Noncompliance Area: Child #1 did not have an updated health report. The health report on file was dated 3/21/25.

Correction Required: The operator shall require the parent to provide an updated health report at least every 12 months for an older toddler or preschool child.

Description: Liability Insurance

Noncompliance Area: The facility's general liability insurance was expired with a date of 3/6/26 at the time of the renewal inspection.

Correction Required: The legal entity shall have comprehensive general liability insurance to cover all persons who are on the premises. A current copy of the insurance policy shall be on file at the facility.

Description: Training regarding plan

Noncompliance Area: Staff person #1 and #2 did not have documentation of emergency plan training.

Correction Required: The operator shall assure that each facility person receives training regarding the emergency plan at the time of initial employment, on an annual basis and at the time of each plan update. The operator shall document the date of each training and the names of all facility persons who received the training.

Noncompliance Area: Cert Rep observed a stack of chairs in front of the rear exit in the facility.

Correction Required: Stairways, hallways, exits from rooms, exits from the facility and other means of egress serving as an exit shall be unobstructed.

Description: Clean and good repair

Noncompliance Area: During the renewal inspection, there was a children's chair in the front classroom space that was damaged with rips and peeling material on the cushion and arms of chair.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Noncompliance Area: During the renewal inspection, there was bottle on table in front classroom space and on shelf near the entrance of facility that was not labeled.

Correction Required: Disposable nursers and bottles shall be labeled with the child's name.

Noncompliance Area: During the renewal inspection, there was peeling paint in the bathroom above the changing table.

Description: Health Information

Noncompliance Area: Child #1 and #2 did not have a health assessment on file. The enrollment date for child #1 was 11/14/23. The enrollment date for child #2 was 1/4/24.

Correction Required: The operator shall require the parent of an enrolled child, including a child, a foster child and a relative of an operator or a facility person, to provide an initial health report no later than 60 days following the first day of attendance at the facility.

Description: Emergency plan

Noncompliance Area: The facility did not have documentation of annual emergency drill on file.

Correction Required: Emergency drills shall be conducted annually. Annual emergency drills shall be documented and on file at the facility.

Regulation: 3280.26(f)

Description: Emergency plan

Noncompliance Area: Provider did not have documentation on file verifying that the facility's emergency plan and subsequent plan updates were sent to the local municipality and to the county emergency management agency.

Correction Required: The operator shall send a copy of the emergency plan and subsequent plan updates to the local municipality and to the county emergency management agency.

Description: Locked or inaccessible - in original container

Noncompliance Area: During the renewal inspection, there was a bottle of hand sanitizer accessible to children on a shelf to the right of the main entrance. There was also a bottle of alcohol and hand sanitizer on staff's desk accessible to children.

Correction Required: Cleaning materials and other toxic materials shall be stored in an original labeled container or in a container that specifies the content. Toxics shall be kept in a locked area or in an area inaccessible to children, and shall be stored away from food, food preparation areas and child care spaces.

Description: FIRE DETECTION/Staff responsibility

Noncompliance Area: During the renewal inspection, provider could not verify that the facility's fire detection system was operable. Provider did not have documentation that showed that the fire detection system was tested by a fire safety specialist with in the past year. The fire inspection summary that was shown to Cert Rep was dated 6/5/20.

Correction Required: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. §  1016(c)). The primary staff person or designated staff person who is responsible for compliance with this chapter shall ensure the requirements in subsection (a) are met.

Regulation: 3280.61(h)

Description: Measurement and use of indoor child care space

Noncompliance Area: On 2/15/22, an inspection occurred by the Phila Department of Health at the location in which 16 children were observed being cared for at one time. On 3/3/22, staff member #1 confirmed that there were 16 children in care that day.

Correction Required: The capacity established for an indoor space may not be exceeded.

Noncompliance Area: During the hybrid renewal inspection on 3/22/22, verification of the annual (completed in the year of 2021), 12 clock hours of child care training was not submitted for staff members #1 and #2.

Noncompliance Area: DURING COMPLAINT INVESTIGATION ON 11/29/2021, IT WAS OBSERVED THAT ONE STAFF PERSON WAS OUTSIDE THE FACILITY WHILE THE OTHER STAFF WAS ALONE WITH 9 CHILDREN RANGING IN AGE FROM 11 MONTHS TO 5 YEARS.

Correction Required: When children are grouped in similar age levels, the following maximum child group sizes and ratios of staff persons apply: Infants 1:4 with a maximum group size of 12; Young toddlers 1:5 with a maximum group size of 12; Older toddlers 1:6 with a maximum group size of 12; Preschool children 1:10 with a maximum group size of 12; Young school-age children 1:12 with a maximum group size of 12; Older school-age children 1:15 with a maximum group size of 15.

Noncompliance Area: DURING COMPLAINT INVESTIGATION ON 11/29/2021, IT WAS NOTED THAT THE FACILITY DID NOT HAVE DOCUMENTATION OF ANY FIRE DRILLS FOR THIS YEAR.

Correction Required: The primary staff person or designated staff person who is responsible for compliance with this chapter shall conduct fire drills and ensure that fire drills are conducted at least once every 60 days.

Noncompliance Area: During the hybrid renewal inspection conducted on 10/1/20, the information received and reviewed from the file of staff member #2, did not include a current health assessment. The health assessment reviewed showed a date of last exam on 4/12/18.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.A facility person's record shall include a written report of initial and subsequent health assessments, including the results of initial and subsequent tuberculin skin tests, x-rays or other medical documentation necessary to confirm freedom from communicable tuberculosis.

Noncompliance Area: During the hybrid renewal inspection conducted on 10/1/20, the facility did not provide a current copy of the general liability insurance. The insurance document provided expired on 4/24/20.

Correction Required: The legal entity shall have comprehensive general liability insurance to cover the persons who are on the premises. A current copy of the insurance policy shall be on file at the facility.

Noncompliance Area: During the hybrid renewal inspection conducted on 10/1/20, the information received and reviewed from the file of staff member #1 did not include an updated and current copy of the Mandated and Permissive Reporting in Pennsylvania training. The training provided from the file of staff member #1 for review of the Mandated and Permissive Reporting in Pennsylvania was last completed on 7/16/15.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL.

Noncompliance Area: During the hybrid renewal inspection conducted on 10/1/20, based on the staff information provided for review, the facility did not provide documentation of staff having current first-aid qualifications. Adult/Pediatric First-Aid CPR training reviewed dated for 2/15/18 and valid for 2 years only.

Correction Required: One or more facility persons competent in first-aid techniques shall be at the facility when one or more children are in care.

Noncompliance Area: During the hybrid renewal inspection conducted on 10/1/20, the hot water temperature measured at the sink of the bathroom used for children measured 115.3 F.

Correction Required: Hot water temperature, in areas accessible to children, may not exceed 110 F.

Noncompliance Area: During the hybrid renewal inspection conducted on 10/1/20, a water damaged ceiling tile was observed located in-between the indoor play space/kitchen area.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Noncompliance Area: One cracked lid with a potential pinch point was observed in the front classroom.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Noncompliance Area: A Bumbo seat that was recalled due to the need for a safety strap was observed. The required safety strap was not in place.

Correction Required: Children's toys and equipment, including furniture and rest equipment, described as hazardous by the United States Consumer Product Safety Commission may not be used by children at the facility and may not be on the premises at the facility. At the time of inspection, the operator shall submit to the Department written affirmation on a form provided by the Department stating that the facility is in compliance with this requirement.

Noncompliance Area: The files for the two children enrolled included the original agreements.

Correction Required: A parent shall receive the original agreement. The facility shall retain a copy of the agreement.

Noncompliance Area: A hands free covered can was not in place at the chaning table in the orange restroom.

Correction Required: If disposable diapers are provided by a parent or by a facility, a soiled diaper shall be discarded by immediately placing the diaper into a plastic-lined, hands-free covered can.

Noncompliance Area: A written feeding schedule for an enrolled infant was not on file at the time of the inspection.

Correction Required: A written statement giving the formula and feeding schedule for an infant shall be obtained from the parent.

Noncompliance Area: The emergency contact form on file for child #1 did not include signed parental consent for administration of minor first-aid procedures by facility staff.

Correction Required: A child's record must contain signed parental consent for administration of minor first-aid procedures by facility staff. Written consent is required prior to admission.

Noncompliance Area: A tube of desitin diaper cream was observed in a cubby in the front child care space.

Correction Required: Cleaning materials and other toxic materials shall be stored in an original labeled container or in a container that specifies the content. Toxics shall be kept in a locked area or in an area inaccessible to children, and shall be stored away from food, food preparation areas and child care spaces.

Noncompliance Area: The hot water in the restrooms was measured at 114.5 F.

Correction Required: Hot water temperature, in areas accessible to children, may not exceed 110 F.

Noncompliance Area: Small areas of peeling paint were observed on the blue wall in the front child care space. Damaged plaster was observed on the bottom right corner at the gate from the gross motor to the back child care space.

Correction Required: Peeled or damaged paint or damaged plaster is not permitted on indoor or outdoor surfaces in the child care facility.

Noncompliance Area: The last documented fire drill was April 2018.

Correction Required: A fire drill shall be held at least every 60 days. Staff persons, volunteers and children in attendance shall participate in the fire drill and shall exit the facility, weather permitting.

Correction Required: Competence in first-aid is demonstrated by the completion of training by a professional in the field of first-aid. First-aid training shall be renewed on or before expiration of certification or every 3 years, as applicable.

Noncompliance Area: During the renewal inspection there was no fire drill log posted showing fire drills are being held at least every 60 days on file.

Correction Required: A fire drill shall be held at least every 60 days. Facility persons and children in attendance shall participate in the fire drill. Facility persons and children shall exit the building, weather permitting.

Noncompliance Area: During the renewal inspection there are many areas of the emergency contact and the fee agreement that are incomplete and need to be corrected for child #1-3.

Correction Required: An agreement shall be signed by the operator and the parent.Emergency contact information is required for each enrolled child. Emergency contact information must reference who shall be contacted in an emergency.

Staff persons and volunteers shall receive training in maintenance of smoke detectors, the duties of facility persons during a fire drill and during a fire and the use of the facility`s fire extinguishers, not including discharge of the fire suppressant agent.

Noncompliance Area: During the renewal inspection there were many electrical outlets without protective receptacle covers throughout the child care facility.

Correction Required: Protective receptacle covers shall be placed in electrical outlets accessible to children 5 years of age or younger.

Noncompliance Area: During the renewal inspection there was no first aid kit in the indoor child care space.

Correction Required: A first-aid kit shall be in a child care space.

Noncompliance Area: During the renewal inspection the bathroom and sink in the kitchen area did not have the required hand washing sign.

Correction Required: A facility person and an able child shall wash his hands after toileting and before eating. A sign on which this requirement is written shall be posted at each toilet, training chair, diapering area and sink in the facility.
