Lil Rascals Day Care Center - Schuylkill Haven PA Child Care Center

Noncompliance Area: Facility person #1 had mandated reporter training dated 8/20/15, facility person #2 has mandated reporter training dated 8/27/20 and facility person #3 has mandated reporter training dated 8/14/20. All of these facility persons had previous mandated reporter training with dates during 4/2015. The previous training was more than 60 months old at the time it was updated and the facility was open and operating since receiving a waiver to continue to operator during Covid-19 pandemic.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services).

Noncompliance Area: During the in-person inspection on 9/24/20, Rep observed an open window in the 1 yr old room that did not have a screen and an open window in the 2 yr old room that was open had a screen that had a hole in it.

Correction Required: Windows or doors used for ventilation shall be screened when open. Screens shall be in good repair.

Noncompliance Area: A daily schedule of activities is not posted in the infant room. Daily schedules will remain posted in all child care spaces.

Correction Required: The written plan of daily activities shall be posted in the group space.

Noncompliance Area: Child #1 is 2 years 5 months old and has only 1 Hep A immunization on record. A medical or personal/religious exemption letter is not on file.

Correction Required: The facility shall require the parent to provide updated written verification from a physician, physician's assistant, CRNP, the Department of Health or a local health department of ongoing vaccines administered to an infant, toddler or preschool child in accordance with the schedule recommended by the ACIP.

Noncompliance Area: AN expired Certificate of Compliance was posted in the facility.

Correction Required: The facility's current certificate of compliance and a copy of the applicable regulations under which the facility is certified shall be posted in a conspicuous location used by parents, with instructions for contacting the appropriate regional day care office posted at the same location.

Noncompliance Area: Facility Persons #1 & #2 do not have proof of education on file at facility.

Correction Required: A facility person's record shall include verification of child care experience, education and training prior to service at the facility.

Noncompliance Area: Facility person #2 does not have 2 written, non-family references on file at facility.

Correction Required: A facility person's record shall include two written, nonfamily references from individuals attesting to the person's suitability to serve as a facility person

Noncompliance Area: On 5/28/19 Facility Person #1, has a start date of 5/23/19 and does not have an FBI clearance or proof of request for FBI clearance or a signed disclosure statement on file at facility. Facility persons #2, #3 & #4 also do not have signed disclosure statements on file but have complete documentation for all three clearances.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person #1 may not work in a child care position at the facility.

Noncompliance Area: Observed to children 3 children napping on blankets with out mats or other resting equipment.

Correction Required: Bed linens may not be used alone as age-appropriate rest equipment.

Noncompliance Area: Children #1-#3 do not have addresses for release persons on emergency information forms.

Correction Required: Emergency contact information must include the name, address and telephone number of the individual designated by the parent to whom the child may be released.

Noncompliance Area: Facility person #2, was previously employed but left employment for a time and returned 9/11/17. At time of re-hire her health assessment on file is dated 3/1/16. The most recent health assessment is dated 7/5/18. At time of re-hire the health assessment on file was more than 1 year old. TB screening on file is dated 2/3/17 which is acceptable.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.

Noncompliance Area: Facility person #1, DOH 11/6/17, has a mandated reporter training dated 8/19/18 which is beyond the 90 provisional period.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services).

Noncompliance Area: Observed bingo dabbers on a low shelf in the art area of the preschool room that are labeled "keep away from children". They also not labeled as non-toxic.

Correction Required: Cleaning materials and other toxic materials shall be kept in an area or container that is locked or made inaccessible to children. Arts and crafts materials shall be nontoxic.

Noncompliance Area: When Certification Rep was at facility to conduct a complaint investigation on 7/30/18, Rep observed a staff person walk down the hall, through the double doors into the foyer to open the outside door for the Rep. When Rep and facility person returned to the classroom, 9 preschool children were inside the room without a staff person. The facility person stated that there was no extra person to answer the door, however it was determined that an extra facility person was present in the building at that time.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. Children must be supervised at all times. THE LEGAL ENTITY MUST ARRANGE FOR ALL FACILITY STAFF TO RECEIVE A MINIMUM OF 4 HOURS OF PQAS APPROVED TRAINING REGARDING SUPERVISION OF CHILDREN. IT DOES NOT MATTER IF THE PQAS APPROVED TRAINING IS DONE THROUGH REGIONAL KEY. THE LEGAL ENTITY MUST RECEIVE DHS APPROVAL OF THE TRAINING CONTENT PRIOR TO SCHEDULING THE TRAINING. Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises.

Noncompliance Area: Facility person #1, has an initial health assessment on file dated 7/5/17 but does not have results of a TB screening on file.

Correction Required: An adult health assessment must include tuberculosis screening by the Mantoux method at initial employment. Subsequent tuberculosis screening is not required unless directed by a physician, physician's assistant, CRNP, the Department of Health or a local health department.
