Noncompliance Area: Observed staff file #1 contained a criminal background clearance and child abuse clearance which were dated more than 60 months after the previous valid clearances. Observed staff file #1, who was hired prior to 9/30/19, contained an NSOR verification letter which was required to be obtained prior to 7/1/20, but was dated after 7/1/20. Observed staff file #1 contained a mandated reporter training which was dated more than 60 months ago and had not been updated.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services).

Noncompliance Area: Observed in the main child care area, a damaged blue toy bin which had a pinch point and rough edges.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Correction Required: Individual, clean, age-appropriate rest equipment shall be provided for preschool, toddler and infant children as agreed between the child's parent and the operator. The rest equipment shall be labeled for the use of a specific child and used only by the specified child.

Noncompliance Area: Observed child file #1, 2, and 3 contained most recent child service reports which were completed more than 11 months ago.

Correction Required: An agreement shall specify the services to be provided to the family and the child, including the Department's approved form to provide information to the family about the child's growth and development in the context of the services being provided. the operator shall complete and update the form and provide a copy to the family in accordance with the updates regarding emergency contact information at 3290.124(e).

Noncompliance Area: Observed child file #1, 2, and 3 did not contain written verification of ongoing flu vaccines administered in accordance with the schedule recommended by the ACIP.

Correction Required: The facility shall require the parent to provide updated written verification from a physician, physician's assistant, CRNP, the Department of Health or a local health department of ongoing vaccines administered to an infant, toddler or preschool child in accordance with the schedule recommended by the ACIP.

Noncompliance Area: Observed a tube of prescription cream accessible to children on the vanity in the bathroom used by the children and a bottle of medication accessible to children on a bed in an unlocked room.

Correction Required: Medication shall be stored in a locked area of the facility or in an area that is out of the reach of children.

Noncompliance Area: Observed child file #1, 2, 3, and 4 contained recent documentation of parental review of the emergency contact information and the financial agreement, which was completed 12 months after the previously documented date of parental review.

Following review, a parent shall attest to the accuracy of information in the emergency contact information and the financial agreement at each review by affixing a dated signature to the record.

Noncompliance Area: Observed staff file #1 documented the completion of 8 clock hours of training within the previous 2 years when staff #1 was required to complete 12 clock hours.

Correction Required: A staff person shall obtain an biennial minimum of 12 clock hours of child care training.

Noncompliance Area: Observed an electrical outlet, on the decorative lights on the porch railing, was accessible to children and did not have a protective receptacle cover.

Correction Required: Protective receptacle covers shall be placed in electrical outlets accessible to children 5 years of age or younger.

Noncompliance Area: Observed the following items labeled keep out of the reach of children were accessible to children, ice melt material on the porch at the entrance to the facility, Clorox wipes and flex seal accessible in an unlocked storage area, and laundry detergent and bleach accessible in the kitchen area due to an unlocked baby gate. Observed a spray bottle containing liquid and there was no label specifying the contents of the bottle.

Correction Required: Cleaning materials and other toxic materials shall be stored in an original labeled container or in a container that specifies the content. Toxics shall be kept in a locked area or in an area inaccessible to children, and shall be stored away from food, food preparation areas and child care spaces.

Noncompliance Area: Observed the stove in the kitchen area was accessible to children due to an unlocked baby gate.

Correction Required: Hot water pipes and other sources of heat exceeding 110 F that are accessible to children shall be equipped with protective guards or shall be insulated to prevent direct contact.

Observed Lysol and diaper cream labeled "keep out of the reach of children" accessible to children in the diaper changing area. Observed several food items stored in the same storage area as raid bug spray and other toxic materials.

Noncompliance Area: Large plastic bins used for toy storage in the child care space had cracked and broken corners resulting in sharp edges and pinch points. The wooden platform of the outdoor equipment has a loose board with an exposed nail that poses a safety risk.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Noncompliance Area: The mulch used as loose-fill under the embedded outdoor equipment did not meet the recommendations of the United States Consumer Product Safety Commission. In various spots the fill did not meet the required 9 inches of fill and was measured at less than 6 inches deep.

Noncompliance Area: The facility's first-aid kit contained acetaminophen, aspirin, alcohol pads, and antibacterial pads which lacked the name of the child for whom the medication was intended.

Correction Required: The label of a medication container shall identify the name of the medication and the name of the child for whom the medication is intended. Medication shall be administered to only the child whose name appears on the container.

Noncompliance Area: The facility lacked a plastic-lined, hands-free covered can near the diapering area to allow for immediate disposal.
