Findings: Based on Surveyor's inspection of the diapering areas, the following was observed: *The varnish had come off in several sections on the wooden guard rails on the diapering counters in the 1 year old room, the infant room, the 1-2 year old room and in the 2 year old room. These areas of the wood were not longer waterproof and sanitizable; and *One year old room- 2 bowls containing finger paint were stored on the diapering counter; *One-two years old room- A clipboard and a pen were stored on the diapering counter; and *Two year old room- A washcloth was hanging from the diapering sink faucet.

The Director stated that the pavers had come out of the ground and the maintenance crew had not re-installed them.

Findings: Based on Surveyor's observation and a review of staff #2's file, it was determined that staff #2 had answered "Yes" to question #1 on the Criminal History affidavit form, which indicates that the staff is awaiting trial on or has been convicted of or has admitted in open court or pursuant to a plea agreement committing any of the offenses listed in section 41-1758.07, subsection B in this state or similar offenses in another state or jurisdiction . The Director acknowleded that she was aware of staff #2's "Yes" response to question #1. The Director stated that she had asked staff #2 for clarification and the staff told the Director that she had a pending charge and told the Director what the charge was regarding.

Findings: Based on Surveyor's review of staff #2's file and on a discussion with the Director, it was determined that the staff #2 did not have a valid fingerprint clearance card upon the staff's starting date of employment of 9/28/2020. The Director acknowledged that the Surveyor had spoken with the Assistant Director via telephone to notify them that the staff had been denied approval of a fingerprint clearance card. Upon a later review of the Surveyor's documentation, it was determined that this phone call was made on 10/21/2020. **Previously cited on 8/13/2020.
