth and development in the context of the services being provided. The operator shall complete and update the form and provide a copy to the family in accordance with the updates regarding emergency contact information in 3270.124(f) (relating to emergency contact information).

Noncompliance Area: Child #1 had a most recent health assessment dated 6-8-18.

Correction Required: The operator shall require the parent to provide an updated health report at least every 6 months for an infant or young toddler

Noncompliance Area: There was aspirin in a staff's purse accessible to children on a book rack in the childcare room.

Correction Required: Medication shall be stored in a locked area of the facility or in an area that is out of the reach of children.

Noncompliance Area: There was no written consent from a child's parent for staff to administer a child's ibuprofen observed to be in the kitchen.

Correction Required: A parent shall provide written consent for administration of medication or a special diet.

Noncompliance Area: Staff person #1 lacked a TB test.

Correction Required: An adult health assessment must include tuberculosis screening by the Mantoux method at initial employment. Subsequent tuberculosis screening is not required unless directed by a physician, physician's assistant, CRNP, the Department of Health or a local health department.A facility person's record shall include a written report of initial and subsequent health assessments, including the results of initial and subsequent tuberculin skin tests, x-rays or other medical documentation necessary to confirm freedom from communicable tuberculosis.

Noncompliance Area: There was yogurt, cheese, and a meat sandwich in children's lunchboxes which were being stored on the kitchen table and were not being refrigerated.

Correction Required: Potentially hazardous food brought from the child's home or provided by the facility shall be refrigerated.

Noncompliance Area: Child #1 had an emergency contact form and agreement that had not been updated within a 6 month time period.

Correction Required: A parent is required to review and update the emergency contact information and the financial agreement at least once in a 6-month period or as soon as there is a change in the information.

Noncompliance Area: Staff person #1, classified as an Assistant Group Supervisor, had only 1948 hours of experience documented.

Correction Required: An assistant group supervisor shall have a high school diploma or a general educational development certificate and 2 years experience with children.A facility person's record shall include verification of child care experience, education and training prior to service at the facility.

Noncompliance Area: There was a hand sanitizer bottle attached to a child's back pack accessible to children in the cubby area.

Correction Required: Cleaning materials and other toxic materials shall be kept in an area or container that is locked or made inaccessible to children.

Noncompliance Area: Staff person #1 and staff person #2 lacked health assessments.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.

Correction Required: The label of a medication container shall identify the name of the medication and the name of the child for whom the medication is intended. Medication shall be administered to only the child whose name appears on the container.

Noncompliance Area: There was a tube of diaper cream accessible to children in a child's cubby near the entrance to the facility. There was a tube of diaper cream accessible to children in the diapering area in the infant/toddler area of the main childcare room.

Correction Required: Medication shall be stored in a locked area of the facility or in an area that is out of the reach of children.

Noncompliance Area: Child #1 had an epi-pen at the facility that was expired.

Correction Required: Medication shall be stored in accordance with the manufacturer's or health professional's instructions on the original label.

Noncompliance Area: There was no written consent from Child #1's parent to administer the epi-pen that was at the facility for the child.

Correction Required: A parent shall provide written consent for administration of medication or a special diet.

Noncompliance Area: Staff person #1 lacked proof of qualifications to be a staff person.

Correction Required: A facility person's record shall include verification of child care experience, education and training prior to service at the facility.

Noncompliance Area: Staff person #1, with a documented start date of 11-7-17, lacked an FBI clearance.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). Facility Person # 1 may not work in a child care position at the facility.A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL.

Noncompliance Area: At 9:30am, it was observed that Staff person #2 was alone in the preschool area with 11 preschoolers. At 9:50am, it was observed that another preschool child was dropped off leaving Staff person #2 alone in the preschool area with 12 preschoolers.

Correction Required: When children are grouped in similar age levels, the following maximum child group sizes and ratios of staff persons apply: Infants 1:4 with a maximum group size of 8; Young toddlers 1:5 with a maximum group size of 10; Older toddlers 1:6 with a maximum group size of 12; Preschool children 1:10 with a maximum group size of 20; Young school-age children 1:12 with a maximum group size of 24; Older school-age children 1:15 with a maximum group size of 30.

Noncompliance Area: There was a container of hand sanitizer accessible to children on top of toy shelf in the main childcare room.

Correction Required: Cleaning materials and other toxic materials shall be kept in an area or container that is locked or made inaccessible to children.

Noncompliance Area: There were cracks on the lids of two plastic containers that contained materials and toys for the children in the area outside of the girl's bathroom.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Noncompliance Area: Child #1 lacked a current child service report.

Noncompliance Area: There was no hand washing sign posted by the training chair in the bathroom,

Correction Required: A facility person and an able child shall wash his hands after toileting and before eating. A sign on which this requirement is written shall be posted at each toilet, training chair, diapering area and sink in the facility.

Noncompliance Area: At approximately 1:45pm it was observed that there was a child sleeping on rest equipment positioned behind a solid partition. From where the staff person who was assigned responsibility for the child was positioned, she could not see the child.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises.

Noncompliance Area: At approximately 1:45pm it was observed that Staff person #1 was on the infant/toddler side of the room with 1 infant, 3 young toddlers, and 1 preschooler during nap time. It was also observed that Staff person #2 was on the preschool side of the room with 2 infants, 1 older toddler and 4 preschoolers during nap time.

Correction Required: The staff:child ratio while toddlers and preschoolers are napping is one staff person to 10 young toddlers, one staff person to 12 older toddlers, one staff person to 20 preschool children

Noncompliance Area: At approximately 1:45pm it was observed that Staff person #1 was on the infant/toddler side of the room with 1 infant, 3 young toddlers, and 1 preschooler during nap time. It was also observed that Staff person #2 was on the preschool side of the room with 2 infants, 1 older toddler and 4 preschoolers during nap time. With the number of children present it was required that there be 3 staff persons on the premises. Staff person #2 reported that the third staff person left the premises for a break.

Correction Required: Staff persons who are on duty but are not providing child care during naptime shall remain in the child care portion of the facility premises.
