Care Bear Day Care - Bovard PA Child Care Center

Noncompliance Area: On 11/5/20 the indoor temperature in the Infant Room was measured at 62.8 F. The temperature in Toddler Room was measured at 63 F and the temperature in the Upstairs Room was measured at 64.2 F. The facility reported having an issue with the heating system and were awaiting maintenance on a part.

Correction Required: The indoor temperature shall be at least 65 F.

Noncompliance Area: Space heaters were reportedly being utilized at the facility due to issues with the heating system.

Correction Required: Portable space heaters are not permitted.

Noncompliance Area: On 11/2/20 Staff Person #1, who had been removed from a child care taking position on 10/30/20 for not having an NSOR certificate, was observed to be providing care for children and a completed NSOR certificate was still not on file.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). Facility Person #1 may not work in a child care position at the facility.

Noncompliance Area: The rest equipment in the upstairs Preschool Classroom was not all labeled for the child it was intended for.

Correction Required: Individual, clean, age-appropriate rest equipment shall be provided for preschool, toddler and infant children as agreed between the child's parent and the operator. The rest equipment shall be labeled for the use of a specific child and used only by the specified child.

Noncompliance Area: An emergency contact form was observed to be missing for one child receiving care in the Toddler Classroom and two emergency contact forms were missing for children receiving care in the upstairs Preschool Classroom.

Correction Required: When children are in the facility, emergency contact information shall be present in a child care space for children receiving care in the space.

Noncompliance Area: The health assessment on file for Staff Person #2 lacked a statement that they had been examined for communicable diseases and the results of that examination and the physician's assessment of their suitability to provide child care.

Correction Required: An adult health assessment must include an examination for communicable diseases and the results of that examination. An adult health assessment must include the physician's or CRNP's assessment of the person's suitability to provide child care.

Noncompliance Area: The instructions for contacting the Regional Office were not posted with the Regulation Book and current Certificate.

Correction Required: The facility's current certificate of compliance and a copy of the applicable regulations under which the facility is certified shall be posted in a conspicuous location used by parents, with instructions for contacting the appropriate regional day care office posted at the same location.

Noncompliance Area: The file for Staff Person #1 lacked updated mandated reporter training within 60 months of their initial training.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services).

Noncompliance Area: The file for Staff Person #2 lacked a request for their NSOR certificate, State Police Clearance and verification that they had been fingerprinted for their FBI Clearance prior to starting in a child care taking position. Staff Person #2 was observed to be working alone with a group of children and they did not have a completed State Police, Child Abuse or NSOR certificate on file at the time of the inspection. Staff Person #2 has exceeded 45 days at the facility. The file for Staff Person #3 lacked a signed disclosure statement.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). Facility Person #2 may not work in a child care position at the facility. A provisional employee may not be permitted to work alone with children and must work within the vicinity of a permanent employee. A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL.

Noncompliance Area: In the upstairs Preschool Room a bottle of hand sanitizer labeled keep out of reach of children was observed on the radiator cover. A tube of toothpaste that was labeled to be kept out of reach of children under age 6 was observed on a low shelf outside the restroom. The items were accessible to children receiving care in the space.

Correction Required: Cleaning materials and other toxic materials shall be kept in an area or container that is locked or made inaccessible to children.

Noncompliance Area: The first aid kit in the Toddler Classroom was missing scissors.

Correction Required: A first-aid kit must contain the following: soap, an assortment of adhesive bandages, sterile gauze pads, tweezers, tape, scissors and disposable, nonporous gloves.

Noncompliance Area: At approximately 12:00 p.m. Staff Person #1 was observed alone in the Toddler Room with a mixed age group that included 1 young toddler, 3 older toddlers and 7 preschool age children while Staff Person #2 was preparing lunch in the kitchen. Staff Person #1 was observed to leave the Toddler Room to heat up a lunch in the Infant Room while Staff Person #2 was still in the kitchen This left the children alone in the Toddler Room as Staff Person #1 was in the Infant room and Staff Person #2 was in the Kitchen.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises.

Noncompliance Area: The Director has not consistently been scheduled to be present 30 hours per week at the facility.

Correction Required: A director shall be employed by a facility and be present at the facility site a minimum of 30 hours per week.

Noncompliance Area: At approximately 11:45 a.m. Staff Person #1 was observed to be alone in the Toddler Classroom with a mixed age group that included 1 young toddler, 3 older toddlers and 7 preschool age children while Staff Person #2 prepared lunch for the children. No other staff were present in the building to assist with meal preparation.

Correction Required: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements in 3270.51 (relating to similar age level).

Noncompliance Area: The swing set in the preschool area children play space did not have the required 9 inches of loose fill as Operator reported recently tilling the area to remove some grass that had grown in the area.

Correction Required: Outdoor equipment that requires embedded mounting must be mounted over a loose-fill or unitary playground protective surface covering that meets the recommendations of the United States Consumer Product Safety Commission. The equipment must be anchored firmly and be in good repair.
