Noncompliance Area: On 12/12/25, it was observed that the facility fire detection system had not been tested every 30 days. The last recorded facility system test was on 12/4/24.

Correction Required: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. § 1016(c)). The Director or designated staff person who is responsible for compliance with this chapter shall ensure the requirements under subsection (a) are met.

Description: Toxic plants not permitted

Noncompliance Area: On 4/24/25, it was observed that a Peace Lilly plant was on the table in the common area outside of the gym. Peace Lilly plants are considered toxic. CORRECTED ON SITE.

Correction Required: Toxic plants are not permitted in a child care space.

Description: Building Surfaces

Noncompliance Area: On 4/24/25, it was observed that the cover of the metal baseboard was broken and laying on the floor.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Description: Emergency plan

Noncompliance Area: On 12/6/24, it was observed that the facility had not completed an Emergency Drill in the previous 12 months.

Correction Required: Emergency drills shall be conducted annually. Annual emergency drills shall be documented and on file at the facility.

Regulation: 3270.113(a)

Description: Supervised at all times

Noncompliance Area: On 12/18/23, at approximately 7:45 am, it was observed that there was a lapse in supervision for an unknown amount of time. Upon entering the lobby/gym area it was observed that staff person 1 was across the lobby in the play area with 3 school age children. Upon entering the gym, it was observed that 5 school age children were alone in the room. One child was playing with a ball and the other 4 were climbing on a stack of chairs. One child returned to the gym after approximately 1 minute. Staff person 1 and the 2 remaining children returned to the gym after approximately 2 minutes.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. Children must be supervised at all times.

Description: Child's hands washed

Noncompliance Area: On 12/18/23, it was observed that the 8 school age children did not wash their hands before morning snack.

Correction Required: A staff person shall ensure that a child's hands are washed before meals and snacks, after toileting and after being diapered.

Description: General Health and Safety/Promote development

Noncompliance Area: On 12/18/23, it was observed that 4 school age children were climbing on 6 stacks of adult size chairs that were stacked 2-7 chairs high in the gym. There was no protective surfacing under the chairs to prevent injury in the event of a fall.

Correction Required: Conditions at the facility may not pose a threat to the health or safety of the children. Daily activities shall promote the development of skills, social competence and self-esteem. Daily experiences shall recognize the child as an individual and give some choice of activities that respect personal privacy, lifestyle and cultural background.

Description: Clean and good repair

Noncompliance Area: On 12/12/22, it was observed that the kitchen playset in the Kindergarten classroom was broken on the left side near the bottom. CORRECTED ON SITE.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Description: Consent for emergency medical care required prior to admission/Consent for administration of minor first-aid required prior to admission

Noncompliance Area: On 6/16/22, it was observed that child 2 did not have signed parental permission for emergency medical care or minor first aid. Child was present on the day of inspection.

Correction Required: A child's record shall contain signed parental consent for emergency medical care for the child. Written consent is required prior to admission. A child's record shall contain signed parental consent for administration of minor first-aid procedures by facility staff. Written consent is required prior to admission.

Description: Signed parental consent for transportation, walking excursions, swimming and wading

Noncompliance Area: On 6/16/22, it was observed that child 2 did not have signed parental consent for swimming while at the swimming pool.

Correction Required: A child's record shall contain signed parental consent for transportation, walking excursions, swimming and wading.

Regulation: 3270.66(a)

Description: Locked or inaccessible

Noncompliance Area: On 6/16/22, it was observed that cleaning supplies were kept in the unlocked, under the sink cabinet in the kitchenette in the basement classroom. Children were observed in the classroom and the kitchenette was accessible to the children. CORRECTED ON SITE.

Correction Required: Cleaning materials and other toxic materials shall be kept in an area or container that is locked or made inaccessible to children.

Noncompliance Area: Agreement for child #1 was not signed by the operator and did not specify the date of the child's admission.

Correction Required: An agreement shall be signed by the operator and the parent. An agreement shall specify the date of the child's admission.

Noncompliance Area: It was observed that the facility's pick up and drop off procedures were not posted.

Correction Required: Written notification of safe routes shall be posted by the operator at a conspicuous location in the child care facility.

Noncompliance Area: It was observed that the regulations, Chapter 3270, were not posted in a conspicuous location used by parents with instructions for contacting the appropriate regional day care office posted at the same location.

Correction Required: The facility's current certificate of compliance and a copy of the applicable regulations under which the facility is certified shall be posted in a conspicuous location used by parents, with instructions for contacting the appropriate regional day care office posted at the same location.

Noncompliance Area: File for staff person #1 did not contain documentation verifying that the annual emergency plan training was completed.

Correction Required: The operator shall assure that each facility person receives training regarding the emergency plan at the time of initial employment, on an annual basis and at the time of each plan update. The operator shall document the date of each training and the names of all facility persons who received the training and kept on file at the facility.

Noncompliance Area: It was observed that the ceiling vents in the upstairs room were dusty and unclean. It was observed in the upstairs room that the pull down steps, where one would access an attic space, was not secured to the ceiling, separated by a few inches, causing a visible hazard. It was observed that a table saw, containing a blade, was being stored under a stair well that is used by children in care making it accessible to those children.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Noncompliance Area: It was observed that a daily schedule was not posted in the gym, and the gym is being used as daily childcare space.

Correction Required: The written plan of daily activities shall be posted in the group space.

Noncompliance Area: Emergency contact form for child #1 did not contain the telephone number of the child's physician or source of medical care.

Correction Required: Emergency contact information must include the name, address and telephone number of the child's physician or source of medical care.

Noncompliance Area: Emergency contact form for child #3 did not include enrolling parent's work address.

Correction Required: Emergency contact information must include the home and work addresses and telephone numbers of the enrolling parent.

Noncompliance Area: It was observed that an inhaler was placed in the first-aid kit and was not being stored in its original container. It was stated that the child is being administered the medication but no medication log was observed.

Correction Required: A prescription or nonprescription medication may be accepted only in an original container. The medication shall remain in the container in which it was received. An operator is responsible to establish and maintain a medication log if prescription or nonprescription medication is administered.

Noncompliance Area: Files for children #1 - #5 all contained the original agreements.

Correction Required: A child's record shall contain a copy of the initial agreement and subsequent written agreements between the parent and the operator. The parent receives the original agreement.

Noncompliance Area: Facility's written emergency plan did not include a method for facility persons to inform parents that an emergency has arisen or ended.

Correction Required: The facility shall have an emergency plan that provides for a method for facility persons to contact parents as soon as reasonably possible when an emergency situation arises. Correction Required: A staff person or a substitute staff person shall meet one of the applicable staff qualifications for the position in which the person is performing.A facility person's record shall include acceptable verification of experience, education or training is a transcript or a diploma or a letter signed by a representative of the experiential, educational or training entity.

Noncompliance Area: It was measured in the woman's bathroom, used by children in care, that the water temperature was 128 degrees Fahrenheit.

Correction Required: Hot water temperature, in areas accessible to children, may not exceed 110 F.

Noncompliance Area: It was observed that band aids were missing from the first-aid kit used in the gym.

Correction Required: A first-aid kit must contain the following: soap, an assortment of adhesive bandages, sterile gauze pads, tweezers, tape, scissors and disposable, nonporous gloves.

Noncompliance Area: It was observed that the inside of the purple exit door in the gym had a line of sharp rusted metal at the bottom accessible to children.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Noncompliance Area: It was observed that the basement classroom used by children contained peeling paint.

Correction Required: Peeled or damaged paint or damaged plaster is not permitted on indoor or outdoor surfaces in the child care facility.

Noncompliance Area: It was observed that the basketball hoop in the gym was bent and appeared to be falling off the wall and not in good repair.

Noncompliance Area: Files for staff person #2 and #4, who have been counted in the staff-child swimming ratio, did not contain documentation verifying that water safety training was successfully completed.

Correction Required: A facility person who is counted in the staff-child swimming ratio shall annually complete water safety instruction.

Noncompliance Area: Staff person #1 had a start date listed of 6/4/19, but documentation on file for TB test was dated 11/2/16. Staff person #2 had a start date listed of 6/4/19, but documentation on file for TB test was dated 4/19/18.Therefore, a TB test conducted within 12 months prior to providing care was not found on file at facility for either staff person. File for staff person #2 also was missing a physical.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.An adult health assessment must include tuberculosis screening by the Mantoux method at initial employment. Subsequent tuberculosis screening is not required unless directed by a physician, physician's assistant, CRNP, the Department of Health or a local health department.

Noncompliance Area: File for staff person #3 was missing one written, nonfamily references from individuals attesting to the person's suitability to serve as a facility person.

Noncompliance Area: It was observed in the gym, where children receive care, there was a gymnastic mat that was ripped and not in good repair.
