Noncompliance Area: It was observed that the file for staff person #1 did not contain two written non-family references.

Correction Required: A facility person's record shall include two written, nonfamily references from individuals attesting to the person's suitability to serve as a facility person.

Noncompliance Area: It was observed that the file for staff person #2 had a state police clearance for a volunteer and not one for a childcare facility person. It was observed that the file for facility person #3 had an NSOR dated 5/6/20 and it was renewed on 10/20/25 causing a 167-day lapse.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person #2 may not work in a childcare position at the facility.

Noncompliance Area: It was observed that the facility did not have an indoor or outdoor play space to be used for large muscle activity.

Correction Required: A facility shall provide outdoor or indoor play space to be used for large muscle activity which includes running, jumping, climbing and riding.

Description: Updated every 6 months/Emergency info/agreement updated 6 mos

Noncompliance Area: Upon inspection of children's files, it was found that for Child #1, the agreement form had been last reviewed/signed on 12.20.23. It was found that for Child #5, the agreement and emergency contact forms had both been last reviewed/signed on 4.11.25 and 9.1.24 which was beyond 6 months..

Correction Required: The parent shall update in writing emergency contact information once in a 6-month period or as soon as there is a change in the information. A parent is required to review and update the emergency contact information and the financial agreement at least once in a 6-month period or as soon as there is a change in the information.

Description: Unsafe Areas in Outdoor Space

Noncompliance Area: Upon inspection of personnel files, it was found that there were two missing pieces of fencing were in the outdoor play space. There were also missing barrier from pieces of wooden slats and building materials to the left of the play space.

Correction Required: If unsafe areas or conditions are in or near an outdoor play space, fencing or natural barriers are required to restrict children from those unsafe areas or conditions.

Noncompliance Area: Staff person #1 was observed to be caring for children unsupervised. Staff person #1 does not have current pediatric first-aid/CPR training. This is evidenced by the previously documented pediatric first-aid/CPR training expiration date of 10/2024. Staff person #2 was observed to be caring for children unsupervised. Staff person #2 does not have current pediatric first-aid/CPR training. This is evidenced by the previously documented pediatric first-aid/CPR training expiration date of 10/2024.

Correction Required: A facility shall be operated in conformity with applicable Federal and State laws and regulations. State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children. Until such time as the required trainings are completed, staff persons #1 and staff person #2 - must be supervised, when interacting with children, by a (AGS, primary staff person) who has completed the required training related to this citation. If there are no staff person(s) available to supervise staff person #1 and staff person #2, staff person #1 and staff person #2 -- may not work in a childcare position at the facility.

Noncompliance Area: The file for staff person #3 did not have a current pediatric first aid and CPR training certificate. This is evidenced by the previously documented pediatric first aid and CPR training had an expiration date of 10/2024.

Correction Required: Competence is the completion of training by a professional in the field of first-aid and CPR. All staff persons shall renew their certification in pediatric first-aid and pediatric cardiopulmonary resuscitation (CPR) on or before the expiration of the most current certification.

Noncompliance Area: The file for staff person # 1 contained a DHS -- FBI clearance dated 4.25.19. The file did not contain an update. The FBI clearance is no longer valid. The file for staff person #2 contained a child abuse clearance dated 4.13.19 and state police clearance dated 4.12.19 and FBI clearance dated 4.17.19. The file did not contain updates. The child abuse, state police, and FBI clearances are no longer valid.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). Facility Person # 1 and Facility #2 may not work in a childcare position at the facility until updated clearances are obtained.

Noncompliance Area: It was observed that fire drills were not conducted at least once every 60 days. The documented fire drills at the facility occurred on 6.27.23, 8.25.23, 10.24.23, 12.27.23 (64 DAYS), 2.26.24 (61 days), 4.25.24. It was observed that smoke detection testing days were not conducted at least once every 30 days. The documented testing dates at the facility occurred on 6.23.23, 7.25.23(32days), 8.28.23 (34 days), 9.22.23, 10.24.23 (32days), 11.27.23 (34 days),12.28.23 (31 DAYS), 1.27.24, 2.28.24 (32 Days), 3.25.24, and 4.22.24.

Correction Required: The primary staff person or designated staff person who is responsible for compliance with this chapter shall conduct fire drills and ensure that fire drills are conducted at least once every 60 days. The primary staff person or designated staff person who is responsible for compliance with this chapter shall ensure the requirements in subsection (a) are met.

Noncompliance Area: It was observed that a young toddler was sleeping in a rocker type bouncer (inappropriate rest equipment) during nap time. (CORRECTED ON SITE)

Correction Required: Individual, clean, age-appropriate rest equipment shall be provided for preschool, toddler and infant children as agreed between the child's parent and the operator.
