Noncompliance Area: On 11/15/19, the initial health assessment and the results of tuberculosis testing by Mantoux method observed in the file belonging to Staff #1 were not dated to ensure they were conducted within 12 months of initial hire.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.A facility person's record shall include a written report of initial and subsequent health assessments, including the results of initial and subsequent tuberculin skin tests, x-rays or other medical documentation necessary to confirm freedom from communicable tuberculosis.

Noncompliance Area: On 11/15/19, initial training in the facility's emergency plan was not observed in the file belonging to Staff #1.

Correction Required: The operator shall assure that each facility person receives training regarding the emergency plan at the time of initial employment, on an annual basis and at the time of each plan update. The operator shall document the date of each training and the names of all facility persons who received the training and kept on file at the facility.

Noncompliance Area: On 11/15/19, a signed disclosure statement was not observed in the file belonging to Staff #1.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL.

Noncompliance Area: On 10/22/19, rest equipment (pack n plays and mats) were not labeled for the individual use of a specific child.

Correction Required: Individual, clean, age-appropriate rest equipment shall be provided for preschool, toddler and infant children as agreed between the child's parent and the operator. The rest equipment shall be labeled for the use of a specific child and used only by the specified child.

Noncompliance Area: On 10/22/19, the agreement belonging to Child #1 was not signed by the parent. Date of admission was not observed on the agreement forms belonging to Child #1, Child #2, Child #3 and Child #4.

Correction Required: An agreement shall be signed by the operator and the parent.An agreement shall specify the date of the child's admission.

Noncompliance Area: On 10/22/19, emergency contact information was not observed in the play space area where children were receiving care.

Correction Required: When children are in the facility, emergency contact information shall be present in a child care space for children receiving care in the space.

Noncompliance Area: On 10/22/19, certification representative observed Staff #1 changing diapers. The diaper changing surface was not sanitized after each use.

Correction Required: Diaper changing surfaces shall be cleaned after each use by wiping the surface with a sanitizing solution or by changing a pad or other surface covering.

Noncompliance Area: On 10/22/19, diapers at the facility were not checked nor changed at least every 2 hours. According to documentation provided by Staff #1, Child #4 diaper was changed at 9:08am and Child #3 diaper was changed at 10:05am. Staff #1 did not check nor change the diapers of Child #3 and Child #4 until 1:15pm.

Correction Required: A staff person shall check a child's diaper at least every 2 hours and whenever the child indicates discomfort or exhibits behavior that suggests a soiled diaper. A staff person shall change a child's diaper when the diaper is soiled.

Noncompliance Area: On 10/22/19, the date of the initial health assessment observed on file for Staff #1 (hired 9/5/19) was not legible to ensure it was conducted within 12 months of initial service in child care.

Noncompliance Area: On 10/22/19, three electric cords accessible to children hanging from cloud shaped lamps attached to the wall were observed in the toddler area. The hanging electrical cords pose a safety threat if a child pulls on the cord, the cloud shaped lamp could fall off the wall, injuring a child. The cords could also strangle a child if wrapped around neck.

Correction Required: Conditions at the facility may not pose a threat to the health or safety of the children.

Noncompliance Area: On 10/22/19, Staff #1 was observed alone at the facility with four children. First aid training was not observed in the file belonging to Staff #1.

Correction Required: One or more facility persons competent in first-aid techniques shall be at the facility when one or more children are in care.

Noncompliance Area: On 10/22/19, a Director responsible for the general management of the facility and present at the facility for a minimum of 30 hours per week was not observed at the facility. Staff #2 is listed as the Director of the facility, however, Staff #2 is the Director at another facility owned by the Legal Entity.

Correction Required: A director is responsible for the general management of the facility, including the minimum duties described at 3270.34(a)(1) - (6).A director shall be employed by a facility and be present at the facility site a minimum of 30 hours per week.

Noncompliance Area: On 10/22/19, Staff #1 was observed working alone with four children at the facility. Staff #1 is qualified as an aide.

Correction Required: An aide or a combination of aides shall be supervised at all times by a staff person qualified at minimum as an assistant group supervisor.

Noncompliance Area: On 10/22/19, at approximately 10:15am, Staff #1 was observed alone at the facility with four children.

Correction Required: At least two facility persons shall be present in the facility when two or more children are in care. At a minimum, one of the facility persons shall be a staff person.

Noncompliance Area: On 10/22/19, six uncovered electrical outlets were observed in the facility.

Correction Required: Protective receptacle covers shall be placed in electrical outlets accessible to children 5 years of age or younger.

Noncompliance Area: On 10/22/19, Clorox wipes, bleach and wallpaper stripping solution was observed in the unlocked cabinet under the sink located in the kitchenette area. A fire extinguisher instructing to "keep away from children" was observed on the floor accessible to children in the kitchenette area. Two liquid plug in air fresheners were observed accessible to children in the outlets located in the facility.

Correction Required: Cleaning materials and other toxic materials shall be kept in an area or container that is locked or made inaccessible to children.

Noncompliance Area: On 10/22/19, a soiled diaper was observed placed on the floor. Staff #1 stated the soiled diaper was placed it on the floor because a plastic lined waste receptacle was not available at the diapering area.

Correction Required: Trash that has been contaminated by human secretions or excrement shall be contained in closed, plastic-lined receptacles.If disposable diapers are provided by a parent or by a facility, a soiled diaper shall be discarded by immediately placing the diaper into a plastic-lined, hands-free covered can.

Noncompliance Area: On 10/22/19, emergency telephone numbers were not posted by the telephone located in the kitchenette area.

Correction Required: The telephone number of the nearest hospital, police department, fire department, ambulance and poison control center shall be posted by each telephone in the facility.

Noncompliance Area: On 10/22/19, the vent cover located in the gross motor area was bent and not secured to the wall making the vent accessible to children.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Noncompliance Area: On 10/22/19, Staff #1 did not wash Child #4 (young toddler) hands after diapering. Hand washing signs stating the requirement for washing hands were not posted at two sinks and diapering area in the facility.

Correction Required: A facility person and an able child shall wash his hands after toileting and before eating. A sign on which this requirement is written shall be posted at each toilet, training chair, diapering area and sink in the facility. A staff person shall ensure that a child's hands are washed before meals and snacks, after toileting and after being diapered.

Noncompliance Area: On 10/22/19, the portable sink located at the diaper changing area was not operable. Staff #1 acknowledged that the sink was not filled with water when two diapers were changed between 9am-10am.

Correction Required: A source of running water for handwashing shall be present in infant and toddler diapering areas. If the running water does not flow directly into a drain that is connected to a sewage system, a receptacle shall be provided to contain the water used for washing. The receptacle shall be emptied into an approved sewage system at least once a day.

Noncompliance Area: On 10/22/19, two portable space heaters were observed at the facility. The space heaters were not in use during the time of the inspection.

Correction Required: Portable space heaters are not permitted.

Noncompliance Area: During the initial inspection on April 22, 2019, the facility did not have an indoor or outdoor play space.

Correction Required: A facility shall provide outdoor or indoor play space to be used for large muscle activity which includes running, jumping, climbing and riding, prior to the issuance of the certificate of compliance.

Noncompliance Area: During the initial inspection on 4/22/19, signs were posted over sink and toileting areas, however, the exact language was not specified for washing hands before meals and after toileting.
