Noncompliance Area: During renewal inspection, staff files were reviewed. It was observed that Staff #1 obtained their NSOR clearance on 5/19/25. This date indicates that the clearance was not obtained prior to Staff #1 working with children. (See code sheet for date of hire).

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. This policy must be approved by DHS before implementation. The operator shall provide a date for when this policy and staff review will be completed.

Description: Devices must be compliant/Director or designated staff person ensure compliance

Noncompliance Area: During allocated unannounced visit, it was observed that the facility could not provide the documentation showing fire drills and fire alarm testing was conducted. Provider misplaced the documentation.

Correction Required: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. §  1016(c)). The Director or designated staff person who is responsible for compliance with this chapter shall ensure the requirements under subsection (a) are met.

Regulation: 3270.124(b)(3)

Description: Parent home/work address, phone

Noncompliance Area: Child #1's enrolling father did not have the work phone number listed on the emergency contact sheet. Child #2's emergency contact sheet did not have both enrolling parents work address and did not have the enrolling father's work phone number.

Correction Required: Emergency contact information must include the home and work addresses and telephone numbers of the enrolling parent.

Description: Copies of reports in file at facility/Reports of accidents, injuries and illnesses. Original report - parent same day Copy - facility accident file. Copy - child's file

Noncompliance Area: During inspection, director admitted to no longer keeping a master file of incident/accident/injury reports. Original reports are provided to the parent and a copy is kept in a child's file.

Correction Required: Copies of reports of injury, death or fire shall be kept in a file at the facility. A child's record shall contain reports of accidents, injuries and illnesses involving a child in care at the facility. The original report shall be given to the parent on the day of the incident. The second copy of the report shall be retained at the facility in an accident file. The third copy of the report shall be retained at the facility in the child's file.

Regulation: 3270.36(b)(5)/3270.192(2)(ii)

Description: HS/GED + 2 yrs/Exp, educ., training prior to facility

Noncompliance Area: Staff #1 was listed as an AGS. Staff #1 has a high school diploma, but staff did not have two years of childcare experience. Staff only had one year of experience.

Correction Required: An assistant group supervisor shall have a high school diploma or a general educational development certificate and 2 years experience with children. A facility person's record shall include verification of child care experience, education and training prior to service at the facility.

Regulation: 3270.103

Description: Small Toys and Objects

Noncompliance Area: A renewal inspection was conducted on 7/25/23. At that time, small stones less than 1 inch in diameter were observed on the playground used by the toddlers.

Correction Required: Toys and objects with a diameter of less than 1 inch, objects with removable parts that have a diameter of less than 1 inch, plastic bags and styrofoam objects may not be accessible to children who are still placing objects in their mouths.

Regulation: 3270.104(a)

Description: Clean, good repair, proper size

Noncompliance Area: A renewal inspection was conducted on 7/25/23. At that time, a large, red shelf in the corner of the Pre-K classroom was not anchored and posed a tipping hazard. A sharp wire was observed sticking out of a radiator in the young toddler room.

Correction Required: Furniture must be durable, safe, easily cleaned and appropriate for the child's size, age and special needs.

Regulation: 3270.166(3)

Description: Disposable nursers or parents

Noncompliance Area: A complaint investigation was conducted on 7/25/23. During the investigation, it was found that the infant bottles are washed with soap and water before being reused and the facility does not have a commercial dishwasher.

Correction Required: Disposable nursers shall be used for infants unless bottles are provided by the parent or unless a commercial dishwasher is used by the facility.

Regulation: 3270.31(e)(4)(ii)

Description: Fire safety - 1 yr.

Noncompliance Area: A renewal inspection was conducted on 7/25/23. At that time, the files were reviewed. The file for Staff Person #2 did not have documentation of fire safety training conducted within the past twelve months. The most recent fire safety training on file was dated 5/11/22.

Correction Required: Staff persons shall participate, at least annually, in firesafety training conducted by a fire protection professional. Staff persons and volunteers shall receive training in maintenance of smoke detectors, the duties of facility persons during a fire drill and during a fire and the use of the facility's fire extinguishers, not including discharge of the fire suppressant agent.

Regulation: 3270.31(f)

Description: Health and Safety Training

Noncompliance Area: A renewal inspection was conducted on 7/25/23. At that time, the staff files were reviewed. Staff person #1 has not completed the following required pre-service training within 90 days of their date of hire: pediatric first aid and cpr training.

Correction Required: Staff persons shall complete professional development within 90 days of hire as listed in subsections (f)1-10. Staff person #1 will have until 8/9/23 to complete the required training. Until such time as the required training has been completed, staff person #1 must be supervised, when interacting with children, by an AGS who has completed the required training related to this citation. If there are no staff available to supervise staff person #1, then staff person #1 may not work in a child-care position at the facility.

Description: Comply with CPSL/CPSL information

Noncompliance Area: A renewal inspection was conducted on 7/25/23. At that time, the staff files were reviewed. Staff person #1 did not have the request for the NSOR certificate on file prior to beginning employment at the facility. The application could not be located but it is believed that it was submitted 1/3/23. A second application was sent on 2/17/23. The NSOR certificate was dated 2/24/23, more than 45 days after the onset of employment. Staff Person #1 was not suspended from employment after 45 days when the NSOR was not received. Staff Person #4, who has lived in New York in the past five years, did not have a NY Sex Offender Registry check or the NY Child Abuse Clearance on file at the facility or applications for the clearances at the time of inspection.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Staff Person #4 may not work in a child care position at the facility until the NY Child Abuse Clearance and NY Sex Offender check is on file.

Noncompliance Area: A renewal inspection was conducted on 7/25/23. At that time, the staff files were reviewed. The file for Staff Person #3, an assistant group supervisor, did not include verification of two years' experience to qualify them for their position.

Correction Required: An assistant group supervisor shall have a high school diploma or a general educational development certificate and 2 years experience with children.

Description: Space safe for large muscle activity

Noncompliance Area: A renewal inspection was conducted on 7/25/23. At that time, weeds about a foot high were observed along the playground fence.

Correction Required: Outdoor or indoor play space shall be safe for large muscle activity.
