Noncompliance Area: At time of renewal inspection on 7/2/25, the health assessment for staff #1 did not have questions #2 and #3 answered by the physician regarding communicable diseases and suitability to provide child care.

Correction Required: An adult health assessment must include an examination for communicable diseases and the results of that examination. An adult health assessment must include the physician's or CRNP's assessment of the person's suitability to provide child care.

Noncompliance Area: At time of renewal inspection on 7/2/25, the file for staff person #2 contained an out of state driver's license showing the staff person resided outside of PA within the past 5 years, but there was no documentation of the applications or completed out of state clearances that are required.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). LACKING REQUIRED HIRING DOCUMENTS: Facility Person #2 may not work in a child care position at the facility. A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person #--- may not work in a child care position at the facility.

Description: Locked or inaccessible/Small Toys and Objects

Noncompliance Area: At time of renewal inspection on 7/2/25, hand sanitizer was observed in several classrooms throughout the facility and was accessible to children. Additionally, plastic bags with diapers and extra clothing were observed under changing tables and in cubbies in several classrooms throughout the facility and were accessible to children.

Correction Required: Cleaning materials and other toxic materials shall be kept in an area or container that is locked or made inaccessible to children. Toys and objects with a diameter of less than 1 inch, objects with removable parts that have a diameter of less than 1 inch, plastic bags and styrofoam objects may not be accessible to children who are still placing objects in their mouths.

Noncompliance Area: During the renewal inspection on 7/11/24, the facility's emergency plan had not been updated to meet the Federal requirements 45 CFR 98.41(a)(1)(vii), which includes having a plan for continuity of operations in the event of a disaster.

Correction Required: A facility shall be operated in conformity with applicable Federal and State laws and regulations.State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children.

Description: Written statement

Noncompliance Area: During renewal inspection on 7/11/24, two out of the four infants in the Koalas Room did not have formula and feeding schedules obtained from the parents.

Correction Required: A written statement giving the formula and feeding schedule for an infant shall be obtained from the parent.

Description: Emergency plan/Letter to parents

Noncompliance Area: During renewal inspection on 7/11/24, the facility's emergency plan and the letter given to parents regarding the emergency plan, were missing information. The emergency plan itself was missing the word lockdown and the procedures that will be followed during a lockdown. The letter that is given to parents at the time of enrollment did not include lockdown procedures and did not include how children who are non-walkers, children who have disabilities and/or chronic medical conditions will be accommodated.

Correction Required: The facility shall have an emergency plan that provides for accommodations for shelter of children during an emergency including lock-down, shelter in place at the facility and shelter at locations away from the facility premises. The operator shall provide to the parent of each enrolled child a letter explaining the emergency procedures. The operator shall also provide to the parent of each enrolled child a letter explaining any subsequent update to the plan.

Description: Health and Safety Training - Pediatric First Aid and CPR

Noncompliance Area: During renewal inspection on 7/11/24, the first aid and CPR certification held by staff person #1 was not Pediatric first aid and CPR and the training was not conducted by a PQAS instructor.

Correction Required: Staff persons shall complete professional development in pediatric first aid and pediatric cardiopulmonary resuscitation within 90 days of hire.

Noncompliance Area: During renewal inspection on 7/11/24, the file for staff person #2 included mandated reporter training that was more than 60 months old, with a date of 7/7/24.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). PROVISIONAL HIRE UNSUPERVISED: A provisional employee may not be permitted to work alone with children and must work within the vicinity of a permanent employee. A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL.

Description: Protective Outlet Covers 5 yrs. or less

Noncompliance Area: During renewal inspection on 7/11/24, unused phone jack/computer ports were observed in the Pandas and Zebras room; these ports were not covered and were accessible to children younger than 5 years of age.

Correction Required: Protective receptacle covers shall be placed in electrical outlets accessible to children 5 years of age or younger.

Noncompliance Area: There was not the required verification of experience in the record of facility staff #2 who is listed as an assistant group supervisor.

Correction Required: A facility person's record shall include verification of child care experience, education and training prior to service at the facility.

Noncompliance Area: Facility staff #1 did not have the out-of-state clearances required for any staff who has lived in another state within the past 5 years.

Regulation: 3270.31(e)(1)(i)

Description: By accredited secondary or postsecondary institution approved by PDE

Noncompliance Area: Facility staff #2 had a diploma from a foreign country and there was not an evaluation for the US equivalency.

Correction Required: Training conducted by a secondary or postsecondary institution is acceptable when the institution is approved by the Department of Education and accredited by an accrediting agency recognized by the United States Department of Education or the Council of Postsecondary Accreditation and acceptable to the Department of Education.

Description: Health and Safety Training - Pediatric First Aid and CPR

Noncompliance Area: Facility staff #1 did not have the required pediatric first aid and cpr training. Facility staff #1 had online pediatric first aid and cpr that did not include an in-person component as required.

Correction Required: Staff persons shall complete professional development in pediatric first aid and pediatric cardiopulmonary resuscitation within 90 days of hire.

Description: Mixed Age Level

Noncompliance Area: During the onsite visit on 8/2/2022, Certification Representative observed 6 older toddlers and 7 preschoolers with two staff in the outdoor play space.

Correction Required: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements in § 3270.51 (relating to similar age level).

Noncompliance Area: Certification Representative observed several cots in several classrooms that did not have at least 2 feet of space on three sides of the equipment.

Correction Required: At least 2 feet of space is required on three sides of a bed, cot, crib or other rest equipment while the equipment is in use.

Noncompliance Area: There was not updated health assessments at least every 6 months for facility child #1 whose date of birth was 11/6/2017. The only health assessment in the record was dated 8/12/2018. There was not updated health assessments at least every 6 months for facility child #2 whose date of birth was 2-9-2018. There were two health assessments in the record with dates of 6/4/2018 and 6/21/2019.

Correction Required: The operator shall require the parent to provide an updated health report at least every 6 months for an infant or young toddler

Noncompliance Area: The facility has used two 11-15 passenger vans to transport children.

Correction Required: In accordance with the requirements of 67 Pa. Code Chapter 171 (relating to school buses and school vehicles), the facility may not transport a child in an 11-15 passenger van.

Noncompliance Area: The facility emergency plan was not updated at least annually and when changes in the plan were made. The emergency plan review/update was dated 3/6/2018. Certification Representative noted that part of the plan still listed the previous relocation facility which had been since changed.

Correction Required: The operator shall review the emergency plan at least annually and update the plan as needed. The operator shall document in writing each review and update of the emergency plan and kept on file at the facility.

Noncompliance Area: Facility staff #1 - #4, who are permanent employees had volunteer state police clearances in their record.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services).

Noncompliance Area: During renewal inspection on 6/20/18 certification representative observed an inhaler for child # 10 that was not in the original box and did not have a label to identify the medication and the child. The inhaler had the child's name making taped to it.

Correction Required: A prescription or nonprescription medication may be accepted only in an original container. The medication shall remain in the container in which it was received. The label of a medication container shall identify the name of the medication and the name of the child for whom the medication is intended. Medication shall be administered to only the child whose name appears on the container.

Noncompliance Area: During renewal inspection on 6/20/18 certification representative observed an Epipen with an expiration date of 1/2018 for child # 9.

Correction Required: Medication shall be stored in accordance with the manufacturer's or health professional's instructions on the original label.

Noncompliance Area: During renewal inspection on 6/20/18 certification representative reviewed several staff files. Staff # 4 had an expired Child Abuse clearance that was dated 4/30/13.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services).

Noncompliance Area: During renewal inspection on 6/20/18 certification representative observed damaged paint in Room 202 by the music area and in Room 207 by the door.

Correction Required: Peeled or damaged paint or damaged plaster is not permitted on indoor or outdoor surfaces in the child care facility.
