Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem. An adult health assessment must include tuberculosis screening by the Mantoux method at initial employment. Subsequent tuberculosis screening is not required unless directed by a physician, physician's assistant, CRNP, the Department of Health or a local health department. |

Provider Response: (Contact the State Licensing Office for more information.) Staff #1 had a physical prior to employment and Staff #1 physician did not indicate a TB test needed to be done. The regulation regarding staff physicals and TB tests is not clear. In the regulation it states, " subsequent TB screening is not required unless directed by a physician". We feel this statement is an ambiguity. Once this was brought to our attention, we immediately sent Staff #1 to get a second TB test paid by our center. Staff #1 worked in childcare prior and it was unclear about subsequent testing. If the regulation was communicated clearly, all doctor's offices would be aware and require the TB testing. |

Prior to inspection ending Staff #1 and Staff #2 had verification of hours form in each file. Staff #3 has not worked for the center for three plus months. |

Staff #1 and #2 did have proof of education although we did not have proof of hours working with children (verification form) completed. The verification forms were completed before inspection was over for Staff #1 and #2. Ex-staff # 3's file has been pulled and will never be eligible to work for the center again due to a series of events (not involving children). |
