Until such time as the required training has been completed staff person #2 must be supervised when interacting with children by an AGS, primary staff person who has completed their required training related to this citation. If there are no staff available to supervise staff person #2, staff person #2 may not work in a child-care position at the facility.

Noncompliance Area: The NSOR clearance on file for Staff person #1 was observed to be greater than 60 months. This is evidenced by the NSOR clearance being dated 11/12/2019.

Description: Parent Access & Participation

Noncompliance Area: The legal entity issued the parent a "no trespass" letter which prevented the parent from having the opportunity to participate in the facility's program when the children were present.

Correction Required: A parent of a child in care shall be permitted free access, without prior notice, throughout the center whenever children are in care, unless a court of competent jurisdiction has limited the parental right of access to the child and a copy of the order is on file at the facility. Opportunity shall be provided for parents to participate in the facility's program. The operator shall maintain a yearly file which documents general announcements to promote parent participation. The file shall be updated annually.

Noncompliance Area: In the preschool room it was observed a broken red Lego. The school-age room had several wooden blocks that were splintering.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). LACKING REQUIRED HIRING DOCUMENTS: Facility Person #2 may not work in a child care position at the facility. A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Noncompliance Area: The facility's fire alarm test report documented testing of the fire alarm system between 01/02/2023 - 02/02/2023 (31 Days); 04/02/2023 - 05/11/2023 (39 Days); 05/12/2023 - 06/26/2023 (45 Days); 08/17/2023 - 09/18/2023 (32 Days). A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.

Correction Required: The operator shall require the parent of an enrolled child, including a child, a foster child and a relative of an operator or a facility person, to provide an initial health report no later than 60 days following the first day of attendance at the facility. The facility may not accept or retain an infant 2 months of age or older, a toddler or a preschool child at the facility for more than 60 days following the first day of attendance at the facility unless the parent provides written verification from a physician, physician's assistant, CRNP, the Department of Health or a local health department of the dates (month, day and year) the child was administered immunizations in accordance with the recommendations of the ACIP.

Staff #2 was observed having the most current PSP clearance dated 10/19/16 and FBI clearance dated 10/11/16, both clearances exceeding 60 months. Staff #3 was observed having the most current PSP clearance dated 12/8/15, Pennsylvania Child Abuse clearance dated 12/18/15, and FBI clearance dated 5/8/14, all clearances exceeding 60 months. Staff #4 was observed having the most current PSP clearance dated 8/12/16, Pennsylvania Child Abuse clearance dated 8/16/16, and an FBI clearance dated 8/19/16, all clearances exceeding 60 months.

Noncompliance Area: Observed in the pre school room, damaged magnatiles and a cracked bin in which they were contained.
