Description: Comply with CPSL/CPSL information

Noncompliance Area: The file for Staff #1, provisionally hired after 2/1/25 (SEE LIS CODE SHEET), lacked an NSOR certificate prior to start date with children, as required by the Announcement C-25-01.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). LACKING REQUIRED HIRING DOCUMENTS: Staff #1 -- may not work in a childcare position at the facility. A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Staff #1--- may not work in a childcare position at the facility.

Regulation: 3270.52

Description: Mixed Age Level

Noncompliance Area: On 6/10/26 at approximately 4:00pm in the preschool area, Staff #1 identified 8 preschoolers and 1 older toddler. The staff: child ratio for older toddlers is 1:6.

Correction Required: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements in § 3270.51 (relating to similar age level). The required staff:child ratios must be maintained at all times.

Regulation: 3270.95(a)/3270.95(b)

Description: Devices must be compliant/Director or designated staff person ensure compliance

Noncompliance Area: The facility's fire detection log documented dates 5/1/26 and 6/1/26, more than 30 days apart.

Correction Required: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. § 1016(c)). The Director or designated staff person who is responsible for compliance with this chapter shall ensure the requirements under subsection (a) are met.

Regulation: 3270.106(f)

Description: 2 feet apart

Noncompliance Area: At approximately 115pm in the preschool area of the building there was one child blocked into the back corner for nap time with no space on any sides of the rest equipment in use. Another child on their nap mat was in the opposite corner with shelves on two sides and a wall on the third side. In the older toddler area of the building at approximately 115pm there were four children on nap equipment in a row next to each other not leaving at least 2 feet of space on 3 sides. In the young toddler area, there were 4 children using rest equipment that did only have at least 2 ft of space on 3 sides.

Correction Required: At least 2 feet of space is required on three sides of a bed, cot, crib or other rest equipment while the equipment is in use.

Regulation: 3270.113(a)

Description: Supervised at all times

Noncompliance Area: At approximately 115pm in the older toddler area one child was sleeping behind the table with plastic chairs on top next to the window unable to be seen by the staff. In the young toddler area behind the table with plastic chairs on top under the window was a child sleeping unable to be seen by the staff. Per staff statements and other documentation on 3/11/26 at approximately 145pm a tornado warning was issued. Staff and children were evacuated to the basement of the facility. Once a name to face was completed approximately 5-15 minutes after being in the basement it was confirmed that a preschool age child was left up upstairs in the facility alone sleeping behind a table on their nap equipment unable to be seen.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises.

Regulation: 3270.113(a)(1)

Description: Staff assigned to specific children

Noncompliance Area: Per staff statements and other documentation on 3/11/26 at approximately 145pm a tornado warning was issued. Staff and children were evacuated to the basement of the facility. Once a name to face was completed approximately 5-15 minutes after being in the basement it was confirmed that a preschool age child was left up upstairs in the facility alone sleeping behind a table on their nap equipment unable to be seen.

Correction Required: Tiered LIS: Tier 1. Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises. This portion of the plan shall have an immediate correction date. Tier 2. The legal entity shall develop a visual method for identifying specific children for whom each staff person is responsible and for tracking children during transition periods. All staff will utilize the identification method appropriately at all times while on duty at the facility. The operator shall provide a date for when this will be completed.

Regulation: 3270.113(b)

Description: No physical punishment

Noncompliance Area: Per staff statements on 3/10/26 Staff #5 grabbed and picked up a child by the arm and then tossed the child to the ground. On 3/11/26 Staff #5 pushed a child away from them when they were painting a wall in the toddler area. In April of 2026 per staff statements Staff #5 picked up another child by the arm and dropped the child quickly when another staff member yelled for Staff #5 to put the child down. Per staff statements, Staff #9 smacked a child on the back of the hand.

Correction Required: Tiered LIS: Tier 1. A facility person may not use any form of physical punishment, including spanking a child. This portion of the plan shall have an immediate correction date. Tier 2. The legal entity will participate in technical assistance with the ELRC in regard to appropriate interactions with children and with classroom management.

Regulation: 3270.31(e)(4)(i)

Description: Age and Training

Noncompliance Area: The files for Staff persons #6 and 7 included verification of pediatric First Aid/CPR trainings dated 3/11/26, after the expiration date of 10/2025.

Correction Required: Competence is the completion of training by a professional in the field of first-aid and cardiopulmonary resuscitation (CPR). All staff persons shall renew their certification in pediatric first aid and pediatric cardiopulmonary resuscitation (CPR) on or before the expiration of the most current certification.

Regulation: 3270.31(f)

Description: Health and Safety Training

Noncompliance Area: Staff person #3 has completed Pediatric first aid and CPR training, however the trainer has not provided documentation that they are PQAS-certified in that training curriculum. Staff person #8 has completed Pediatric first aid and CPR training, however the training was not completed through a Pennsylvania Quality Assurance System (PQAS) approved curriculum.

Correction Required: Staff persons shall complete professional development within 90 days of hire as listed in subsections (f)1-10 or (g)1-10. Until such time as the required training has been completed, staff person #3 and 8 must be supervised, when interacting with children at a minimum by, an AGS who has completed all preservice trainings and has all qualifications to care for children unsupervised. If there are no staff person(s) available to supervise staff person #3 and 8, staff person #3 and 8 may not work in a child-care position at the facility

Regulation: 3270.32(a)

Description: Comply with CPSL

Noncompliance Area: Staff person #5 has completed mandated reporter training, however the mandated reporter training does not meet the minimum of three hours.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to Child Protective Services). Until such time as the required training has been completed, staff person #5 must be supervised, when interacting with children at a minimum by, an AGS who has completed all preservice trainings and has all qualifications to care for children unsupervised. If there are no staff person(s) available to supervise staff person #5, staff person #5 may not work in a child- care position at the facility

Regulation: 3270.33(a)/3270.192(2)(ii)

Description: Each staff person meets quals/Exp, educ., training prior to facility

Noncompliance Area: Staff #5's file did not contain proof of education and experience to be a staff person and per staff statements is used in ratio.

Correction Required: A staff person or a substitute staff person shall meet one of the applicable staff qualifications for the position in which the person is performing. A facility person's record shall include verification of child care experience, education and training prior to service at the facility.

Regulation: 3270.51

Description: Similar Age Level

Noncompliance Area: At approximately 115pm Staff #3 identified 11 preschool age children in their group; three of the children in this group were not staying on their rest equipment.

Correction Required: When children are grouped in similar age levels, the following maximum child group sizes and ratios of staff persons apply: Infants 1:4 with a maximum group size of 8; Young toddlers 1:5 with a maximum group size of 10; Older toddlers 1:6 with a maximum group size of 12; Preschool children 1:10 with a maximum group size of 20; Young school-age children 1:12 with a maximum group size of 24; Older school-age children 1:15 with a maximum group size of 30.

Regulation: 3270.52

Description: Mixed Age Level

Noncompliance Area: At approximately 2pm Staff #1 left Staff #2 in the infant area alone with 4 infants and 2 young toddler age children. In the older toddler area staff #4 identified 3 older toddlers and 4 preschool age children in their group; two children were at first rolling around the floor and then were sitting in the teacher's lap, another child was playing with toys and then started crawling and rolling on the floor.

Correction Required: TIERED LIS: Tier 1. When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with § 3270.51 (relating to similar age level). This portion of the plan shall have an immediate correction date. Tier 2. The legal entity will ensure that all staff receive an in-person training on appropriate staff child ratios conducted by the ELRC. The legal entity will submit details of the training course to the Department for approval prior to implementation. Proof of training of all the staff persons will be submitted to the Department within 10 days of the completion of this training. The operator shall a provide a date for when this will be completed.

Regulation: 3270.103

Description: Small Toys and Objects

Noncompliance Area: A plastic bag containing screws and bolts was observed in an unlocked drawer in the entrance walkway of the facility and accessible to children.

Correction Required: Toys and objects with a diameter of less than 1 inch, objects with removable parts that have a diameter of less than 1 inch, plastic bags and styrofoam objects may not be accessible to children who are still placing objects in their mouths.

Noncompliance Area: The agreement form for Child #1 did not contain a fee amount.

Correction Required: An agreement shall specify the amount of the fee to be charged per day or per week.
