Noncompliance Area: The first aid kit in the Infant, Toddler, Preschool, and School-Age rooms was observed to lack scissors, tweezers, soap, and tape.

Correction Required: A first-aid kit must contain the following: soap, an assortment of adhesive bandages, sterile gauze pads, tweezers, tape, scissors and disposable, nonporous gloves.

Noncompliance Area: A handwashing sign was not posted near the diapering area in the Infant room.

Correction Required: A facility person and an able child shall wash his hands after toileting and before eating. A sign on which this requirement is written shall be posted at each toilet, training chair, diapering area and sink in the facility.

Correction Required: The operator shall require the parent of an enrolled child, including a child, a foster child and a relative of an operator or a facility person, to provide an initial health report no later than 60 days following the first day of attendance at the facility.

Noncompliance Area: The file for Child #1, an infant, contained health assessments dated 03/13/2019 and 12/12/2019; more than six months passed between health assessments.

Noncompliance Area: The health report on file for children #1 and #2 were observed not to include a statement stating that the child is able to participate in child care and appears to be free from contagious or communicable disease.

Noncompliance Area: The immunization record on file for children #1, #4 and #5 were observed not to be up to date with the recommendations of the ACIP this is evidenced by the following; the immunization record on file for child #1 was observed not to contain documentation of child #1 receiving an influenza vaccine within the last 12 months nor was there documentation on file of child #1 receiving a second dose of the Hepatitis A vaccination by age 2 as recommended by the ACIP, the immunization record on file for child #4 was observed not to contain documentation of child #4 being vaccinated with the influenza vaccine within the last 12 months nor was there documentation of child #4 receiving a second dose of the Hepatitis A vaccination by the age of 2 as recommended by the ACIP, also the immunization record on file for child #5 was observed not to contain documentation of child #5 receiving the influenza vaccine within the last 12 months as recommended by the ACIP.

Correction Required: The facility shall require the parent to provide updated written verification from a physician, physician's assistant, CRNP, the Department of Health or a local health department of ongoing vaccines administered to an infant, toddler or preschool child in accordance with the schedule recommended by the ACIP.

Noncompliance Area: In the play room downstairs a toy bin containing foam puzzle pieces was observed to be cracked along the edges creating rough edges, sharp corners and pinch an crush points.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Noncompliance Area: It was observed that the infant cribs located in the infant room were not labeled for the children whom they are intended for.

Correction Required: Individual, clean, age-appropriate rest equipment shall be provided for preschool, toddler and infant children as agreed between the child's parent and the operator. The rest equipment shall be labeled for the use of a specific child and used only by the specified child.

Noncompliance Area: It was disclosed by facility staff that there is not a written statement on file at the child care facility giving the formula a feeding schedule for each infant aged child in care.

Correction Required: A written statement giving the formula and feeding schedule for an infant shall be obtained from the parent.

Noncompliance Area: The left wall at the entrance of the reading nook in the preschool room was observed to have damaged plaster and peeling paint.

Correction Required: Peeled or damaged paint or damaged plaster is not permitted on indoor or outdoor surfaces in the child care facility.

Noncompliance Area: **At approximately 9:00am it was observed that there was one staff person in the downstairs room to the right of the staircase with 4 preschool children. The staff person was in the rear of the room. It was also observed that there was one preschoolers in the bathroom off of the downstairs room to the left of the staircase who was not being supervised by a staff person. The staff person present in the downstairs room to the right of the staircase could not see, hear, direct or assess the child who was in the bathroom off the downstairs room to the left of the staircase.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. Children must be supervised at all times. The legal entity must arrange for all facility staff to receive a minimum of two hours of training regarding supervision of children. The legal entity must receive DHS approval of the training content prior to scheduling the training.

Noncompliance Area: At approximately 10:20am it was observed that Staff person #1 was alone in the nursery room with 4 young toddlers and 1 infant. Staff person #2 admitted that at that same time, she was alone in the downstairs room with 2 older toddlers and 7 preschoolers.

Correction Required: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements in 3270.51 (relating to similar age level).

Noncompliance Area: There were 5 wooden child sized chairs in the main room on the first floor that had loose screws causing them to wobble and be unstable. There were large fluffy floor pillows in the infant room that posed a suffocation hazard to the infants and the toddlers and were not appropriate for their age level.

Correction Required: Furniture must be durable, safe, easily cleaned and appropriate for the child's size, age and special needs.

Noncompliance Area: Child #1 had a most recent health assessment dated 2-10-17.

Correction Required: The operator shall require the parent to provide an updated health report at least every 12 months for an older toddler or preschool child.

Noncompliance Area: There were multiple toothbrushes being stored laying bristles down in the cabinet above the sink in the downstairs bathroom. The toothbrushes were not being stored with the bristles up and exposed to circulating air.

Correction Required: Toothbrushes shall be stored with the bristles up and exposed to circulating air.

Noncompliance Area: Staff person #1 had a health assessment that did not include an examination for communicable diseases and the results of the exam.

Correction Required: An adult health assessment must include an examination for communicable diseases and the results of that examination.

Noncompliance Area: Staff person #1 had a health assessment that did not include the medical provider's assessment of the person's suitability to provide childcare.

Correction Required: An adult health assessment must include the physician's or CRNP's assessment of the person's suitability to provide child care.

Noncompliance Area: Staff person #2, functioning as an Assistant Group Supervisor, lacked proof of childcare experience.

Correction Required: An assistant group supervisor shall have a high school diploma or a general educational development certificate and 2 years experience with children.A facility person's record shall include verification of child care experience, education and training prior to service at the facility.

Noncompliance Area: At 10:30am it was observed that a young toddler arrived at the facility and was placed in the main room upstairs making the total number of children in that room 8. The measured capacity of the room is 7. By 10:38am, all 8 children were still present in the room.

Correction Required: The capacity established for an indoor space may not be exceeded.

Noncompliance Area: There were two damaged panels to the wooden fence that surrounds the outdoor play area. One of the panels was in several pieces on the ground causing splintered wood and exposed nails to be accessible to the children. The other panel was detached on one end of the frame of the fence causing it to be unstable. The damaged and missing panels of the fence caused a large gap in the fence to be accessible to the children thereby allowing them access to the adjoining street.

Correction Required: If unsafe areas or conditions are in or near an outdoor play space, fencing or natural barriers are required to restrict children from those unsafe areas or conditions.Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Noncompliance Area: The hot water temperature in the bathroom upstairs measured 115.5 degrees F. The hot water temperature in the bathroom downstairs measured 120.7 degrees F.

Correction Required: Hot water temperature, in areas accessible to children, may not exceed 110 F.

Noncompliance Area: The required emergency numbers were not posted by the telephone in the carpeted room downstairs.

Correction Required: The telephone number of the nearest hospital, police department, fire department, ambulance and poison control center shall be posted by each telephone in the facility.

Noncompliance Area: The door knob on one of the cupboard doors underneath the counter top in the carpeted room downstairs was bent to the side causing a crack in the wooden cabinet and allowing a sharp edge and splintered wood to be exposed to the children.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Noncompliance Area: There was peeling paint on the ramp leading to the porch on the outside playground.

Correction Required: Peeled or damaged paint or damaged plaster is not permitted on indoor or outdoor surfaces in the child care facility.

Noncompliance Area: Upon assessment of ratio and supervision in the downstairs right Pre-School Room at 2:05 PM on 6/8/17, 3 PS children were observed to be napping alone and unsupervised.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises.

Noncompliance Area: Upon assessment of ratio and supervision in the downstairs right Pre-School Room at 2:05 PM on 6/8/17, 3 PS children were observed to be napping alone and unsupervised.

Correction Required: When children are grouped in similar age levels, the following maximum child group sizes and ratios of staff persons apply: Infants 1:4 with a maximum group size of 8; Young toddlers 1:5 with a maximum group size of 10; Older toddlers 1:6 with a maximum group size of 12; Preschool children 1:10 with a maximum group size of 20; Young school-age children 1:12 with a maximum group size of 24; Older school-age children 1:15 with a maximum group size of 30.

Noncompliance Area: Upon assessment of supervision and ratio in the nursery room at 1:45 PM on 5/22/17, an infant was observed sleeping on the bare floor, with his head propped on a pillow.

Correction Required: Individual, clean, age-appropriate rest equipment shall be provided for preschool, toddler and infant children as agreed between the child`s parent and the operator. The rest equipment shall be labeled for the use of a specific child and used only by the specified child.Infants shall be placed in the sleeping position recommended by the American Academy of Pediatrics unless there is a medical reason an infant should not sleep in this position. The medical reason shall be documented in a statement signed by a physician, physician's assistant or CRNP and placed in the child's record at the facility.

Noncompliance Area: The file for Staff Person #1 lacked documentation of current emergency plan training.

Correction Required: The operator shall assure that each facility person receives training regarding the emergency plan at the time of initial employment, on an annual basis and at the time of each plan update. The operator shall document the date of each training and the names of all facility persons who received the training and kept on file at the facility. A facility person`s record shall include verification of child care experience, education and training following the outset of service at the facility.

Noncompliance Area: The file for Staff Person #1 lacked documentation of mandated child abuse reporter training.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person`s record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL.

Noncompliance Area: *Upon assessment of supervision and ratio at 1:00 PM on 3/14/17 during naptime in the Nursery room, Staff #2 was observed to be the only staff present supervising 11 children - 1 young toddler, 7 older toddlers and 3 pre-school children. Upon assessment of supervision and ratio at 1:45 PM on 5/22/17 during naptime in the Nursery room, Staff #2 was observed to be the only staff present supervising 9 children - 1 Infant, 2 Young toddlers and 6 older toddlers.

Correction Required: The staff:child ratio while toddlers and preschoolers are napping is one staff person to 10 young toddlers, one staff person to 12 older toddlers, one staff person to 20 preschool children

Noncompliance Area: During naptime from 1:45 PM - 2:15 PM on 5/22/17, three staff were present in the facility. One staff person was with 4 infants in the main activity room, another staff person was with 2 OT and 5 PS in the main activity room and another staff person was with 2 YT and 6 OT in the nursery room. The staff person who was on break was not present in the facility, therefore leaving the remaining staff out of ratio if the children woke or needed to evacuate the facility in an emergency.

Correction Required: Staff persons who are on duty but are not providing child care during naptime shall remain in the child care portion of the facility premises.

Noncompliance Area: Upon assessment of supervision and ratio at 1:00 PM on 3/14/17 during naptime in the nursery room, which has a capacity of 6 children, 11 children were observed napping on cots that did not have 2 feet of space on at least 3 sides. Upon assessment of supervision and ratio at 1:45 PM on 5/22/17 during naptime in the Nursery Room, which has a capacity of 6 children, 8 children were observed napping on cots that did not have 2 feet of space on at least 3 sides. Upon assessment of supervision and ratio at 1:50 PM on 5/22/17 during naptime in the Main Activity Room, 7 children were observed to be napping on cots that did not have 2 feet of space on at least 3 sides.

Correction Required: The capacity established for an indoor space may be exceeded at naptime, when toddler or preschool children are resting on rest equipment. The capacity of the space is determined by the requirement for placement of rest equipment described at 3270.106(f). At least 2 feet of space is required on three sides of a bed, cot, crib or other rest equipment while the equipment is in use.

Noncompliance Area: A cracked white toy bin was observed on the low shelf in the front room. A cracked blue toy bin was observed on the top of the shelf by the window in the front room.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Noncompliance Area: During the inspection, a staff member was observed placing an infant in a crib. At a later time during the inspection, a different infant was observed in the first crib. When asked, the staff responded that they had made a mistake when the first infant was placed in the crib and had moved that infant to the correct crib.

Correction Required: Individual, clean, age-appropriate rest equipment shall be provided for preschool, toddler and infant children as agreed between the child`s parent and the operator. The rest equipment shall be labeled for the use of a specific child and used only by the specified child.

Noncompliance Area: The file for Child #1 contained a Child Service Report that was completed more than 6 months following enrollment.

Correction Required: The services to be provided to the family and the child, including the Department`s approved form to provide information to the family about the child`s growth and development in the context of the services being provided. The operator shall complete and update the form and provide a copy to the family in accordance with the updates regarding emergency contact information in 3270.124(f) (relating to emergency contact information).

Noncompliance Area: The files for Child #1 and #4 contained emergency contact forms that lacked the work addresses and telephone numbers of the enrolling parent. The file for Child #3 contained an emergency contact form that lacked the work telephone number of the enrolling parent.
