Noncompliance Area: In the outside play space, observed 4 Big Wheels. There was one yellow, one green and two pink in color. Each of the Big Wheels had approximately a 2-3 inch crack in one of the three black wheels. Also, in the outside play space, observed a pink tricycle which had a pink plastic basket attached to the back of it. Two corner areas of the basket were cracked.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Noncompliance Area: The parent did not receive the original fee agreement for child #1 as the original was in the child's file.

Correction Required: A parent shall receive the original agreement. The facility shall retain a copy of the agreement.A child's record shall contain a copy of the initial agreement and subsequent written agreements between the parent and the operator. The parent receives the original agreement.

Noncompliance Area: There was more than six months between the previous and the most current and updated health assessment on file for child #2, who is a young toddler.

Correction Required: The operator shall require the parent to provide an updated health report at least every 6 months for an infant or young toddlerA child's record shall contain initial and subsequent health reports.

Noncompliance Area: In the Jungle Room first aid kit, observed burn gel which lacked the name of the child for whom the medication was intended. In the Ocean Room first aid kit, observed Vaseline lip therapy which lacked the name of the child for whom the medication was intended.

Correction Required: The label of a medication container shall identify the name of the medication and the name of the child for whom the medication is intended. Medication shall be administered to only the child whose name appears on the container.

Noncompliance Area: The file for staff #3, lacks a current and updated health assessment which was conducted within the past 24 months.

Correction Required: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem.A facility person's record shall include a written report of initial and subsequent health assessments, including the results of initial and subsequent tuberculin skin tests, x-rays or other medical documentation necessary to confirm freedom from communicable tuberculosis.

Noncompliance Area: Based on a conversation with staff, the breakfast at the facility consists of grain and dairy items. Two of the required three food groups were being served for breakfast.

Correction Required: Breakfast prepared at the facility for children of toddler age or older shall have at least one item from three of the following four food groups: dairy, protein, fruit and vegetable, grain.

Noncompliance Area: The facility provides breakfast, lunch, and snack. The breakfast and snack menu items were not posted. The lunch menu was posted.

Correction Required: An operator shall conspicuously post the menu at least 1 week in advance or provide a menu to each family.

Noncompliance Area: The most current fire safety training conducted on 5/21/2020, for staff 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, and 11 was not conducted by a fire protection professional.

Correction Required: Staff persons shall participate, at least annually, in firesafety training conducted by a fire protection professional. Staff persons and volunteers shall receive training in maintenance of smoke detectors, the duties of facility persons during a fire drill and during a fire and the use of the facility's fire extinguishers, not including discharge of the fire suppressant agent.A facility person's record shall include verification of child care experience, education and training following the outset of service at the facility.

Noncompliance Area: The files for staff #1, with start date of 5/26/20 and #5 with start date of 8/29/29, lack the correct disclosure statement required under the CPSL. The file for staff #1, with provisional hire date of 5/26/20, has a National Sex Offender application which is dated 07/28/2020. NSOR was not on file by provisional hire end date of 7/10/2020. There is now an NSOR on file. The file for staff #2, with provisional hire date of 3/16/2020, lacked an application for the NSOR on or before initial start date in a child care position. NSOR application is dated 5/21/2020. There is now an NSOR on file and dated 5/26/2020. There was more than 60 months between the previous State Police and Child Abuse clearances on file for staff #4. Clearance dates are as follows; State Police - 1/23/15 and then 5/11/2020, Child Abuse - 5/6/15 and then 7/27/2020.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL.

Noncompliance Area: The file for staff #5, who holds the title of aide, lacks verification of an 8th grade education. There are 2500 hours of child care experience on file.

Correction Required: An aide shall have a minimum of an 8th grade education and 2 years of experience with children. A facility person's record shall include verification of child care experience, education and training prior to service at the facility.

Noncompliance Area: Observed that the indoor Outback play space protective surface covering had an approximately a foot long area to the left of the entrance door which was starting to come loose. Thus, causing a tripping hazard to the children in care.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Noncompliance Area: Observed that one of the glass doors which leads to the outside play space lacked visual identification.

Correction Required: A visual strip or other visual identification shall be placed on glass located in a traffic area, a child care space or a play space.

Noncompliance Area: In the Outback boys bathroom, observed that one of the toilet stalls lacked a hand washing sign.

Correction Required: A facility person and an able child shall wash his hands after toileting and before eating. A sign on which this requirement is written shall be posted at each toilet, training chair, diapering area and sink in the facility.

Noncompliance Area: There was more than 60 days between fire drills. A fire drill was completed on 2/4/2020 and then on 6/25/2020.

Correction Required: A fire drill shall be held at least every 60 days. Facility persons and children in attendance shall participate in the fire drill. Facility persons and children shall exit the building, weather permitting.

Noncompliance Area: In the infant room, observed a Bumbo seat which lacked a safety strap. The Bumbo seats have been described as hazardous by the United States Consumer Product Safety Commission if they do not have a safety strap.

Correction Required: Children's toys and equipment, including furniture and rest equipment, described as hazardous by the United States Consumer Product Safety Commission may not be used by children at the facility and may not be on the premises at the facility. At the time of inspection, the operator shall submit to the Department written affirmation on a form provided by the Department stating that the facility is in compliance with this requirement.
