5 CSR 25-500.082 Physical Requirements of Group Day Care Homes and Day Care Centers

Violation: The facility did not have a fenced outdoor play area that was on or adjoining the day care property and was accessible without hazard as evidenced by the fence was not in good condition in that during the outdoor inspection, the fence was missing a anchor bar in the fence that was allowing the back fence (school age playground side) to not anchor or lock properly. When CI Ray-Warnke went to attempt to anchor the bar or latch the fence there was a lock engaged but no bar. Since there is no bar to engage at the bottom of the fence this create a hazard for when school age children exit their exit doors into the playground, children have nothing to precent them from exiting the property and fence of the facility into unapproved outdoor space and neighboring property.

The play area shall be located so it is convenient and the children can gain access to it without hazard. An outdoor play area used exclusively for school-age children shall not be required to have a fence. Fences shall be constructed to prevent children from crawling or falling through or becoming entrapped.
