Noncompliance Area: The file for Child #1, start date 10/10/2016, contained an initial health assessment dated 01/12/2017; more than 60 days following the first day of attendance at the facility.

Correction Required: The operator shall require the parent of an enrolled child, including a child, a foster child and a relative of an operator or a facility person, to provide an initial health report no later than 60 days following the first day of attendance at the facility.

Noncompliance Area: The file for Child #1 lacked documentation of an up to date flu vaccination in accordance with the schedule recommended by the ACIP.

Correction Required: The facility shall require the parent to provide updated written verification from a physician, physician's assistant, CRNP, the Department of Health or a local health department of ongoing vaccines administered to an infant, toddler or preschool child in accordance with the schedule recommended by the ACIP.

Noncompliance Area: The file for Facility Person #4 contained documentation of emergency plan training on 05/17/2020, lacking documentation of emergency plan training in the last year.

Correction Required: The operator shall assure that each facility person receives training regarding the emergency plan at the time of initial employment, on an annual basis and at the time of each plan update. The operator shall document the date of each training and the names of all facility persons who received the training and kept on file at the facility.

Noncompliance Area: The file for Facility Person #1 contained documentation of mandated reporter training completed 02/04/2015, lacking documentation of mandated reporter training in the last five years. The file for Facility Person #2 contained documentation of mandated reporter training completed 04/10/2015, lacking documentation of mandated reporter training in the last five years. The file for Facility Person #2 contained FBI Clearances dated 09/25/2014 and 05/18/2020; more than five years passed between clearances. The file for Facility Person #3 lacked documentation of a NSOR Clearance at the time of inspection; NSOR Clearance verified on day of inspection.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL.

Noncompliance Area: **Through interviews conducted with staff person's #1 - #4 it was found that each staff person who was present at the North Park Pool on July 12, 2019, were unable to identify what happened when a lifeguard from the North Park Pool had to pull child #1 a preschool aged child from the pool. Each staff person gave a different statement as to what happened illustrating that child #1 was not being effectively supervised at the time of the incident.

Correction Required: The legal entity must arrange for all facility staff to receive a minimum of two hours of on line training regarding supervision of children while on an excursion away from the facility. The legal entity must receive DHS approval of the training content prior to scheduling the training.

Noncompliance Area: ***Through interviews with staff person's #1-#4 it was verified that while swimming at the North Park Pool on 7/12/2019, staff person #1 was assigned the specific responsibility to supervise a group of 6 preschool aged children while swimming and staff person #3 was assigned the specific responsibility to supervise a group of 7 preschool age children while swimming. Also, at the time of the incident involving child #1 needing to be pulled from the pool by a lifeguard not employed by the facility, staff person's #2 and #3 were left to supervise a group of 15 preschool aged children while swimming.

Correction Required: A statement will be prepared by the operator stating that the facility will not take children swimming without prior approval from the Western Regional Office of Child Development and Early Learning. This statement will be added to the facility's enrollment packet and will be signed by all current and newly enrolled children, as well as, all current and newly enrolled staff to document their review of this statement. This will be done for a period of 4 months from the date that this plan of correction is accepted.

Noncompliance Area: **On 7/12/2019, staff person's #1-#4 were present with a group of 18 preschool aged children on an excursion to the North Park Pool where the children were swimming. It was disclosed by staff person's #1-#4 that none of them were certified in lifeguard training.

Correction Required: The operator will include in their enrollment packet a copy of this regulation for current and newly enrolled parents, as well as, current and newly hired staff.. The review will be documented with a signed and dated signature. This will be done for a period of 4 months from the date which the plan of correction is accepted.

Noncompliance Area: *Staff person's #1-#3 disclosed that they were counted in ratio while a group of 18 preschool aged children swam at the North Park Pool. It was disclosed by staff person's #1-#3 that they had not completed water safety instruction within the last 12 months. It should also be noted that staff person #4 who was also present on the excursion had not completed water safety instruction within the last 12 months either.

Correction Required: A facility person who is counted in the staff-child swimming ratio shall annually complete water safety instruction.

Noncompliance Area: Two large storage cabinets located in the preschool room standing approximately 6 feet high and one large storage cabinet located in the older toddler classroom standing approximately 6 feet high were observed not to be secured to the wall creating a falling hazard to the children in care.

Correction Required: Furniture must be durable, safe, easily cleaned and appropriate for the child's size, age and special needs.

Noncompliance Area: The agreement form on file for child #3 were observed not to contain documentation of the services to be provided to the family and the child.

Correction Required: The services to be provided to the family and the child, including the Department's approved form to provide information to the family about the child's growth and development in the context of the services being provided. The operator shall complete and update the form and provide a copy to the family in accordance with the updates regarding emergency contact information in 3270.124(f) (relating to emergency contact information).

Noncompliance Area: The agreement form on file for children #3 were observed not to contain documentation to specify the child's arrival and departure times.

Noncompliance Area: The most recent health report on file for child #1 and older toddler aged child in care was observed to be greater than 12 months old. This is evidenced by the most recently dated health report on file for child #1 being dated 8/16/2017.

Correction Required: The operator shall require the parent to provide an updated health report at least every 12 months for an older toddler or preschool child.

Noncompliance Area: The shot record on file for child #1 showed that the child was not administered immunizations in accordance with the recommendations of the ACIP. There was no documentation of exemption on file for this child.

Correction Required: The facility may not accept or retain an infant 2 months of age or older, a toddler or a preschool child at the facility for more than 60 days following the first day of attendance at the facility unless the parent provides written verification from a physician, physician's assistant, CRNP, the Department of Health or a local health department of the dates (month, day and year) the child was administered immunizations in accordance with the recommendations of the ACIP.

Noncompliance Area: It was observed that the operator had not notified the local traffic safety authorities in writing of the location of the facility and the program's use of pedestrian and vehicular routes around the day care facility since October of 2017.
