Description: Infant sleep position

Noncompliance Area: An infant was observed to be sleeping in a bouncer for approximately 10 minutes. There was not a note in the child's file from a doctor approving the use of a bouncer for the infant to sleep.

Correction Required: Infants shall be placed in the sleeping position recommended by the American Academy of Pediatrics unless there is a medical reason an infant should not sleep in this position. The medical reason shall be documented in a statement signed by a physician, physician's assistant or CRNP and placed in the child's record at the facility.

Description: Free from contagious/communicable disease

Noncompliance Area: child #1 and #2 were missing a statement from the physician or physician's assistant that the child is able to participate in child care and appears to be free from contagious or communicable disease.

Correction Required: A health report shall include a statement that the child is able to participate in child care and appears to be free from contagious or communicable disease.

Noncompliance Area: staff #1 had a child abuse clearance dated 2/12/26, FBI clearance dated 2/3/26, and an NSOR clearance dated 2/5/26, which were completed after working with children. Staff #2 had an FBI clearance dated 6/4/26 and a child abuse clearance dated 5/11/26, both of which were completed after working with children.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL.

Description: Training regarding plan

Noncompliance Area: During the inspection, the file for Staff #1 and Staff #2 did not contain documentation of the emergency plan training in 2024.

Correction Required: The operator shall assure that each facility person receives training regarding the emergency plan at the time of initial employment, on an annual basis and at the time of each plan update. The operator shall document the date of each training and the names of all facility persons who received the training and kept on file at the facility.

Description: Staff person - 18 yrs.

Noncompliance Area: During the inspection, it was verified, by Staff #3 and the director, that Staff #3 began working as a staff person at age 17 and was not enrolled in an approved curriculum related to childcare.

Correction Required: A staff person shall be 18 years of age or older.

Description: Comply with CPSL/Individual Records

Noncompliance Area: During the inspection, Individual #1 was functioning as a volunteer and did not have a volunteer file onsite in order to comply with state regulations and CPSL requirements.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). Individual # 1 may not work in a childcare position at the facility. An individual record is required for each facility person.

Noncompliance Area: During the inspection, the state police, child abuse, and FBI clearances were all received after the end of the 45-day provisional hire date for Staff #3. In addition, Staff #3 was working with children and did not have an NSOR certificate or disclosure statement on file.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). Facility Person # 3 may not work in a childcare position at the facility. Correction Required: An aide shall have attained one of the qualification levels specified in §3270.37(b)(1)-(3). A facility person's record shall include verification of child care experience, education and training following the outset of service at the facility.

Noncompliance Area: During the renewal inspection, while outside on the playground, emergency contact information was not present for Child #1, #2, #3, #4 and #5.

Noncompliance Area: During the renewal inspection, the last health report for Child #1 was dated 10/11/22 and had not been updated within 6 months as required for young toddlers.

Correction Required: The operator shall require the parent to provide an updated health report at least every 6 months for an infant or young toddler.

Noncompliance Area: During the renewal inspection, Staff #2 was observed caring for four school-age children unsupervised. Staff #2 has not completed the following pre-service training prior to caring for children unsupervised: Health and Safety.

Correction Required: A facility shall be operated in conformity with applicable Federal and State laws and regulations.State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children.

Description: Mantoux TB/Health assessment, TB test

Noncompliance Area: During the renewal inspection, the initial health assessment for Staff #2 did not include the results of tuberculin skin tests, x-rays or other medical documentation necessary to confirm freedom from communicable tuberculosis.

Correction Required: An adult health assessment must include tuberculosis screening by the Mantoux method at initial employment. Subsequent tuberculosis screening is not required unless directed by a physician, physician's assistant, CRNP, the Department of Health or a local health department. A facility person's record shall include a written report of initial and subsequent health assessments, including the results of initial and subsequent tuberculin skin tests, x-rays or other medical documentation necessary to confirm freedom from communicable tuberculosis.

Noncompliance Area: During the renewal inspection, a copy of the emergency plan had not been sent to the local municipality.

Correction Required: The operator shall send a copy of the emergency plan and subsequent plan updates to the local municipality and to the county emergency management agency.

Noncompliance Area: During the renewal inspection, the state police clearance for Staff #1 expired on 9/13/17 and was not renewed until 6/28/23 which was not within 60 months as required under the CPSL. Staff #2, a provisional hire, did not have an FBI clearance on file and was observed caring for four school-age children unsupervised. Also, Staff #2 started working with children prior to having either a state police or FBI clearance on file.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A provisional employee may not be permitted to work alone with children and must work within the vicinity of a permanent employee. A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person #2 may not work unsupervised in a childcare position at the facility.

Regulation: 3270.102(a)

Description: Clean and good repair

Noncompliance Area: During the renewal inspection, the blue chair in the toddler room was torn exposing the foam inside.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Description: ACIP recommended immunization record

Noncompliance Area: During the renewal inspection, the initial health report for Child #1 did not contain written verification from a physician, physician's assistant, CRNP, the Department of Health or a local health department of the dates (month, day and year) the child was administered immunizations in accordance with the recommendations of the ACIP.

Correction Required: The facility may not accept or retain an infant 2 months of age or older, a toddler or a preschool child at the facility for more than 60 days following the first day of attendance at the facility unless the parent provides written verification from a physician, physician's assistant, CRNP, the Department of Health or a local health department of the dates (month, day and year) the child was administered immunizations in accordance with the recommendations of the ACIP.

Regulation: 3270.131(e)(2)(i)

Description: Exemption documentation from parent/guardian

Noncompliance Area: During the renewal inspection, the immunization record did not include the influenza vaccine for Child #2. The file for Child #2 did not include a statement of exemption from immunization written, signed and dated from the child's parent or guardian.

Correction Required: Exemption from immunization for religious belief or strong personal objection equated to a religious belief shall be documented by a written, signed and dated statement from the child's parent or guardian. The statement shall be kept in the child's record.

Regulation: 3270.77(a)

Description: No peeling paint or plaster

Noncompliance Area: During the renewal inspection, peeled paint was observed on the inside door frame in the infant room.

Correction Required: Peeled or damaged paint or damaged plaster is not permitted on indoor or outdoor surfaces in the child care facility.

Noncompliance Area: During the renewal inspection, each staff person was not assigned specific children in the Infant/young toddler group, older toddler group and preschool/school-age group.

Correction Required: Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises.

Noncompliance Area: During the renewal inspection, the file for Staff #1 did not contain acceptable FBI documentation as required under the CPSL; the NSOR verification, dated 7/23/20 for Staff #2 and 7/24/20 for Staff #3, was received after the 7/1/20 deadline required under the CPSL for existing staff; the mandated reporter training for Staff #2 had not been updated within 60 months as required under the CPSL.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services).A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL.

Noncompliance Area: During the renewal inspection, soap was missing in the infant/toddler, preschool/school-age and outside first aid kits. Scissors and tweezers were also missing in the outside first aid kit.

Correction Required: A first-aid kit must contain the following: soap, an assortment of adhesive bandages, sterile gauze pads, tweezers, tape, scissors and disposable, nonporous gloves.

Noncompliance Area: During the inspection, the immunization record for Child #1 did not include the 6-month rotavirus vaccine.

Correction Required: The facility may not accept or retain an infant 2 months of age or older, a toddler or a preschool child at the facility for more than 60 days following the first day of attendance at the facility unless the parent provides written verification from a physician, physician's assistant, CRNP, the Department of Health or a local health department of the dates (month, day and year) the child was administered immunizations in accordance with the recommendations of the ACIP.

Noncompliance Area: During the inspection, the file for Staff #1, #2, #3 and #4 did not contain proof of annual fire safety training conducted by a fire protection professional.

Correction Required: Staff persons shall participate, at least annually, in firesafety training conducted by a fire protection professional. Staff persons and volunteers shall receive training in maintenance of smoke detectors, the duties of facility persons during a fire drill and during a fire and the use of the facility's fire extinguishers, not including discharge of the fire suppressant agent.

Noncompliance Area: During the inspection, the water temperature was 120 F in the children's bathroom.

Correction Required: Hot water temperature, in areas accessible to children, may not exceed 110 F.

Noncompliance Area: During the inspection, a first aid kit was not present in the infant room.

Correction Required: A first-aid kit shall be in a child care space.

Noncompliance Area: Observed children's Motrin, infant pain and fever medicine were not labeled with the name of the child they were intended for stored with children's medication.

Correction Required: The label of a medication container shall identify the name of the medication and the name of the child for whom the medication is intended. Medication shall be administered to only the child whose name appears on the container.
