Although Staff #3 served as a VOLUNTEER from 08.31.2022 to 06.03.2024, Staff #3 was hired as a full-time staff person on 06.04.2024 and did not obtain the appropriate State Police Clearance required for employment at that time.

Description: Small Toys and Objects

Noncompliance Area: Observed foam sponges used for Art projects on a low surface in the Main Room that were accessible to the children in care. Observed empty plastic bags hanging in the girls' bathroom that were accessible to the children in care. In the Toddler Gross Motor Space there was a foam block that had tears in the seam allowing the foam to be accessible to the children in care. All of these items were accessible to children who are still placing objects in their mouths.

Correction Required: Toys and objects with a diameter of less than 1 inch, objects with removable parts that have a diameter of less than 1 inch, plastic bags and styrofoam objects may not be accessible to children who are still placing objects in their mouths.

This policy is to be posted in all rooms and near the restroom doors and all staff will sign the policy to attest that they have received the policy. The operator will submit this policy to the Certification Representative once completed.

The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises.

Correction Required: A health report shall include a review of the child's immunized status according to recommendations of the ACIP. The facility shall implement dismissal policies in accordance with the Department of Health regulation in 28 Pa. Code § 27.77 (relating to immunization requirements for children in child care group settings). Child #4 must be dismissed from care by close of business 2/27/24 and may only return to care when the immunization record is updated or when a parent provides a written, signed exemption letter.

Noncompliance Area: In the Infant Room, there was a bottle of Gripe Water used to treat infant gas, that did not identify the name of the child for whom the medication was intended.

Correction Required: The label of a medication container shall identify the name of the medication and the name of the child for whom the medication is intended. Medication shall be administered to only the child whose name appears on the container.

Noncompliance Area: Observed the Child Emergency Contacts for the facility in an unlocked storage box in the unlocked Outdoor PlaySpace which leaves confidential information vulnerable.

Correction Required: Child records are confidential and shall be stored in a locked cabinet.

Description: General Health and Safety

Noncompliance Area: Located in the Hallway and the Main Room there were oscillating fans that were plugged in. These fans were in reach of the children, posing a threat to any child that was in care. In the boy's bathroom was a black milk crate that was turned upside down and being used as a step stool for the children to wash their hands posing a falling hazard to the children in care. In the Preschool Room there was an extension cord running from the TV which was hung on the wall to the outlets that was close to the floor. This extension cord was loose and therefore, created a strangulation hazard to the children in care.

Correction Required: Conditions at the facility may not pose a threat to the health or safety of the children.

Noncompliance Area: In the Preschool Room there was an electrical outlet hanging from the wall on an extension cord that lacked a protective receptacle cover. In the unlocked furnace room off of the Preschool Classroom there was an outlet on the far wall that lacked a protective outlet cover. Both of these outlets were accessible to children 5 years of age and younger.

Correction Required: Protective receptacle covers shall be placed in electrical outlets accessible to children 5 years of age or younger.

Description: Building Surfaces

Noncompliance Area: In the Outdoor PlaySpace there was splintering wood on the far side of the fence along the ground creating a cutting hazard for the children in care. On the back of the storage box which held the Emergency Contact Forms and First Aid Kit in the Outdoor PlaySpace there were two metal hooks protruding out from the box creating a slicing hazard for the children in care. In the Outdoor PlaySpace along the wooden railing that separates the black top from the play equipment there were two screws protruding out creating a cutting hazard to the children in care. In the Preschool Classroom there were ten vents on the ceiling tiles that were covered in a black substance, there were four ceiling tiles that were missing pieces, and three ceiling tiles in which they were not secured in the ceiling, all of these created a crushing hazard to the children in care. In the Preschool Room there were two pipes and two metal hooks sticking out from the wall next to the right wall when entering the room. Both of the pipes and the metal hooks created a cutting hazard to the children in care. Along the far wall in the Preschool Classroom and the right-side wall the baseboard was not attached to the wall, creating pinch points for the children in care. In over ten spots on the floor in the Preschool Room, gaps in the flooring caused the movement in the flooring planks, creating a pinching hazard to the children in care. In the Hallway outside the two bathrooms, there were two pipes sticking out of the wall creating a cutting hazard to the children in care. In the Hallway there was an emergency light that was dangling from the ceiling with exposed wires and at the bottom of the steps there was an electrical box that had exposed wires that was not secured into the wall creating a crushing hazard to the children in care.

Correction Required: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards.

Description: No peeling paint or plaster

Noncompliance Area: In the Preschool Room, there was peeling light blue paint on the left wall underneath the dry erase board. On the painted chalkboard int he Preschool Room there was peeling black paint in the lower right-hand corner. In the Toddler Gross Motor space there was peeling blue paint along the far wall.

Correction Required: Peeled or damaged paint or damaged plaster is not permitted on indoor or outdoor surfaces in the child care facility.

Description: Stairs, exits, etc. unobstructed

Noncompliance Area: Observed the side exit door off of the Main Room was partly blocked due to boxes and a gate. Observed the side exit door off of the Preschool Room was partly blocked due to a metal stool and door in the wooden frame that was leaning against the wall on the landing.

Correction Required: Stairways, hallways, exits from rooms, exits from the facility and other means of egress serving as an exit shall be unobstructed.

Description: Inpatient hospitalization or ER treatment of child

Noncompliance Area: Based on conversation with staff, the facility was notified on 5/1/23 that child #1 was treated at Children's hospital on 4/29/23. The department was initially notified of the ER treatment on 5/4/23. The child had injured their left arm while using the monkey bars in the facility's playground on 4/26/23 and at that time, there was no apparent injury to the child.

Correction Required: The operator shall immediately notify a child's parent and shall telephone notice to the appropriate regional office within 24 hours if a child in care at the facility is hospitalized or receives emergency room treatment.

A short time later, when the same staff and children were sitting down for lunch in the main room, staff person #2 went to the bathroom to grab wipes, leaving staff person #1 briefly out of ratio with all 8 children. The bathroom is off the infant room.

Correction Required: When children are grouped in mixed age levels, the age of the youngest child in the group determines the staff:child ratio and maximum group size in accordance with the requirements in § 3270.51 (relating to similar age level).

Noncompliance Area: Upon review of the Facility Files it was verified that Facility Person #3 did not have a valid health assessment on file and that it had been photo copied from the last examination and the date had been changed to reflect 2022. Upon questioning the validity the Operator verified the prior assessment had been copied to Certification Representative. The Fire Safety Trainings on file for Facility Person's #1, #2, #3, #4, #5 and #6 were also not valid in that the Certificates from 2020 had been copied and dated to reflect a training occurring in 2021. Upon questioning the validity, Operator verified to Certification Representative that the Facility Persons did not participate in annual Fire Safety Training in 2021.

Correction Required: The Department may deny, refuse to renew or revoke a certificate of compliance for fraud or deceit in obtaining or attempting to obtain a certificate of compliance.

Staff persons and volunteers shall receive training in maintenance of smoke detectors, the duties of facility persons during a fire drill and during a fire and the use of the facility's fire extinguishers, not including discharge of the fire suppressant agent.

Two bottles of hand sanitizer were observed to also be accessible to the children in the classroom. In the hallway outside the restrooms a container of Clorox Wipes were observed on a low shelf and could be accessible to children traveling between the classrooms and the indoor gross motor room. All items were labeled Keep Out of Reach of Children.

Correction Required: Cleaning materials and other toxic materials shall be kept in an area or container that is locked or made inaccessible to children.

Noncompliance Area: The facility lacked proof of purchase of their interconnected fire alarm system. The facility also lacked verification of an annual fire alarm inspection. An inspection of the Sprinkler System was all that was available.

Correction Required: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. §  1016(c)).The Director or designated staff person who is responsible for compliance with this chapter shall ensure the requirements under subsection (a) are met.

Noncompliance Area: One cracked bin with a potential pinch point was observed in the Preschool area.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Noncompliance Area: The file for Children #3 and #5 lacked child service reports that had been completed every 6 months.

Correction Required: The services to be provided to the family and the child, including the Department's approved form to provide information to the family about the child's growth and development in the context of the services being provided. The operator shall complete and update the form and provide a copy to the family in accordance with the updates regarding emergency contact information in 3270.124(f) (relating to emergency contact information).

Noncompliance Area: The current emergency contact form for Child #1 lacked the physician information for the child. The current emergency contact forms for Children #2 and #6 lacked the addresses for the physician's.

Correction Required: Emergency contact information must include the name, address and telephone number of the child's physician or source of medical care.

Noncompliance Area: The emergency contact form for Child #1 lacked the health insurance coverage and policy number for the child.

Correction Required: Emergency contact information must include health insurance coverage and policy number for a child under a family policy or Medical Assistance benefits, if applicable.

Noncompliance Area: The emergency contact form for Children #1 and #4 lacked the addresses for the release person's listed.

Correction Required: Emergency contact information must include the name, address and telephone number of the individual designated by the parent to whom the child may be released.

Noncompliance Area: In the medication cabinet in the office one expired Benadryl and one expired Acetaminophen were observed.

Correction Required: Medication shall be stored in accordance with the manufacturer's or health professional's instructions on the original label.

Noncompliance Area: Medication logs were missing for three Acetaminophen medications in the medication cabinet in the Office.

Correction Required: A parent shall provide written consent for administration of medication or a special diet.

Noncompliance Area: The current health assessment on file for Staff Person #4 lacked the professional title of the health professional who completed the examination.

Correction Required: A health assessment shall be conducted and a report shall be written and signed by a physician, physician's assistant or CRNP. The signature must include the individual's professional title.

Noncompliance Area: Infant feeding scheduled written by parents were not on file for three infants receiving care at the time of the inspection.

Correction Required: A written statement giving the formula and feeding schedule for an infant shall be obtained from the parent.

Noncompliance Area: The files for Staff Person's #1, #2, #3 and #4 lacked updated FBI clearances within 5 years as required by the CPSL.

Correction Required: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). Facility Person #4 may not work in a child care position at the facility.

Noncompliance Area: One electrical outlet was observed to be missing a protective receptacle cover in the art area in the back of the toddler child care space.

Correction Required: Protective receptacle covers shall be placed in electrical outlets accessible to children 5 years of age or younger.

Noncompliance Area: A first aid kit was observed to be sitting on a table in the school age area and could be accessible to children who receive care in the space.

Correction Required: A first-aid kit must be inaccessible to children.

Noncompliance Area: The first aid kit in the Infant classroom was missing tape.

Correction Required: A first-aid kit must contain the following: soap, an assortment of adhesive bandages, sterile gauze pads, tweezers, tape, scissors and disposable, nonporous gloves.

Noncompliance Area: The Facility has utilized a high chair for time out purposes for a young toddler in care.

Correction Required: A facility person may not restrain a child by using bonds, ties or straps to restrict a child's movement or by enclosing the child in a confined space, closet or locked room. The prohibition against restraining a child does not apply to the use of adaptive equipment prescribed for a child with special needs.

Noncompliance Area: In the School Age area of the classroom a broken pillar which caused a sharp edge was observed in a barbie house. A cracked toy box lid was also observed in the School Age Classroom.

Correction Required: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts.

Noncompliance Area: The refrigerator in the Infant Classroom was observed to measure at 55 F.

Correction Required: A facility shall have an operable, clean refrigerator used to store potentially hazardous foods. The refrigerator shall be capable of maintaining food at 45 F or below. An operating thermometer shall be placed in the refrigerator.

Noncompliance Area: At approximately 1:05 pm Staff Person #1 was observed to be seated on the floor with their back to 3 infants sleeping in pack and plays in the nap area of the classroom. This position did not allow for the staff person to be able to properly supervise the children.

Correction Required: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises.

Noncompliance Area: The agreement for Child #4 lacked the arrival and departure times for the child.

Correction Required: An agreement shall specify the child's arrival and departure times.

Noncompliance Area: The original agreements were observed to be in the children's files.

Correction Required: A parent shall receive the original agreement. The facility shall retain a copy of the agreement.

Noncompliance Area: The emergency contact form for Child #7 lacked emergency contact persons information.

Correction Required: Emergency contact information is required for each enrolled child. Emergency contact information must reference who shall be contacted in an emergency.

Noncompliance Area: The emergency contact form for Child #4 lacked the addresses for the release persons listed.

Correction Required: Emergency contact information must include the name, address and telephone number of the individual designated by the parent to whom the child may be released.

Noncompliance Area: A book bag containing 2 Epipens was observed to be hanging from a hook in the children's locker area. The bag could be accessible to children while retrieving items.

Correction Required: Medication shall be stored in a locked area of the facility or in an area that is out of the reach of children.

Noncompliance Area: A preschool age child was observed to be laying on the floor of the boys restroom while having their diaper changed. A mat or other surface covering was not in place to allow for the area to be sanitized following the diapering.

Correction Required: Diaper changing surfaces shall be cleaned after each use by wiping the surface with a sanitizing solution or by changing a pad or other surface covering.

Noncompliance Area: An infant who was 5 1/2 months old was observed to be lying on the floor drinking a bottle. The infant was not being held while being bottle fed.

Correction Required: An infant 6 months of age or younger shall be held while being bottle fed.

Noncompliance Area: A bottle of bleach water solution was observed above the cubbies containing food in the infant room.

Correction Required: Cleaning materials and other toxic materials shall be stored in an original labeled container or in a container that specifies the content. Toxics shall be stored away from food, food preparation areas and child care spaces.
